Under this Ordinance the Importation of Plant Regulations (Government Notice No. 462, Aug. 5, 1932) vrere promulgated. Notice No. 462 cancels the following Government Notices, namely: No. 253 of 1913, No. 491 of 1921, No. 603 of 1921, No. 72 of 1922, No. 30 of 1926, No. 484 of 1926, No. 597 of 1923, No. 440 of 1929, No. 744 of 1929, No. 560 of 1930, and No. 369 of 1931. SUMMARY Importation Prohibited The importation of the plants and plant products named in regulation 8 (l), page 3, is prohibited from all places outside the Scheduled States (Belgian Congo, Northern Rhodesia, and the Union of South Africa) . Importation Restricted Departmental importations: The plants and plant products named in regulation 8 (2), page 4, are limited to introductions "by or under the direct supervision of the Department of Agriculture, subject to prescribed precautionary measures, including quarantine and special permit Special permit required: The plants and plant products named in regulation 8 (3), page 4, may be imported only under special permit issued by the Department and under prescribed conditions. -2- Importation Unrestricted Fruit, bulbs, tubers, garden vegetables, seeds, and such portions of plants as cannot be propagated, unless specially restricted or prohibited. (Reg. 8 (3) (i.), p.4.) GENERAL REGULATIONS Definitions Regulation 1. The following terms have the meanings respectively assigned to them if not inconsistent with the context: "Plant" shall include everything in the nature of a plant , and the fruit, leaves, cuttings, bark, or any part thereof, whether living or dead, severed or attached, but shall not include seed, unless specifically mentioned, nor manufactured products of plants. "Insect pesf'shall mean any insect or other invertebrate animal which may be injurious to agricultural or horticultural products . "Plant disease" shall mean any disease caused by fungus, bacterium, virus, or other organism which may be injurious to agricultural or horticultural products- "Cotton seed" shall mean seeds of any species or variety of Gossypium. "Cotton lint" shall mean cotton fiber from which all seeds have been removed by passage through a ginning machine, and shall refer to unmanufactured cotton generally, including linters and all kinds of cotton waste, but excluding purified cotton wool (absorbent cotton) and cotton batting. "Scheduled States" shall include Belgian Congo, Northern Rhodesia, and Union of South Africa. Reg. 2. These regulations shall apply generally to any plant imported into Southern Rhodesia. Authorized Ports of Entry Reg. 3. Plants may be introduced into Southern Rhodesia only by mail or through the following ports of entry: Beitbridge, Bulawayo, Gwelo, Plumtree, Salisbury, Umtali, or such port of entry -3- as the Minister of Agriculture and Lands may all cm under special permit, Regulations 4 to 7, inclusive. Administrative procedure concern- ing the importer or consignee. ON THE INTRODUCTION 0? PLANTS FROM OVERSEAS AND N^N SCHEDULED AFRICAN STATES Reg. 8. The introduction of plants and plant products into Southern Rhodesia from overseas or from any nonscheduled African State shall "be subject to the following restrictions: (l) Importation prohibited: (a) Eucalyptus, acacia, conifers, oak (Que reus) , plane (plat anus) plants or any part thereof except seed. (b_) Live peach stones. (c.) Fresh stone fruits. (d) Fresh citrus fruits, and dried citrus peel (candied citrus peel excepted) . (e) Elm seeds and. plants, including all species of Ulmus from Europe or any country where the elm disease (Qraphium ulmi) is known to exist. (f) Chestnut seeds or plants, including all species of Castanea from North America or any other country where the chestnut blight disease (Endothia para- sitica) is known to exist. (g.) Any plant packed in soil other than special rooting compost. (h) Government Notice No. 516 of September 16, 1927, prohibits also the importation of seeds, fruit, stems, roots, or any portion of Opuntia tuna Mill. , 0. ficus-indica Mill., and 0. monacantha Haw., and of the seeds of burweed (Xanthium spinosum).; , Mexican poppy (Argemone mexicana L.), and dodder (Cuscuta spp.) STATE .lJ5ffir*»*> -4- (2) Departmental importations: Importation of the follovriLng shall "be limited to introductions made "by or under the direct supervision of the Department and shall "be subject to such precautionary measures, including quarantine, as may "be prescribed, and shall "be subject also to a permit under subsection (3) hereof having been obtained: (a) Grapevines. (b_) Sugarcane. (c.) Plants of banana, cocoa, tea, and coffee. (See reg. 11 (2).)