At a Court of Assistante held the third of Aprill, 1637, in xiijth Teare of the Raigne of our Souraigue Lord, Charles, by the Grace of God o,f Eng land, Scotland, France, & Ireland Kinge, Defendor, &c. i It is also agreed by the Court that those tenn men of Saiigust, viz, Ed- mond Freeman, Henry Fealve, Thomas Dexter, Edward Dillingham, William Wood, John Carman, Iliehard Chad- well, William Almy, Thomas Tapper, & George Knott shall have liberty to view a place to sitt down & have suffl- eient lands for three score f amylies vpon the conditions propounded to them by the Governor and Mr. Wins- lowe G March, 1638 —"Mr. John Vincent is -elected constable for Sandith, and was sworne to seaue in the said office from this Court to the end of the next gover- ment, viz, for a yeare and a quarter. It is agreed vpon by the Court, that Captaine Staudish and Mr. John Alden . shall, with all convenient speede, goe ', to Sanditch, and set forth their bounds 'Of the lande graunted to them. An Answere to the Propositions made by Mr. Leveridge & others, of Sandwich, concerning the Lande there. Pro: 1. Whether the vndertakers bane a full guift of the lauds at Sandwiche, or whether a conditional graunt onely, for the setling of such a convenient number there that may be vsef ull for the common wealth, & cheifly fltt for church fellowship? Ans: To the first we answere, for yor terme of vndertakers, we rather put instead thereof commities, as suting more properly with the relation twixt them and vs, their grauut bein" condi tional, and not absolute; and the trust committed to them being for the ease of the goument, and more convenient accomodation of such people as shalbe quallifyed according to the condition and intent of the grauut, and their joynt promise. Pro: 2. Whether such of them as are still at Saugust shall haue any power at all there, either to dispose of thiuges, or to possesse any lands at all in case they come not to inhabite? Ans: To the second we answere neg- atiuely; for when they made suite to us, it was as a people streitened & pre tending remouall really wth all possible eonveniency. Pro: 3, Whether it may not be thought convenient to ad some others in their stead to the rest in case they come not? such as are of ye church there, or neighbours of good report? MEMORAND: That John Kerman, of Sandwich, is graunted one messuage, or dwelling house, in Sandwich afore said, and fl'fteene acres ot vpland. be it more or lesse, adjoyneing therevnto, abutting vpon the meddowes of Moon- uscussett; sixteene acres of marsh meddow ground, be it more or lesse, wth two little ilands of vpland therein, (exxcept the said ilands of vpland). lying before the said towne ot Sand wich eastward, and faceins the riuer that comes vp to the said' towne, the said John Kerraain allowing a way for carryages onely; eight acrees of marsh meddow, be it more or lesse, lying at the vpper end of the townes-neok from the swamp towards the beach at the east end, and towards Richard Chad- wells meddow at the west end; tenn acres of vpland, be it more or lesse, lying at Moonusoaulton, & adjoyuiug the landes of Mr. Edmond Freeman; and fourescore and tenn acres lying at the playues, and abutting upon the landes of Mr. Thomas Dexter and Mr. Edward Dillinghame. southerly from them, wth all and singuler tbapper- tences to the said premisss belonging, and in any wise appertaineing & euery part & parcell thereof: to haue and to hold the said messuage or dwelling house, XV acres of vpland. xvjteene acres of marsh meddow (except the two ilands of vpland theriu before excepted.) and eight acrees of marsh meddow, tenn acres of vpland at Moon- uscaultou, and the said fourescore and tenn acrees of vpland lying at the playnes, with all & singuler their appertencs. & euery part and parcell thereof, except before excepted, vnto the said John Kermau, his heires asignes foreuer, to the onely proper use and behoofe of him, the said John Kerman,his heires aud assignes foreuer. 17 June, 1641. Lettres of ailministra- con are graunted to Joane Swyft, of Sandwich, to administer vpon her hus- bandes estate, and to pay the debts as farr as the estate will amount vnto. by equall proporcons, and is bound to the Gou & Assistantes to do it, &Daniell Wing wth her, 20 August, 1644. Robte Boatflsh is lyeensed to draw wyne at Sandwich; and when he is at any time wthout, it shalbe lawfull lor Willm Newland to sell wyne to persons for their neede. Gerog Allen, of Sandwich, is lyvenscd to cutt hey at the pondes beyond Sand wich Playnes, so he giue not the Indians any thinge for yt wthout approbacon of the Bench. 7 July, 1646. It is agreed vpon and ordered by the Court, that when the inhabitantes ot Sandwich haue payd a debt ot xvij li or xviij li, oweing to .the old company, and payd the charges and purchase of their towneship, or such a sume as Mr. Thomas Prence and Captaine Miles Standish shall agree vpon. that then the comittees or vnder takers shall yeild vp the lands vndes- posed to the towne, to be giuen forth and disposed by such persons as the towne shall appoynt, and that euery inh.abitant haueing lands graunted him shall pay proportionably to the sd paymentes. 