Rejection of bids: Any bid which is not commensurate with the value of the article offered or which is merely a nominal or fractional advance may be rejected by the auctioneer if in his judgment such bid would be likely to affect the sale injuriously. II. The buyer: The highest bidder shall be the buyer, and if any dispute arises between two or more bidders, the auctioneer shall either decide the same or put up for re-sale the lot so in dispute. III. Identification and part payment by buyer: The name of the buyer of each lot shall be given immediately on the sale thereof, and when so required, each buyer shall sign a card giving the lot number, amount for which sold, and his or her name and address. Payment at the actual time of the sale shall be made of all or such part of the purchase prices as may be required. If the two foregoing conditions are not complied with, the lot or lots so purchased may at the option of the auctioneer be put up again and re-sold. IV. Risk after purchase: Title passes upon the fall of the auctioneer's hammer and thereafter neither the consignor nor the Association is responsible for the loss or any damage to any article occasioned by theft, fire, breakage or any other cause. V. Delivery of purchases: Delivery of any purchases will be made only upon payment of the total amount due for all purchases at the sale. Deliveries will be made at the place of sale or at the storage warehouse to which purchases may have been removed. Deliveries at the American Art Galleries will be made only between the hours of 9 A. M. and 1 P. M. on sales' days and on other days-except holidays, when no deliveries will be made- between the hours of 9 A. M. and 5 P. M. Deliveries at places of sale other than the American Art Galleries will be made only during the forenoon following the day of sale unless by special notice or arrangement to the contrary. Deliveries at the storage warehouse to which goods may have been sent will be made on any day other than holidays between the hours of 9 and 5. Deliveries of any purchases of small articles likely to be lost or mislaid may be made at the discretion of the auctioneer during the session of the sale at which they were sold. VI. Storage in default of prompt payment and calling for goods: Articles not paid for in full and either not called for by the purchaser or delivered upon his or her order by noon of the day following that of the sale will be turned over by the Associa- tion to some carter to be carried to and stored in some warehouse until the time of the delivery therefrom to the purchaser, and the cost of such cartage and storage will be charged against the pur- chaser and the risk of loss or damage occasioned by such removal or storage will be upon the purchaser. NOTE: The Limited space of the Delivery Rooms. of the Association makes the above requirements necessary, and it is not alone for the benefit of the Association, but also for that of its patrons, whose. goods otherwise would have to be so crowded as to be subject to damage and loss. VII. Shipping: Shipping, boxing or wrapping of purchases is a business in which the Association is in no wise engaged, and will not be performed by the Association for purchasers. The Association will, however, afford to purchasers every facility for employing at current and reasonable rates carriers and packers; doing so, however, without any assumption of responsibility on its part for the acts and charges of the parties engaged for such service. VIII: Guaranty: The Association exercises great care to catalogue every lot correctly and endeavors therein and also at the actual time of sale to point out any error, defect or imperfec- tion, but guaranty is not made either by the owner or the Association of the correctness of the description, genuineness, authenticity or condition of any lot and no sale will be set aside. on account of any incorrectness, error of cataloguing or imper- fection not noted or pointed out. Every lot is sold "as is" and without recourse. • Every lot is on public exhibition one or more days prior to its sale, and the Association will give consideration to the opinion of any trustworthy expert to the effect that any lot has been incor- rectly catalogued and in its judgment may thereafter sell the lot as catalogued or make mention of the opinion of such expert, who thereby will become responsible for such damage as might result were his opinion without foundation. IX. Buying on order: Buying or bidding by the Associa- tion for responsible parties on orders transmitted to it by mail, telegraph or telephone will be faithfully attended to without charge or commission. Any purchases so made will be subject to the foregoing conditions of sale except that, in the event of a purchase of a lot of one or more books by or for a purchaser who has not through himself or his agent been present at the exhibi- tion or sale, the Association will permit such lot to be returned within ten days from the date of sale and the purchase money will be refunded if the lot in any manner differs from its catalogue description. Orders for execution by the Association should be written and given with such plainness as to leave no room for misunderstand- ing. Not only should the lot number be given, but also the title, and bids should be stated to be so much for the lot, and when the lot consists of one or more volumes of books or objects of art, the bid per volume or piece should also be stated. If the one trans- mitting the order is unknown to the Association, a deposit should be sent or reference submitted. Shipping directions should also be given. Priced Catalogues: Priced copies of the catalogue or any session thereof, will be furnished by the Association at charges commensurate with the duties involved in copying the necessary information from the records of the Association. Center panel of crimson velvet ap- pliqué embroidered, in colored silks and gold cord, with scrolls, flowers and leaves, the front with escutcheons charged with coat-of-arms. Side panels of silk brocade woven, in crimson silk, with pomegranates and scrolls on cloth of gold ground. Finished with silk looped braid. Length, 7 feet 8 inches; width, 2 feet 3½ inches. Length, 4 feet 2 inches. 