Vehicles moving slowly shall keep as close as possible to the curb line on the right, so as to allow faster moving vehicles free passage on the left. STOPPING, STANDING AND TURNING. n Sec. 1221. Stopping at Curl). No vehicle shall stop with its left side to the curb. 2 Sec. 1222. Driving, Backing, Etc., cm Side¬ walks, Crosswalks and Intersections. It shall not be lawful for any person driving or having charge of any cart, wagon or other vehicle to drive or back any cart, wagon or other vehicle onto the sidewalk of any of the streets of said city, or to stop any such cart or any other vehicle, on any of the crosswalks or intersections of streets so as to obstruct or hinder the travel along such crosswalks or intersections of streets, or to place any such carts or other vehicles crosswise of any streets of said city except to load thereon or unload therefrom ; but in no case shall it be lawful for any person to permit such cart or other vehicle to remain so crosswise of anv %/ street for a longer period than may be ac¬ tually necessary for such purpose; it shall not be lawful for the owner or occupant of any store, warehouse or building in any street or avenue in which the rails of any street railway company are laid to obstruct or interfere with the passing of cars of any such street railway company. Sec. 1223. Backing Up to Curb. In no case shall a vehicle remain backed up to the curb excepting when actually loading or un¬ loading. Sec. 1224. Stopping Close to Curb Line. Un¬ less in an emergency or to allow another ve¬ hicle (as provided in sections 1227, 1230 and 1231) or pedestrian to cross its path, no ve¬ hicle shall stop in any public street or high¬ way of this city except close to the curb line. Sec. 1225. Obstructing Crossings. No ve¬ hicle shall stop, for the purpose of taking or setting down a .passenger or loading or un¬ loading freight, or for any other purpose, except in case of accident or other emergency, 3 or when directed to stop by the police, in such a way as to obstruct any street crossing. Sec. 1226. Stopping Near Corners. No ve¬ hicle shall stop or stand within the inter¬ section of any street, nor within ten feet of a street corner. Sec. 1227. Signal in Sloidng Up or Stop¬ ping. In slowing up or stopping a signal shall always be given to those behind by raising the whip or hand vertically. Sec. 1228. Street Cars Taking On or Dis¬ charging Passengers. Any person, firm or cor- corporation operating any street car or inter- urban car in the city of Milwaukee shall, for the purpose of taking on and discharg¬ ing passengers, bring said car to a stop at the farther side of any street crossing; except that in the district of the city of Milwaukee bounded by Juneau avenue and Chestnut street on the north, Sycamore street and Michigan street on the south, Lake Michigan on the east, and Seventh street on the west, including the streets above named, any such persons, firm or corporation shall, for the purpose of taking on or discharging passen¬ gers, bring said car to a stop at the near side of the street crossing, and except, fur¬ ther, that at all street crossings where the tracks of a street or interurban railway cross or connect with other tracks of the same street or interurban railway, or cross the tracks of any other street, interurban or steam railway, any such person, firm or cor¬ poration operating such street or interur¬ ban railway shall, for the purpose of taking on or discharging passengers, bring said car to a stop at the near side of the street cross¬ ing ; provided, however, that the following ex¬ ceptions shall be made, viz: Cars shall stop to take on or discharge 4 passengers at the second or far side crossing at: Seventh and Chestnut streets—northbound. Seventh and Chestnut streets—westbound. Sixth and Sycamore streets—westbound. Third and Sycamore streets—eastbound. East Water and Oneida streets—north¬ bound, and at the first or nearside crossing at the following points : North avenue and Nineteenth street—west¬ bound. State and Eighth streets—westbound. State and Ninth streets—eastbound. Kinnickinnic avenue and Maple street— southbound. Center street and Island avenue—west¬ bound. RIGHT OF WAY. Sec. 1229* General. At the intersection of any public street or highway with any other public street or highway, the operator or driver of any vehicle shall have the right of way over the operator or driver of any other vehicle approaching him on such cross street or highway from the left, excepting only in cases where a police officer shall be in actual charge of the regulation of traffic at such intersection of streets. Sec. 1230. Right of Way of Certain Ve¬ hicles. The officers and men of the fire de¬ partment and fire patrol, wuth their fire ap¬ paratus of all kinds, when going to, or on duty at, or returning from a fire, and all ambulances, whether of public or private character, and all other vehicles when em¬ ployed in carrying sick or injured persons to hospitals or other places for relief or treat¬ ment, and the officers and men and vehicles 5 of the police department, shall have the right Of way in any street and through any pro- cession, except over vehicles carrying hinted States mail. In turning corners., in going round curves, at the intersection of any street the speed of all vehicles shall be reduced to such a rate as will tend to avoid danger or acci¬ dent. IMPROPER USE OF STREETS. Sec. 1236. Coasting Forbidden; Bicyclists. No bicycle shall be allowed to proceed in any street of the city by inertia of momen¬ tum with the feet of the rider removed from the pedals. Sec. 1237. Trick Riding Forbidden. No rider of a bicycle shall remove both hands from the handle-bars, or practice any trick or fancy riding in any street. Sec. 1238. Carrying Children on Bicycles No bicyclist in the city of Milwaukee shall carry upon his bicycle any child under the age of five years. t Sec. 1239. Riding On Back of Vehicles. No person shall ride upon the back of any vehicle without the consent of the driver, and when so riding no part of the person’s body must protrude beyond the limits of the vehicle. ✓ Sec. 1240. Cruising by Hacks , Etc., For¬ bidden. No automobile, public or private hack, while awaiting employment by passen¬ gers, shall stand in or upon any public street or place, other than at or upon public or private hack stands, respectively designated by the common council; nor shad any hack- man or automobile driver seek employment by repeatedly and persistently driving his hack or automobile to and fro in a short space before, or otherwise interfering with proper and orderly access to, or egress from 7 any theater, hall, hotel, public resort, rail¬ way or steamboat landing, or other place of public gathering, but any hackman or auto¬ mobile driver may solicit employment by driving through any public street or place without stops other than those due to ob¬ struction of traffic, and may pass and repass before any theater, hall, hotel, public resort, railway or steamboat landing or other place of public gathering, provided that after pass¬ ing such public place he shall not turn and re¬ pass until he shall have gone a distance of two blocks beyond such place. Sec. 1241. Standing of Vehicles in Down Town Districts . No vehicle shall be per¬ mitted to remain standing on any street dur¬ ing the time between 6 o’clock a. m. and < o’clock p. m., Sundays and holidays excluded, except for the purpose of receiving or dis¬ charging passengers or loading or unloadi g goods within the district bounded by the cen¬ ter line of Wells and Mason streets on the north, the center line of Jackson street on the east, the center line of Sycamore an Michigan streets on the south and the cen e line of Eighth street on the west. LIGHTS. Sec 1242. Vehicles to Be Equipped with Lamps. Every vehicle on ' vheels - ^^^® r stationary or in motion, on any public street, whwav 'or bridge within the corporate lun- llfS the city of Milwaukee stall have .£ tached to it a lamp or lamps which sha be kept lighted during the period fiom thirty minutes after sunset to thirty ^ mutes be¬ fore sunrise and shall be so displayed as to be visible from the rear and front cf such vehicle during said period from thirtynnm utes after sunset to thirty minutes 8 sunrise; provided, however, that this act shall not apply to any vehicle which is de¬ signed to be propelled by hand or to any vehicle designed for the transportation, as its principal freight, of hay or straw, while loaded with such freight. Sec. 1244. Dazzling Headlights; Lights Other Than White Lights. No vehicle shall be operated upon or along any street or other public place within the city of Milwaukee, the lamp or lamps on the front of which shall project main light rays above a plane which shall strike the roadway more than two hun¬ dred feet forward from the base of such ve¬ hicle on a horizontal roadway. No such ve¬ hicle shall maintain any light other than a white or yellow light or lights visible in the direction in which such vehicle is traveling. MOTOR VEHICLES. Sec. 1245. * Unnecessary Smoke, Gas, Etc, .From Vehicles Prohibited. It shall be un¬ lawful for any person to operate, or for any owner of any motor vehicle or motorcycle to permit to be operated upon any street, alley or other public place in the city of Milwau¬ kee any motor vehicle or motorcycle in such manner as to permit to escape therefrom any unnecessary smoke, gas, steam or of¬ fensive odor, or in such manner as to dis¬ charge any. embers, oil or residue from the fuel used in the operation thereof; proof of the escape from such motor vehicle or rno- torcylc of any smoke, gas, steam or offen¬ sive odor shall be prima facie proof that the same is unnecessary. It shall be unlawful for any person to operate, or for any owner thereof to permit to be operated upon anv public street, alley or other public place i 9 in the city of Milwaukee any motor vehicle or motorcycle, the exhaust pipe of which, used for carrying exhaust gases from such motor