PENNSYLVANIA The information contained in this summary was compiled from material received from the plant quarantine official of Pennsylvania and has been approved "by him. It is issued for the convenience of plant quarantine in- spectors,, shippers, transportation agents, truckers, and others concerned in the interstate movement of plants, plant products, and other materials subject to State regulation on account of plant pests. The summary for Pennsylvania gives the general requirements for ship- ping nursery stock, into that State. An appendix furnishes information on post-office requirements for mailing plants as well as terminal-inspection procedure. This summary does not include digests -of nursery-stock and plant- quarantine requirements relating to the movement of plants entirely wi thin the State. The information contained in this circular is believed -to be correct and complete up to the time of preparation, but it is not intended to be used independently of or as a substitute for the original texts of the regulations, and it is not to be interpreted as legally authoritative. In addition to State requirements, shippers will need to take into consideration applicable plant quarantines of the United State Department of Agriculture. In most instances these quarantines regulate the inter- state movement.Qf specified plants, plant products, and other articles from designated regulated areas. However, some of these quarantines regu- late the interstate movement of certain articles into designated protected areas. Plant Pest Act of 1937) Definition of Nursery Stock, — All trees, shrubs, brambles,- woody vines, and woody florist stock, their roots, cuttings, grafts, scions, buds, fruit pits and other seeds, and parts thereof for propagation; herbaceous perennials and other plants and plant products for propagation as ornamen- tals, except bulbs, field-crop seeds, vegetable seeds and vegetable plants, flower seeds, and bedding and other annual herbaceous plants and parts thereof. G-eneral Shipping Requirements. — In order to obtain legal permission to do business in Pennsylvania, a nonresident nurseryman, dealer, or other per- son should file with the Pennsylvania Department of Agriculture a signed copy of his current State nursery-inspection certificate and a statement as to the exact acreage owned by him and the acreage being grown for him on contract. Copies of order forms, contracts, or agreements must be furnished the Department upon request. A dealer must furnish affidavit that he will buy only inspected and certified stock, and 'he must furnish on demand a list of all sources from which he secures his stock. An agent must carry a nursery agent's certificate obtained by authority of or by request of his principal. A valid inspection certificate of the State of origin must be at- tached to each shipment or container of nursery stock moving into Pennsylvania, and such shipment must also be plainly marked on the outside to show the names and addresses of consignor and consignee and the general nature of the contents. Uncertified shipments of nursery stock and im- portations from foreign countries must be reported, upon arrival, by the carrier or consignee to the Department of Agriculture and must be hald un- opened for inspection or instructions.