4 October, 1648. The Court haue or dered, concerning Thomas Dunham, that bee abstaine from coming att or sending vnto Martha Knote, of Sand widge. from this present day vntell the first Tuesday of Desember next, vntell the Court can better deserne the treuth of bis pretended contracte with the sd Martha Knote, vnlass the Gouerner, vpon clearing of thingea, shall giue him leaue. BEFORE Edward Winslow. Miles Staudish, and Edmond Freeman, geu- telron, three of the Assistantes of the gouermnt aforesaid, by vertue of the order ot the Generall Court of the first of June last past, whereby the said Edward Winslow, Miles Staudish, Ed mond Freeman, and John Browne, or any two or three of them, were author ized to set the bouudes of Yarmouth and Barnestable. and to heare and de termine all causes and controuersies amongst the inhabits of Yarmouth. Barnestable & Sandwich, wch shall come before them, &c. At the Generall Court holden at New Plymouth, the 7th of October. 1651. Att this Court Ralph Allin, Senior, of Sandwidge. and Richard Kerbey were summoned to answare for theire de riding, vild speeches of and conserniug Gods word and ordinances: they are bound ouer vnto the next Generall Court to make theire appeerance, and in the mean time to bee of good be havior towards all manor of persons, & not to depart the said Court without lycence accordingly, as followeth: — Ralph Allin, Senior, of Sandwidg, ac- knowlidgeth to owe vnto the Court the sura of 20 pounds. Mr. Tho Dexter, Senior, the sum of 10 pounds. William Basset, the younger, the sum of 10 pounds. The condicion, that if the said Ralph Allen shalbee of good behauior towards towards all manner of persons, and appeere at the Generall Court to bee holden at Plymouth the first Tuesday in March next, and not depart the said Court without lycence; that then, &c. Richard Kerbey acknowledgeth to owe vnto the Court the sum of 20 pounds. Tho Launders, the sum of 10 pounds. Ralph Allen, Senior, the sum of 10 pounds. Rose Newland, Edmond Freeman, Senior, and his wife, Goodwife Turner, aud widow Knott, all of the towne of Sandwige, for not frequenting the pub- lick worship of God, contrarye to order made the 6th of June. 1651. 17th of Jenewary, 16.52. " At a Towne Meetiug lawfetully warned by the Counstable with warrant from Captain Standige — yt upon speciall ocation it shall be laf ull for those yt live in ye towne to give order to ye Clarke, to set up a bill of ye placeby publiek writting and give publiek notis of a towne meeting. 24 February, 1652. It is ordered yt every inhaby of ye towne shall have his parte about ye tryall ot ye action oonseruing ye Bridge, 28 February, 16.52. Richard Bourne and Thomas Dexter Junior is duly constituted and apointed at a towne meeting to arrange a peaceable end of ye difference yt is betwixt the inhabi tants about Scuatton Neck and what soever shall be paid out in disburst- ments about ye said neck ye towne have bound themselves to pay it. 28 February, 1652. The towne hath authorised Thomas Dexter senor as the person where ye neighboring townes, to Witt— Bastable aud Yarmouth have apointed to an.?wer ye action yt River Bridge. . . .^^ Aprill ye 7, 1653. Wee the inhabby- tance of Sandige Doe hereby mgage ourselves to pay whatever James Skeff doeth ingage hiraselte in ye behalfe of ye towne for Pistols, Ponder, and Bullets, Drum and Cutlers and Halfe Pikes— And that both form of pay time and place— And alsoe wee doe ingage ourselves to pay him for his pames twenty shillings. . , ^ November 10th. 1653. It is ordered that noe man shall cut of any timber from the comon to sell it out or the towne, or wrought ether into or wheeles. plancke or bordesuponye for- feture of five shillings for every tree. Jenewary 24, 165.3. It is ordered that where a towne meeting is warned what soever is acted betwixt ten Ocloke in ye morning and four Oelok in ye alter- uoonne shall be authentick whosoever be absent. Provided, there shall be ten men in number at the said meeting. This above said order is voted downe and is null and not to be in force for ever—this last day of August 1676. May 13.1654. Thomas Lander doeth ingage himselfe to ye towne in five weeckes time to make current pay of — pounds three shillings eight pence in the townes behalfe to Mr. Nud.ie of Boston, in Tarr and too bee satisfied by ye towne in marohantable corne at harvest. June 2eth, 1G54. The towne hath gineven full power tooe Mr. Edward Dillingham and Richard Bourne in theire behalfe to agree with Tho. Dexter to goe on to build the Mill new againe and what the said Mr. Edward Dilling ham and Richard Bourne doeth promise to the said Tho. Dexter the towne hath iugaged themselves to stand to theire agreement. Widdow Bodfish hath liberty granted her to put upon the Towne Neck three of her cattle besides her calves. The 18 day of May. 1655. The towne hath agreed with Matthew Alliu to put up the Pound with all new white oak postes, only free from the charge of the towne that ordereth the repair — This is to be performed at or before the 4 of June next insuin the date hereof and the towne are to give him the poles for his paines. AUsoe the towne hath lent Goodie Bodfish of corne tell they call for itt, of that in Thomas Borgis hand of the Levy. 1G55. To Mr. Leveridge: Loving Brother— It is the ernest desier of our friends with oursolves, all whose names are under wrighten. to incurrage by a cleare call to continue and imploythespiritualgittand tallant which God of his goodness and mercy hath bestoed uppon you hopping yt if it please ye Lord to incline your hart to answere as in our