vehicle or motorcycle are not parallel with the ground. Sec. 1247. Frightening of Horses by Auto¬ mobiles. Every person operating an automo¬ bile or other similar motor vehicle upon or along any public highway shall, upon a signal by putting up the hand or other sign of distress, made by a person riding or driv¬ ing a horse or horses, w T hich are frightened, cause such automobile or other similar motor vehicle to stop, unless a movement forward is necessary to avoid accident or injury, am upon request shall stop all motor power until such horse or horses are under control; and shall, if requested, assist such person or per¬ sons to pass such automobile or other similar motor vehicle in safety. All motor pow er shall be stopped on any automobile or other similar motor vehicle while left un¬ attended on the public highway. And every person operating an automobile or other sirn- iliar motor vehicle or other vehicle shall stop whenever it passes a street cat u ic i is either taking on or letting off passengeis. CROSSING OF STREET INTERSECTIONS BY PEDESTRIANS. Sec. 1251. Crossing of Street Intersections Diagonally. On that portion of Wisconsin street and Grand avenue, extending from the east side of Jefferson street to the west side of Eighth street, no pedestrian shall cross 10 any street intersection diagonally, thus, and pedestrians shall be allowed to cross such intersections only at right angles, thus. GENERAL RULE CONCERNING THE USE OF STREETS. t Sec. 1252. Reasonable Care to Be Used. Nothing contained in this article or omitted therefrom shall be construed or held to re¬ lieve any person using, or traveling, or being upon any street for- any purpose, whatever, from exercising all reasonable care to avoid or prevent injury through collision with all other persons and vehicles. Sec. 1253. Traffic Not to Be Obstructed. No vehicle shall be allowed to remain upon or be driven through any street of the city of Milwaukee so as willfully to blockade or obstruct the traffic of that street. No vehicle shall be so overloaded that the horse or horses are unable to draw it. 11 POWERS OF POLICE DEPARTMENT. Sec. 1254. General Powers. The police department shall have all powers and duties in relation to the management of vehicular traffic. Sec. 1255. Police Department to See that Ordinances are Posted. The police depart¬ ment shall see that this article is posted in all public stables and at the hack, cab and express stands, and shall keep copies of it at all of its stations and issue it on applica¬ tion. DEFINITIONS. Sec. 1256. Definitions of Terms Used. The following terms, whenever used herein, ex¬ cept as otherwise specifically indicated, shall be defined to have and shall be held to in¬ clude each of the meanings herein lelow re¬ spectively set forth, and any such terms used in the singular number shall be held to in¬ clude the plural: . , Street. Every avenue, boulevard, nigh way, roadway, cartway, lane, alley, strip, path, square and place used by or laid out for the use of vehicles. Roadway. That portion of any street which is included between the curbs oi cuib lines thereof and is designed for the use of vehicles. Curb. The lateral boundaries of that por¬ tion of a street designed for the use of ve¬ hicles, whether marked by curbstones or no so marked. Vehicles. Every wagon, carriage, omnibus, sleigh, pushcart, automobile, bicycle, tricy¬ cle and other convenience (except baby car¬ riages), in whatever manner or by whatever force or power the same may be driven, rid¬ den or propelled, which is or may be used 12 for or adapted to pleasure riding or the trans¬ portation of passengers, baggage or merchan¬ dise upon the street; and every draught and riding animal, whether driven, ridden or led, excepting that an animal or animals at¬ tached to any vehicle shall, with such vehi¬ cle, constitute one vehicle. PENALTIES FOR VIOLATIONS. Sec. 1257. Penalties. Any person violat¬ ing any of the provisions of this article un¬ less otherwise specifically provided, shall, upon conviction thereof, be punished as fol¬ lows : For the first offense, by a fine of not less than ten dollars nor more than fifty dollars; for a second offense, by imprisonment in the house of correction of Milwaukee county for not less than ten nor more than thirty days ; for any subsequent offense, by imprisonment in the house of correction of Milwaukee county for not less than three nor more than six months. MISCELLANEOUS VEHICLE REGULA TIONS. Sec. 1258. Bicycles, Parades. Persons rid¬ ing or using bicycles, velocipedes, tricycles or other similar vehicles along or upon any pub¬ lic street, avenue, lane, alley or any other public road, ground or way within the city of Milwaukee shall not ride more than two abreast excepting in a general parade or public demonstration; provided, that the chief of police of the city of Milwaukee, upon the request of any bicycle club or other party, may give permission to such club or party to ride at a greater speed than here¬ inbefore provided