27-SPANISH EMBROIDERED SILK ROBE AND CLOAK Eighteenth Century EMBROIDERED SATIN Seventeenth Century Under robe of white silk with large sleeves, quilted and with circular medallions occupied by initials V and S. Finished with blue silk and gold thread fringe. Cloak of blue silk with deep collar and bordered with band embroidered, in silver thread, with scrolls and escutcheons, occupied by Spanish Royal armorial bearings of castles, lions and pil- lars, the body embroidered in silver thread with detached stars. Length, 8 feet 6 inches; width, 5 feet 4 inches. Note: This robe and cloak were made for King Charles III (1716- 1788) of Spain, who joined France in aiding the American Colonies and secured Florida. 28-ITALIAN Needlework Border Worked, in cross stitch and colored silks and on a brown ground on a canvas foundation, with scrolled leaves and flowers. Worked in colored wools and gilt thread on a light ground with cen- tral medallion bordered with gold-embroidered acanthus leaves and containing groups of carnations and clusters of grapes supported by scrolled acanthus leaves, grapes, flow- ers and ears of wheat embroidered in gold thread. Bor- dered with piping of crimson velvet with outer borders em- broidered in gold thread. Body carved, in relief, with groups of "Murder of Cæsar" on one side and "Cincinnatus and Messenger from Senate" on the other. Height, 2 feet 7 inches. 50-ITALIAN MAJOLICA OIL JAR Pear-shaped body, with molded rim and molded looped handles. Decorated with rosettes and a plain band; in- vested with a yellow glaze, mottled with dark green. .. Mansart, shown in three-quarter view with curled peri- wig, lace jabot and cross of the Order of the Holy Ghost at his breast. On tapering rectangular pedestal, with molded cornice and straight plinth, of dark green yellow- veined marble. Height of bust, 2 feet 7 inches; height of pedestal, 3 feet 7 inches. Note: Jules Hardouin Mansart (1645-1708), nephew of the inven- tor of the "Mansard" roof, was the favorite architect of King Louis XIV, for whom this bust was made and for whom he designed the Palace of Versailles. 53-ITALIAN BYZANTINE STYLE MARBLE JARDINIÈRE Rectangular-shaped top, carved with figures of the Evan- gelists, birds and scrolled leaves. Columnar standard with capital carved with leaves at the angles and eagles. Shaft pierced with lozenges filled with crosses and carved with acanthus leaves and central sun medallions. Sides carved with meander of berries and pointed leaves, bordered by beads and roundels. Carved and molded foot and rec- tangular base. OBJECTS IN WROUGHT-IRON, BRONZE AND ORMOLU 54-WROUGHT-IRON HANGING LANTERN Hexagonal shape, with tapering triple arched, glazed sides and hinged door, domed top with floral finial, angles with flowers and hexagonal base, pierced and decorated with wrought-iron. Suspended with three wrought-iron chains florally decorated in wrought-iron. Height, 4 feet 1½ inches. 55-PAIR OF FRENCH ORMOLU ANDIRONS Standards of gilt bronze with spiral fluted shafts, orna- mental capitals and feather pendants. Brackets at sides, supporting voluted acanthus leaves and flower and leaf festoons. Semicircular bases with acanthus-leaf edges, pear-shaped acanthus-leaf feet. Gilt bronze ball finials and iron rods. Height, 2 feet 2 inches. Toward the left-hand side is a full-length figure of the Saviour symbolizing the Prince of Peace. He stands under a canopy of crimson drapery and in front of a throne. He wears a blue cape bordered with gold and fastened across the breast with a Jewel set in gold, a robe of gold brocaded in a Gothic patterning with red and a crown, while in His right hand He holds a golden sceptre. On the skirt of His cape is in- scribed, in Gothic text, the name "Filius Dei." On His left are the figures of four maidens coifed and in long robes, symbolizing the Virtues, one being inscribed "Gubernacio," and one carrying a banner on which is the nude figre of a Child Christ surrounded by rays. On the right side of Our Saviour stands another female, also symbolizing a Virtue, in a coif and flowing robes. On the right of the central figure is seated an old man with long gray beard and locks of gray and clothed in a blue mantle and a bro- caded robe. This is King David, who tenders a label, in- scribed with a legend in Gothic characters, to a seated scribe, who writes thereon. The latter figure is inscribed with the name "Andreas." Above and to the left of David is a group of young men in fifteenth century costumes holding a caparisoned horse. In the distance is a land- scape, with hills, trees, windmills and other buildings, while the foreground is occupied with growing floral sprays and clumps of grass woven, on a dark ground, in natural colors. Around the tapestry runs the original rather narrow bor- der consisting of a floral meander of roses, other flowers and leaves suspended by bowed and knotted ribbons woven in bright colors on a dark blue ground. Height, 9 feet 2 inches; width, 9 feet 10 inches. Note: This magnificent tapestry, among the finest of its early period ever shown in this country and especially distinguished owing to its fine state of preservation, is one of several which were woven to the direct order of the Emperor Maximilian I. The fine tapestry representing an allegory with Jesus Christ in the center, that you showed me last year, is, in my opinion, the work of a Flemish artist of the early XVI Century, from about 1510 to 1515. The drawing seems to me, for its composition, as being by the hand of the famous artist who did the drawings for many tapestries made chiefly for Emperor Maximilian, the majority of which are now in Madrid and Vienna. The artist is from Erussel and is called Maitre Philippe (Master Philippe), as it appears from a document of the year 1513 published by Prof.Destree.