desiers wee will not bee to recompence your labor of love. It is agreed upon by the Towne to pay unto Richard Bourne 20 s (Shillings) and his Levie, for much as he is rated in the 10 lb. (ten pounds) levie, lastly made, in consider ation of his labour and paines that he hath taken in businesse concerning the Towne, as in selling of lands to satisfie ye committees and ye like. It is likewise agreed upon by the Towne that there shall be a Levie of Five Pound raised for Mr. Leveridge, for to pay for covering and parting of his house wth board, wch was long sinse promised to be done for him by the Towne — and asrreed that this Levie - shall be made by those foure men woh wer chosen to make the tenn pound levie above mentioned, vide, Mr. Vin cent, William Newland, Thomas Tup per, Robert Bodfish. ^ May 22, An. 1651. It is ordered by the Towne that these foure, Goodman Tup per. Goodman Burge, Senior, Nathaniell Willis and William Gifford shall have power to call a towne meeting, they seeing occations tor ye same, giving tho towne three dayes warning, and these meetings thus warned shall be lawfull meetings, aud what neighbor shall stay above an houre after ye time appointed, shall loose their voats in what is done before they come. It is ordered that the Counstables shall every yeare give up theire ac counts unto the towne at the towne meeting, for that yeare they have been Counstables, before they chose another, or else to stand anoter year Counstable. May 22th. It is agreed upon by the Towne, that iu regard Peter Wright wants land and upon his request ot half a doasen ackers of the towne they have manifested themselves likely to be freely willing to give him soe much. May 22th. Moreover, The Towne have freely given also unto Nathaliel Willis six ackers of land in regard to his great neede of land both to build and plant on'. June 23th. It is now agreed upon by the towne yt the forementioned Peter Wright shall range out his six ackers of land aboue granted him, along by the East side of Mr. Feakes. his land tow ards Spriug Hill aboue the cartway— betweene Mr. Feakes, his land and ye Wovles Hollow. November 21th. It is ordered by the Towne that these five men. viz: Mr. Vincent, Thomas Tupper. Will. New- land, Richard Bourne and James Skiff being chosen by the towne shall make a levie of six Pound wch was agreed upon them iiy the towne to be done for the pairaent of the Clarke and the Committees. March 12th. 16.52. The Towne hath agreed wth Daniell Wing and Michael Blackwell for to catch the fish at Her ring Were for three yearss for (proba bly ninepence) a thousand for the towne. and the towne hath givien them order tor to give a tieme to draw logg to mend the Were, and to pay them in Fish, tlie amount not to be above 5 thousand. It is ordered and agreed upon by the towne that the Towne Neck shall be still preserved for a Calves pasture as it hath beene formerly, from ye first ot May unto ye 14th of October, and yt noe other catle but calves shall be put into this Neck wthout the generall con sent ot ye Towne. It is ordered yt goodman Harper and Goodman Bout shall hier a Calfe Keeper, wh-ich Calfe Keeper shall be paid both for mending of ye fence and keeping ye calves as formerly, by ye head, yt are put into ye Towne Neck. June 24th, An. 1653. It is ordered that all swine above ten weeks ould shall be ringd aud yoked from ye 25 ot March until ye last of October, and soe to continue wringed all winter, and this order to stand in forst from yeare to yeare untill ye towne agree to break it. It is ordered yt ye keppers or any other person or persons are aud have liberty to pound all swine and all other cattell whatsoever except Mr. Leverig, his sheep and calves out of ye towne neck, and this order to put in practice ye third day of the next weeok, which is ye last weeck of June, 1653. And ye owners of ye bogs or cattle to pay 6 d apeice the first time, and 12 d the sec ond; for ye present hogs are aloud to be without wrings untill ye first of September next. It is agreed upon yt Mr. Leveridg only have liberty to put his sheep into ye towne neck with a keepper two days m ye weecke all this summer, and to keep them upon ye farther side of ye neck yt all ye hither side may be pre served for ye calves because of ye water. June 22d, An. 16.52. It is ordered at a , lawfull meetiug upon warrant from ye Gouverner that Goody Bodfish shall have 4 bushel of wheat of that that is dew to ye towne from George Allen. An. 1652. 7th day of November. It is ordered yt Edmond Freeman. Edward Perry, George Allen. Danniell Wing, John Ellis, Thomas Tobey, these six men are appointed to take care of all ye fish yt Indians shall cut up within the limits and bounds of ye towne. as to provide casks for it. and tow diss- pose of it for ye townes use. It is likewise ordered yt if any man y.t is an inhabitant findes a whale and gives notis untoauyot these men afore said, hee shall have a double share. It is further ordered yt these six men shall take care to provide labourers aud casks and what other things is needfull for ye best advantage, that soe what whales either Indian or Inglish give them of, they might de»- pose ot it for ye townes use to be de- vided by them equaly to every inhab- bytant. May the 13, 1653. It is ordered that Mr. Dillingham and Tho. Harper, Mr. Vincent. Richard Bourne, shall forth with make a rate of thirty-seven