for, on the occasion of a road race held by such club, on such streets 13 and at such times as said chief of police may designate. Sec. 1259. Not to Ride on Sidewalks. No person shall be permitted to ride any vehicle mentioned in the preceding section along or upon any sidewalk, or other portion of any public street, park or place, designed or kept for the use of persons on foot only. Sec. 1260. Bells. Each such person riding any vehicle mentioned in section 1258 shall be provided with a suitable bell, of the shape and style ordinarily used on bicycles, which shall be rung whenever approaching a pedes¬ trian or other person upon a street crossing, or other portion of the roadway, in such man¬ ner as to give timely and sufficient warning to enable such pedestrians or persons to avoid a collision; provided, however, that none of the provisions of sections 1258, 1259 and 1260 shall be construed to apply to three or four-wheel vehicles operated by children under the age of twelve years. Sec. 1261. Penalty. Any person violat¬ ing any of the provisions of sections 1258, 1259, and 1260 shall, upon conviction thereof, be punished for each offense by a fine of not less than three dollars, nor more than ten dollars, or by imprisonment in the house of correction of Milwaukee county for a term not exceeding thirty days. Sec. 1262. Roller Skates, PushmoUles. It shall be unlawful for any person to skate with or move by the aid of roller skates, pushmobiles or any noise creating device whatsoever, upon any sidewalk, street or alley in the city of Milwaukee after 8 o’clock p. m., except baby carriages and three wheeled vehicles provided with rubber tires. M Sec. 1263. Penalty . Any person violating the provisions of tlie foregoing section shall, upon conviction thereof, be punished by a fine of not less than one dollar nor more than ten dollars, or by imprisonement in the house of correction for not more than thirty days, or by both such fine and imprison¬ ment. Sec. 1264. Funeral Processions Not to Be Interrupted. Any person who shall wilfully drive or cross any funeral procession, inter¬ rupt or disturb any funeral assembly where the same is in or upon any public street or ground in the city of Milwaukee shall for each offense be punished by a fine of not less than five dollars or exceeding fifty dol¬ lars, or by imprisonment in the house of cor¬ rection not exceeding sixty days. The provisions of this section shall not apply to the United States mail, the mail wagons or employes, while attending to the business of the United States government, nor to the fire or police departments of the city of Milwaukee, in the performance of their duties, and street railways in transit; also bus lines or other vehicles transferring passengers to and from different depots. Sec. 1265. Driving on Sideicalks. No per¬ son or persons shall lead or back any horses, or push or draw any wagon, cart or other vehicle on any sidewalk, or use, ride or drive any horse, wagon, sled or sleigh there¬ on, when no other suitable crossing or means of access is provided, unless such person or persons shall first temporarily protect, cover and cross plank or cause to be temporarily protected, covered and cross planked, such sidewalk, curb and gutter, with wooden planks. Sec. 1266. Vehicles Without Horses Not to 15 Stand in the Streets, Etc. • No person shall suffer any carriage, wagon, cart, sleigh, sled or other vehicle, without horses or other beasts of burden, to remain or stand in any street, alley, or upon any public wharf or dock for more than two hours, under a pen¬ alty of one dollar for each offense. Sec. 1267. Livery and Shop Men i\ ot to Leave Vehicles on Sidewalk, Etc. No owner or occupant of any livery stable, wagon or blacksmith shop, or other place of business shall suffer any wagon, cart, carriage, dray or other vehicle, whether left for safe-keep¬ ing, repair or otherwise, to be or remain on the sidewalk or alley, adjoining, or front¬ ing on any such premises nor on that half of the street adjoining or fronting the same, under penalty of five dollars for each and every offense. Sec. 1268. Horses Standing in Streets to Be Fastened. No person shall leave any horse or horses, whether attached or un¬ attached, to any carriage, wmgon, cab, truck, cart, dray or other vehicle, standing on any street alley or highway within the city, un¬ less the same be securely fastened, or the reins be in his or her hands, under a penalty of not less than two dollars nor more than twenty dollars for each offense. Sec 1269. Horse; How Fastened, No person shall at’any time fasten any horse or horses in such a way that-the horse or horses, vehicle, reins, or lines of any other fastenings shall be an obstacle to the free use of the sidewalk or crossw alk. Sec. 1270/ Width of Tires of Vehicles. Everv vehicle for the purpose of carrying loads of four thousand pounds or over, an the streets of this city shall be made with 16 wheel tires of not less than three inches in width, and all persons