pounds to be paid in Butter and cur rent money. The last of October, 1653. Thomas Dexter is fully discharged from any further charge or demand to pay any thing more about the rate yt was made when hee was Counstable. January 24th, 16.53. It is ordered yt ye pay of all ye whales shall be devid- ed to every houshouleder and to every young mau yt has bis one disposing equaly. December 13th, miS. It is ordered that Richard Chadvvell, Thomas De.x- ter, John Ellis, these three men are to have all ye whale yt comes up within ye limits and bonds of Sandige, and for ye said whales they are to pay to ye towne Sixteene Pounds apise for each whale — Provided any of them have notis given them by any mau yt hath seen ye whale ashore or aground, and returns to the whale staying one ower by ye whale, aud his one oeth is to be taken for the truth and certainty of the thing, to make these three persons above mentioned liabule to pay for ye said whale in case one of them doe not goe along with him that brings them word yt there is a whale cast up— but if any of them returns with him yt gives them notis. then the person yt gives them notis, hee shall helpe to seese the whale, and ye person whoeyer hee bee yt will doe accordingly as is herein propounded to give notis in ye townes behalfe to any of these men hee shall have paide him for his paines and care herein Twenty shillings. If in case there comes up a pese of a whale, that is to say, a halfe or quarter part or three partes of a whale, it is soe appointed yt these tore men, Mr. Dil lingham, Edmond Freeman. Edward Perry, Michaell Blackwell, these men are chosen tooe see the parte of whale before it be cnt any of from it, and to determine what quantity there wanteth of a whole whale without a tonge — furthermore these three men, Richard Chadwell, Thomas Dexter, John Ellis, they are to make payments for all ye whales, thus, a third iu Oile, a third in Corne. a third in Cattell all marohanta ble pament, at a eurreut prise, likewise for what pay is made in cattle ye towne is to make choise of one. aud these three men another to determine ye prise, and if these two men cannot agree they are to choose a third man. It is agreed yt ye towne is to pay ye barrel! of oile to the cuntry, aud ye twenty shillings ot ye mau yt gives notis of a whale — If any of these men find a whale themselves without any notis given them, they are to have in like manner twenty shillings, and this agreement to be iu force until this day, twelve months. Whereas the Towne apointed a meet ing upon the first of March. 1654. two make an agreement with Thomas Dex ter Junior about his Mill, either to build a Mill himself and to grinde theire corne for such tole as they have for- mer?y given him that they might be sure of a Mill, an theire wants suplied, and some better usage then formerly — But the end of our meeting, being all together, was frustrated by himselfe. Wee whose names are hereunder written doe bind ourselves, to grind all our corne, whete, barle , rie or malt that wee spend in our families, at the mill as soone as it is built, which John Ellis, William Swift, William Allen, James Skeff have ingaged themselves to build or to pay unto these fore meu, so much tole as any corne come to the grinding of it, that wee carri to any other mill, in case theire mill be soe that it can grind it. The seven men apointed to ouer see and set the true bounds of the in habitants lands an to haue f6r theire paines a penny an acker for such lands as are rau^ed out and made use of by tillage, luoiug, or pasteriug & fore pence an Aker for such lands as hi» without bounds, or the bounds not to be found clear enofe to be brought to the Record without as much or more paines taken, as at the first. 5. It was agreed upon that upon oc- cation if any of the men apointed could not.or wowld not atend the woork, that any five of them agreed upon should be as athentiok as if all were present. 6. These that weere at this meeting did iudg (judge) it very riteous, that such as had overflush meddo, a consid- derable quantity it should be tendered them that haue formerly inioyed it as their one, to by it for som resonable satisfaction to make it theire one in terest forever. 7. These 7 men were im powered to make sale in the Townes behalfe ot such parsells of flats, or meddoe, that were found to be cleare from any for mer grant, and all that could be made in this way, to satisfi. as four (fsr) as it will run. for the Doo which was in con sideration to be dug. 8. May 22, 1658.— The Towne made an agrement with Richard Chadwell, and William Basset and James Skeff to find three Trouping Horses, well apointed. for one yeare. upon condition that they may have liberty for theire horsis to goe constantly for this whole yeare in the Towne Neck and give them five shillings for every day they are caled forth by the Millitary Officer of the Townej or else where soe apointed by the Court or Counsell of war. We have no more at present to say unto you — but to declare our minds by these three men, Ricliard Born, Rich ard Chadwell, Johu Ellis, and doe invest them with full power from us to stand for our trest (interest) in every reipeot by any lafull meanes whatsoeuer, and not to alter what was dun by those eight men apointed from both, our towne and yours, by mutual! agree ment. The 21th of 12th month have made an addition ot Thomas Tupper unto the three men above mentioned, aud doe invest them with full power as they shall see cause, to put an end to all uuto all difference betwixt us the iu- habitanc ot Sandwidg and the towne of Barnestall in respect of the land or fish. The Towne have agreed that Richard Borne and Thomas 'Tupper sener shall take care in the Townes behalfe. for the keeping of the above said pouder in private safty. The Towne have agreed that the Raters shole have pouer to imploy on man or tooe, to take an invoice of mens severall estates and to be satisfied by the towne for theire paines. January the first day of the month in :67 — The Widdoe Knot did give unto John Toby one Akar of march land — and shee did freely doe this — In the presano of those names as under wrightten Richard Boarne aud Richard C'hadvrell and William Nulaud aud Stephen Winge The third day of May. 1670— The Towne hath maid an agrement with Michall Blackwell to each the fish att the River for the townes use tor the terme of seven yeares — aud six pence a thousant to bee paid in any kind of graiue as it goes amongst us — and hee shall give parsons spedy warning when ther fish douth com. and if auy parson cannot spedj tech them, then Michall Blackwell shall safely keepe them three dayes at the least. And it is agreed upon by the Towne that no young men that ar at there one disposing shall have any more than halfe a thousant of fish for ther sheare at one time- aud providing hee doth plant coarne with thera — and if in case they plant not. they shall have noue, ether to sell or give away to any man. The Towne hath agread that Good man Born and Goodraan Chadwell shold lay out this land for Richard Smith In the year :67 the 6 day of the twelfe month. The Towne hath coveiiauted and agreed with Stephen Skeffe and Joseph Birge to bee Tropers for the Towne for fife yeares, to answer the ordar of Coart. And in considuratiou heareof, the said Stephen Skffe and Joseph Birge is to have paid them yearely, ten shillings a yeare apese in money — and theare time to begin in the middell of July next inshuing from the date heareof — and furdnr, the town is to provid these meu four Pistals and Holstan, and oth^r furniture as belongs to or for the surveis — Except hoarses and powdar and bridles and saddles and soards. 14: 5: 1670— It is agreed upon in a towne meeting that no young meu shall hence fourth haue any libartie to gather any pine knots to make tar of them, within the libetis ot the Town ship, except they bee towne boarne children — and likewise no inhabantant shall any waise joyne in partnership with them upon the forfttute, boath ot the knots aud tar. Aud that any towns man mav se.->e upon the knots, or tar, for the Townes use from the date heare of — But what knots theay have gather ed, and careid to-gether with carts, beetore this date— theay have lit)artie to run them out, or to sell them— And what small heapes theay have liesiin careid together theay have libertie to sel them, haveing to mounths libartie after the date heareof. and if they do not sel them in that time it shal be latiil for any one ot the towue to take them for there one. 18: 2: 72— The Towue hath sould unto John Gibbs all the wast meadow liing at Scuset for fore pounds, only bee is to set of that which the towne doth owe him. and the rest is te be paid in mony — And Miles Blackwell and Thomas Gibbs are cho,-eu to lay this meadow out. 18: 2: 72— The Towne hath granted to sell unto John Blackwell eight akers of land. It lies upon the wester sid of the land which is called Blackmore ground, and and Miles Blackwell. aud Thomas Gibbs, is to view this land aud to give it in to the towne. The 13 July 1671— The Town hath agreed with Thomas Tupper and John Bodtlsh to kepe the Calves for this presant yeare for ninepence a calfe for as many as are put before them, and the said Thomas Tupperand Johu Bod fish is to cut all the upland grass which grows upon the Towne Neck comon, and no other parson to molest them for the presant yeare, and that they louck after the Calves to dayes in the week dilgently. The 13 July 1671— It is voted in a pub- lick Towne Meting to give Master 'Thomas Wally leave to put in his Cowes into towne neck for this presant sumar. The Towne being met together the 13: 4: 7, it is agreed upon, that all the inhabitancB ot the towue— that is to say — raastars of famelies, and all young men that are at theire one disposing. shall kill or cause to be killed, one dozen ot Black Birds — and if any ne glect or rt-fiise to doe according to this card (order) shall pay for the want of his dozen ot birds too shillen — and fordar— if any parson will imploy him selfe after theay have brought theire one dozen, theay tihall have one shillen by the dozeu to bee paid in the gen erall. It is therefore inacted by the towne that Liewtenant John Ellis, Thomas Tobie sen, Steven Skiffe, being fully impowered, are agents for the 'Towne ot Sandwich, to hire as many men as they judge convenient to goo out upon the Scout for the Towne ot Sandwich— aud to ingage iu the townes behalfe tor the payment of the Scouts that are one our sarvice — the Towne of Sand wich hath iugaged themselves to pay the foresaid Agents to iuguge men to be Scouts, in sora good marchantable pay as soon as may be after their sar vice is ended August the 8. 