using vehicles, as aforesaid, carrying four thousand pounds with wheel tires of less than three inches in width shall be liable to a fine of not less than five dollars nor more than twenty-five dol¬ lars. SECTIONS OF THE STATE LAW REGU¬ LATING USE OF VEHICLES. Section 1636—49. Age of Driver; Limit of Speed. No person under the age of sixteen years, unless accompanied by parent, guar¬ dian or other adult person, and no intoxicated person shall operate, ride or drive any auto¬ mobile, motor cycle or other similar motor vehicle along or upon any public highway of this state. No person shall operate or drive any automobile, motor cycle or other similar motor vehicle recklessly or at a rate of speed greater than is reasonable and proper, having regard to the width, traffic and use of the highways and the general and usual rules of the road, or so as to endanger the prop¬ erty, life or limb of any person, and no per¬ son shall operate or drive any automobile, motor cycle or other similar motor vehicle, along any public highway, within the corpo¬ rate limits of any city or village at a speed exceeding fifteen miles per hour, nor on any of the public highways outside of the corpo¬ rate limits of any city or village at a speed exceeding twenty-five miles per hour; and provided further, that no person shall operate or drive any automobile, motor cycle or other similar motor vehicle through any cemetery or through any park or in passing any school ground where persons are or may be in said, highway at a speed exceeding eight miles per hour; and provided further, that in turning corners, in going around 17 curves, at sharp declines, at the intersection of any street or crossroad, and where, for any cause, the view in the direction in which the vehicle is proceeding, shall be obstructed, the speed shall be reduced to such a rate as will tend to avoid danger of accident; the operator, when such automobile, motor cycle or other similar motor vehicle is in motion, shall observe the rules of the road by keep¬ ing to the right upon meeting vehicles and by passing to the left of all vehicles overtaken on any public highway of this state, and at all times giving to the vehicle passed or overtaken one-half of the road. At the in¬ tersection of any public street or highway with any other public street or highway of this state, the operator or driver of any vehicle shall have the right of way over the operator or driver of any other vehicle ap¬ proaching him on such cross street or high¬ way from the left, excepting only in cases in cities where a police officer shall be in actual charge of the regulation of traffic at such intersection of streets. The operator or driver of any vehicle, when any street car is actually taking on or discharging pas¬ sengers at the crossings or intersections of any public streets or highways, shall stop such automobile, motor cycle or other similar motor vehicle, until such passengers shall have been taken on or discharged from such car. Upon meeting any vehicle on any public highway of this state where the traveled track of such highway is less than twenty feet in width, it shall be the duty of the operator of any automobile, motor cycle or other similar motor vehicle to reduce the speed of such automobile, motor cycle or other similar motor vehicle to a rate not ex¬ ceeding fifteen miles per hour until he shall have safely passed such other vehicle. It shall be unlawful for any person to oper- 18 ate any automobile, motor cycle or other similar motor vehicle without a sufficient modern and improved muffler to prevent noise, or with its muffler open upon or along any public street within the corporate limits of any city or village of this state. Sec. 1636—49a. Speed in Passing Vehicle . 1. It shall be unlawful for any person to drive or operate an automobile, motor cycle, or other similar motor vehicle upon and along any public highway of this state at a rate of speed exceeding ten miles per hour while within one hundred fifty feet and passing upon the same traveled track of said high¬ way any other automobile, motor cycle, or other vehicle going in an opposite direction; and it shall likewise be unlawful in passing to go within three feet of any other automo¬ bile, motor cycle, or other vehicle going in the same direction upon any single track of any such highway at a greater rate of speed than ten miles per hour. Speed Limit in Passing Vehicle on Left of Traveled Trade. 2. It shall be unlawful for any person when traveling on the left of the center line of the traveled portion of any pub¬ lic highway of this state, to drive or operate any automobile, motor cycle, or other similar motor vehicle upon and along any such high¬ way containing more than one traveled track at a greater rate of speed than ten miles per hour when approaching within one hundred fifty feet and passing within four feet of any vehicle, motor or otherwise; nor shall any person driving or operating any automobile, motor cycle, or other similar motor vehicle upon any public highway containing more than one traveled track pass within four feet of any vehicle, motor or otherwise, at a greater rate of speed than ten miles per hour 19 when passing any other vehicle, motor or otherwise, which is traveling in the same di¬ rection and to the right of the center line of the traveled portion of said highway. Sec. 163G—49b. Rule When Meeting and Passing. 