1676 It is enacted by the Towne, that heuceforth all Cunstables shall succes sively frora yere to yere, give in a true account of what Estate of the townes may bee in their custody or charge in reference to Rats, or others ways any thing that may bee comitted to any Cunstables charge of any man er of estate of the Townes, whatsoever, and that all Cunstables henceforth doe give in any such estate as above said to the persons as the towne shall de pute to take the Cunstables account And if any Cunstable doe not give in there accounts to the p'sons deputed by the towne for that purposs— that then, the persons deputed shall use any lawfull means to procure an ac count of any such Cunstable. And furthermore, the persons deputed are impowered by the towne to take an ac count of any former Cunstables it any be cappable of giveing in their ac counts, espetially such Cunstables as have served lately in the office of Cun stable. 21y The Towne hath made choyce of Mr. Richard Bourne and Thoraas Tobie this yeare. to take the Cunsta bles accounts, not only this present yeare. but ailsoe forraer Cunstables that are able to give an account when desired. Sly The Towne hath made choyce of Mr. Richard Bourne and given hira lib erty to make his own choyce ot 2 men to help him to decied the rates this yere to the persons to whom it is dew . 4ly Forasmuch as the Towne doeth judge it very disstructive to our young growing timber trees, for any person or persons to peill off the bark of any such trees— and the trees so peild either lo lie and rotte or not to be serviceable for any other use but for fire— It is therefore enacted py the towne that noe person, either Taner or any other man in the Township of Sandwich, doe henceforth peil or cause to be peild, any bark off any such young growing oake trees, except any such person that so pells trees, doe cutt up such trees so peild, for fire wood for his or their own use, and carry such wood home to theire owne houses within 2 nroiiths after any tree be ao peild. And if any person that peiles of the bark of auy oak tree or trees doe neglect to cutt, and carry of the wood within 2 months after — shall forfeitt twelve pence for the Towne use for every tree that any per son peiles and doth not carry off as aboue said. Dec. 7. 1676 A Towne meeting warned by Steuen Skiffe Whereas the Counsell of Warr hath ordered the Towue of Sandwich to pay unto the Towne of Baiustable Seaueuty and three pounds sixteen shillings, which is dew to be payd by the Towne ot Sandwich, to ballanoe the account ot charges that hath arisen by the late wars— the towne therefore agreed and concluded to pay the aboue said 73 pounds, 16 shillings out of the last great Rate, which was '279 pounds. And to be paid by seuerall persons that hath been apoiuted to pay the remaining part of their proportion ot the abouesaid great Rate to the Town of Bainstable. And for the more better effecting of the aboue said payment to Barnstable the towne hath made charges of Benja min Nye and Steueu Skiffe for theire Agents to act as fare themselves could, or eught to doe, both iu treating with Barnstable men about the paying of thera, aud soe to order things in the townes behalfe to the full effecting of the busnes they are chosen for. Viz.: To cans all the persons that are apoiut ed to pay there proportions to Barn stable, to bring their pay to the place as our agents shall apoint in Sandwich — And for their incurriagement, the towne hath iugaged themselves to pay unto Benjamin Nye and Steuen Skiff the moneys they are necessitated to disburs iu and about the paying ot Barnstable the aboue said some, to witt: 73 pounds, 16 shillings, and lUsoe to sattisfle thera tor their time about that busnes, as shall be judged meet and reasonable for thera to haue for ther time they are or may be necessi tated to spend in that work. John Blackwell, to take an acount ot the estate ot the towne, ot what estat hath beeu Rated, or may be rated. 5ly The Towne hath giuen Benjamin Nie liberty to build a Fulling Mill upon a riuer comouly called Spring Hill riuer, prouided itdoth not dainuify the ¦cuntry rode. And Benjamin Nie hath liberty to keep up a mill in the said place as long as he shall see caus to keep up a Fulling Mill in the said place. The 8 of August 1676. Whereas Pete Gaint complaiueth against Jonas Mor- raack in au action of debt to the dam age ot too pounds tor nou payment of a debt of flue barrell of 'Tarr — which appears due to the said complainant — The verdite we And far the plaiutiue. 3 barrell ot Tarr, aud one penny damage, the cost of the sute — The euidence as it was cast by was, Jonas owned the debt before the'Court— August the last 1676 A Towue Mettiug warned by the Cunstable. The Towne hath enacted and con cluded in reference to the time of mettiug togeather, that henceforth, ten of the clock in the morning shall be the perfixt hour of the day for all towne mettings to be warued, & then, assembled at the useall place appoint ed, as ath been our custome hithertoo. 21y The Towne hath enacted that heuceforth whosoever of the listed townesmen doe not appeare at towne mettings according to the warning giuen then, and the hour of the day perfixt in the abouesaid order, shall forfett twelue pence for euery person that doeth neglect soe to appeare as aboue said — And euery person that doeth not attend the towne mettings untill the busnes be accomplished tor which the towne is warned to doe, and goes away or departs beffore such mettings be ended, shall forfett, ailsoe to the townes use, twelue pence to be exactly paid and to loos there voats iu what is done 1676 Sept. 12, 1676 ' A Towne metting warned by Joseph Burge Cunstable, to make choyce of men to take an account of what charg es hath bene since last June Court, and before that time that hath not been giuen in allready. aud the towne hath made choyce of Mr. Richard Bourne. After the aboue said grant there was diuers ot the neighbors that expected the way that a Jury layd out through the said land, and desired that the towne might haue not molestation if euer the towne be necesstated to use that way for loading or unloading of boats, ether earring or receiving as occation may require. The Towne hath ailsoe ordered that Skawten Neck shall be improued for ten yeares by the Eastern part of the Townesmen as they shall see caus to improue it— And the Towne Neck, Viz: Shaman Neck, ."hall ailsoe be im proued by the western part of the Townesmen tor ten yeares, ailsoe as they shall see caus to improue it, and noe longer than ten yeares trom the da'^e heareof, aud then to be at the Townesmens ordering againe, and ail soe the number of persons for each neck shall be ordered and determined by six men as shall be indifferently choseu by the towne, three of the six to be chosen out of the Eastern part, the other three to be chosen out of the western part of the towne, aud the said six meu shall determine the things they are chosen for, as abouesaid, and what they shall agree upon and deter mine shall stand efectuall for tho full term of ten yeares — Aud the six men as are chosen by the towne to determine of the number of men they shall order to each Neck as aboue mentioned, are, Edmund Freman, Edward Perry, Joseph Hallway, for the Easter part, and Johu Blackwell, Jedediah Allen and Thomas Tupper for the Wester part, and the said six men to determine as abouesaid. And it was ordered by the Towne that the '28 pounds of siluer as is brought to ye towne shall be deuided as persons dis bursements were in ye great warrs Rate, each mans proportion to be ac cording to ye same, and to all such persons as was then rated and no other waye. 2. John Gibbs, William Bassett and Thomas Tupper are chosen by ve towne to deuide ye aboue sd 28 po'unds of siluer as is aboue mentioned, according to agreement of ye towne. And Thomas Tupper is chosen by ye towne to deliuer out each mans parte, when deuided as it shall be demanded of him when it is deuided, and not before it is deuided 4. The Towue hath exchanged six acrs of land with Steuen Skiffe, ye sd Steuen Skiffe surrendering up to the towne six acres of his laud, that lies aboue his fensed land, and ye sd Steuen Skiffe hath granted him by ye towne six acrs of land that lies adjoyning to his lots below ye hieway runing toward ye meadow. And to be layd out by John Gibbs and Thomas Tupper who are chosen by the towne to lay out ye sd six acres of land to Steuen Skiff aforesd. 5. The Towne hath exchanged with William Switt sen two acrs of land, & ye sd Swift doth surrend up to ye towne 2 acrs of land that best aganst a place where Daniell Butler had a house stood, and the towne hath granted that ye sd Swift shall haue two acrs of land to be layd out aboue his other lands, upou the hill aboue his dwelling house ad joyning to his other land. Thomas Tupper and John Gibbs are chosen by the towne to lay out the aboue sd two acrs of land for William Swifft aforsd according to grant. The Towue hath granted liberty to Lodoick Hancks, John Gifford. John Nie and Samuell Briggs to make use of that parcell ot laud that lies betweene Neheraiah Besse's land aud the land that Shubaell Sraith raakes use of. Viz: from the road to ye mershes, for six years and noe more from ye date of ye aboue sd towne meting, aud then to be returned to ye towne againe. The bounds of the land that the Towne granted to Mr. Thomas Dexter by way of exchange, as apears by the towne grant the 19 of August 1680. Aud the persons made choyce ot by ye towne are Michaell Blackwell and Lodoick Hanckse, who are to lay out 28 acers ot land at ye place mentioned in ye grant, and ye bounds as was giuen in under ye hand of Goodman Blackwell with the consent and appro bation of Lodoiok Hanks is as follow eth, viz: Prom the bounds of his owne meadow northerly, and soe to whitte oake tre marked, neare unto a let ell swamp, and so to rang by marked tres Westerly and Southerly to a letle whitts oake poste marked, with in the Cow-house swamp upon ye wister side of the riuer, and soe to run throu the sd swamp southerly to a great pine tree marked on the south side of the foresd Riuer, and soe to run easterly by the Countrey road strait untill it come to a great red oack tree marked, near unto Richard Smith's house which is the fardest bound ester- ly, and from thence strait downe toward the sea to a white oak bush marked, neare ye marsh, and from ye bush to ye ditch that incloses in parte Williams Aliens meadow, and soe to run Westerly by ye sd fence as it stands untell you com to a nuke of marsh that belongs to William Gifford, and then to run trom ye sd nuke of raarsh strait within a fence that in parte incloses yo meadow of William Gifford, and soe to run to ye end of a ditch to the creek. The Towne hath made choyce of Edward Perry John Gibbs aud Shu baell Smith to be Rators this yere -2. William Bassett was added by holding up of hands to act in Edward Perrys roome, if Edward Perry will not help make ye rate or any parte of ye rate. Sly. It is agred upon by the Towne that these three meu. John Jening and Isaac Turner are to uiew a peice of land as Joseph Burg desire. 