1. Whenever a person operating a motor vehicle shall meet on a public high¬ way any other person riding or driving a horse or other draft animal, or any other vehicle, the person so operating such motor vehicle or vehicles, or riding or driving a horse, or other draft animal, shall each sea¬ sonably turn to the right of the center of the beaten track of such highway so as to pass without interference. Any such person so operating a motor vehicle or motor cycle shall, on overtaking any such horse, draft animal or other vehicle, pass on the left side thereof, and the rider or driver of such horse, draft animal or other vehicle shall, as soon as possible and with all convenient speed, upon signal, turn to the right of the center of the beaten track of such highway so as to al¬ low free passage on the left, and if necessary on account of road condition, such driver of said draft animal or other vehicle shall stop for sufficient length of time to allow said automobile to pass. Any such person so operating a motor vehicle shall, at the inter¬ section of public highways, keep to the right of the center of such intersection of such highway when turning to the right and pass to the right of the center of such intersec¬ tion when turning to the left. 2. Any person violating any of the pro¬ visions of this act shall be punished by a fine of not less than five dollars nor more than one hundred dollars or by imprisonment in the county jail for not less than ten days nor more than three months. 20 Sec. 1636—51. Rights of Vehicle Owners. Every owner and operator of an automobile or other similar motor vehicle shall have equal rights upon all public highways of this state with all other users of such highways, and no person or persons shall unreasonably obstruct or impede the right of travel of such operator or owner while operating, propelling or driving such automobile or other similar motor vehicle. No person or persons shall give a signal or sign of danger or distress or call for assistance upon a person lawfully operating any such automobile or other sim¬ ilar motor vehicle on a public highway with¬ out a reasonable cause for so doing. , Sec. 1636—52. Lights . From thirty min¬ utes after sunset until thirty minutes be¬ fore sunrise there shall be displayed on the front of every automobile or other similar motor vehicle, while being operated or driven along or upon any public highway of this state, at least one lamp giving a reasonably bright light in the direction in which said automobile or other similar motor vehicle is going, and there shall be displayed on the rear of every such automobile, motor cycle or other similar motor vehicle one tail light which shall display a red light visible from the rear, and it shall be unlawful for any per¬ son to operate or drive any antomobile, mo¬ tor cycle or other similar motor vehicle along or upon any public highway of this state at such a rate of speed that such automobile, motor cycle or other similar motor vehicle cannot be brought to a complete stop within the distance ahead that the driver or operator thereof can, with the aid of the lights there¬ on, in connection with the lights from other sources, see an object the size of a person. Every such automobile, motor cycle, or other similar motor vehicle, while being used upon 21 any public highway of this state, shall be provided with efficient brakes and an ade¬ quate bell, horn or other signal device, and it shall be unlawful for any person to use any signal device which shall not produce an abrupt sound sufficiently loud to serve as an adequate warning of danger, and it shall be unlawful for any person operating any motor vehicle or motor cycle to make or cause to be made any unnecessary noise with any such bell, horn or other signal device, or to use the same except as a warning of danger. The use of siren horns except upon motor vehicles in charge of the police and fire department of cities and upon hospital ambulances and fire insurance patrol, is hereby prohibited. Sec. 1G3G—52m. Operation Without Own¬ er's Consent; Penalty. 1. Any person who shall take, use and operate any automo¬ bile, motor cycle, or other similar motor vehicle upon any public highway of this state without the consent of the owner thereof shall, upon conviction thereof, be punished by imprisonment in the state prison not more than five years, or by imprisonment in the county jail or work house not more than one year, or by a fine of not more than one thou¬ sand dollars, or by both such fine and im¬ prisonment in the discretion of the court. 22 OL*. fcronrnbrrnrr Sc (Co.