7. William Swift sen and Jacob Burge are choseu to uiew a peice of Boggs as John Blackwell would haue. 8. Steuen Skiffe is ordered to pay his father twenty and fiue shillings out of that money as is in his hands as came from the treasurer, iu leiw of a barrell ot oyle as the towne promised Good man Skiffe. 9. The towne hath exchanged 6 acrs of laud with Lodoick Hanks, and granted that he the sd Hauks shall haue his 6 acrs joyuing to his ether lauds, onely the carteway that runs by his hous shall not be infringed or de bared foreuer, viz: the way that leads to Scanten. 21 y. Mr. Edmond Freeman and Steuen Skiffe are by the towne chosen to lay out the sd Haukse 6 acers of land granted him by way of exchang. 3ly. The Towne hath made choyce ot Benjamin Hamoud, Steuen Skiffe and Stouen Wing to make saill ot the the whale that is lately cast one shore in ye most they can of it iu the townes behalfe, and lor ye townes use. 4. Its alsoe noted by the Towne of Sandwich that Joseph Hallway and his partuers that was with him iu cui ting uij of the whale shall haue that parte as they haue allready cut and secured, for six pounds of siluer money to be payd to the towne or there order, and ailsoe to pay the Cuntry a barrell of Oyl, cleare of charge to the towne. The sd Joseph Hallway hath ex pressed himselfe willing to accept of that parte of ye whale as bee aud his partuers have in their posession, and to pay as aboue said Hallway is iugaged and stands indebted to ye towne in siluer 6-0-0 And the cuntrey barrell of oyl as aboue said Caleb Allen stands debter to ye towne ailsoe lor his parte of whale, as he and his partners hath all- ready taken 2-10-0 At a Towne metting held in Sandwich ye last of March 1681, Joseph Burge is chosen by ye towne to Goodman Black- well to lay out fiue acres of land for Mr. Nathanell Fish that hath been formerly granted to sd Mr. Nathaniell Fish the 18th of March 1669, which sd land is to be layd out according to former grant by ye aboue mentioned men as is expressed for sd fish foreuer We Jacob Burge and Thomas 'Tapper being chosen by the Towne to lay out nine acres of laud aboue the great pond neare Benjamin Nie his hous for Caleb Nie, which was granted him by the towne by exchang and gift, as ap pears by towne acte bearing date last of March 1681. The bounds of sd land layed out by us aboue exprest, are as followeth. Bounded at the Easter comer next the hieway by a little read oak poste- marked, by a little swamp, and soe to rang southerly through a swamp to another Rede oake tree marked, and soe to range westerly to another rede oak bush up on a hill, aud from thence toward a seder swamp neare ye carte- way to a rede oak tree marked by the sd swamp, and trom thence to rang to the first bounds tree meutioned. Aud I the said Thoraas Tupper doe ingage for myselfe my heirs aud assigns to secure myselfe my heirs aud assigns to fiee the towne, as a towue, trom any damage by the feuce one each side ot the feuce aforesd, as by auy oth«r parte of the feuce belonging to the sd feild. The towne beiug as-sembled by order from the Select men, hath made choyce of Steuen Wing aud John .Tanning to take an iuvioice of the towues Rateable estate iu reference to the order ot Courte requireing the same. May 15, 1677 The towne hath made choyce ot Steuen Skiff an Agent to dispose of ten Akers ot laud as he shall see caus, that is upou the Scoten Neck that lieth next to Barnstable lis inacted by the towne that whoso- euer shall be chosen by the towne to mend the pouud and keep it in repare shall haue for his paines ten Shillings, to be paid out of the next rate from the date hereof, in Indian Corne good and mrchauttable — And for theif farther sattisfaction the towue hath ordered and determined, that all neat cattell, horses aud hors kiud that are brought unto the pound for tras.^ijass- iug, the person or persons that soe brings in such cattell into the pound shall pay the pinner fourpence per head in some marchantable pay, and for all traspasing sheep that are impounded, the person that brings them into the said pound, shall pay the pinner one penny per head, in pay as aboue said, and for all swine, two pence a head in pay as aforesaid, and by the persons that brings them into the said pound. The towne hath made an agreement ¦with Joseph Burge to be pinner two yeares from the date hereof, and to make up the townes pound suffisieutly to impound all trespas cattell, to wit: neat cattell, horses or hors kind, sheepe and swine, and at the two yeares end the said Joseph is to haue the said pounds suffltient to answer the townes expectation for the end a pound is built for — And the said Joseph to keep a suffl tient lock and key during his time. that soe all trespas cattell brought to be impounded according to the fore- mentioned order may be secured untill legally treed— The said Joseph Burge hath power to exacte all the foremen tioned fees of all those persons that doe from time to time impound any neat cattell, horses or hors kiud, sheepe and swiue, from the deate heareof untill the expireation of two years.