- (d) Plants cultivated for the production of rubber. (e.) Citrus frees, budwood, and seeds. (See reg. 11 (l).) (f) Cottonseed. (See reg. 11 (3).) (g) Lucerne (alfalfa) plants and seed. (3) Special permit required: Importation of the following shall be allowed only under special permit from the Department and shall be subject to any special precautionary measures which may be deemed necessary or expedient, namely: (a) Unmanufactured broomcorn derived from Sorghum. (See reg. 11 (3).) ~ (bj Unmanufactured cork. (c.) Coffee seed for propagation. (d) Tobacco seeds. (e) Acorns and chestnut seeds. (f) Seed cotton and unmanufactured cotton lint, exclusive of cotton batting. (See reg. 11 (9).) (g.) Seeds of maize a_nd barley. (See reg. 11 (4) (5).) (h) Tea seed. (See reg. 11 (2).) (j_) Any other plant or plant product -jhatever, - or living portion thereof, with the exception of fruit, bulbs, tubers, garden vegetables, seeds, and such portions of plants as cannot be propagated, provided that these are not specially prohibited or restricted elsewhere under these regulations. (See reg. 11 (6), (7).) -5~ Plants and Seeds from Scheduled States Reg. 9. Sets forth the conditions under which plants and seeds nay be imported from the Scheduled States of Belgian Congo, Northern Rhodesia, and the Union of South Africa. Application for Special Permits to Import Certain Plants Reg. 10. Applications for special permits to import plants into Southern Rhodesia shall be in writing and shall indicate: (1) The full name, residence, and postal address of applicant . (2) Name and address of person from whom it is proposed to obtain the plants. (3) BotanicaJ. names or the generally accepted popular names and varietal names of the plants and the number of each variety it is desired to introduce. (4) The method of shipment, whether by mail or otherwise; and if not by mail, the port of entry through which the plants are to be introduced. (5) The exact locality where it is proposed to grow the plants and whether or not it is intended to propagate from them. (6) Any other particulars which the Minister may require. Conditions of Entry for Plants Imported Under Special Permit Reg. 11. The following conditions shall apply to the granting of special permits for the introduction into Southern Rhodesia, of the plants, etc., designated, from overseas and nonscheduled African States: Citrus Trees (l) (aj Permits shall be granted only in respect to special varieties or strains which are not procurable in Southern Rhodesia and are judged likely to be of benefit to citrus culture if introduced into the Colony. The decision of the Minister shall be final. -c— Certificate Required (Id.) The consignment shall "be accompanied "by a certificate, signed "by a responsible official of the Department of Agriculture or other recognized institution in the country concerned, to the effect that the nursery or plantation from which the trees were taken was ade- quately inspected at a date not more than 3 calendar months prior to shipment and was apparently free at that time from serious insect pests and plant diseases, with special reference to citrus canker (Bacterium citri (Hasse) Doidge) . The certificate shall also state tiaat citrus canker is not known to have occurred at any time within 100 miles of the said nursery or plantation. Tea Plants and- Seeds Reg. 11 (2) Each consignment must "be accompanied by an official certificate from the Department of Agriculture o r the Indian Tea Association or other recognized institution in the country of origin to the effect that "blister "blight (Exobasidium vexans Mass.) has not occurred within a radius of 10 miles of the estate or garden on which the plants or seeds were produced. Broomcorn Reg. 11 (3) The straws of broomcorn must be detached and the crowns from which they originate must "be completely cut away or otherwise cut to shreds. Maize Seed Reg. 11 (4) Each consignment must be accompanied "by a certificate from the Department of Agriculture or other recognized institution in the country of origin to the effect that Sclerospora diseases of maize have not been known to occur in the district or corresponding administrative division in which the seed wa,s produced. No consignment shall exceed 10 pounds in weight. Barley Seed Reg. 11 (5) Ho consignment shall exceed 10 pounds in weight. -7- Fruit Trees, Forest Trees, Ornamental Shrubs, and Woody Plants Generally Reg. 11 (6) Permits shall not be granted for more than 12 trees or rooted plants or for more than 100 cuttings of any one variety, nor for an aggregate of more than 100 trees or rooted plants or 1,000 cuttings during any one year. Pome Fruit Trees Including Ornamental Species of Cydonia, Malus, and Fyrus Reg. 11 (7) Each consignment shall he accompanied by an official certificate from the Department of Agriculture or other recognized institution in the country of origin, stating that fire-blight (Bacillus amylovorus (Burr.) Trev. ) is not knoT7n in the premises where the plants were grovm. Cottonseed Reg. 11 (9) Permits shall be granted for the introduction of seed cotton and lint only uoder special justifying circumstances and subject to special precautions. Trade samples of cotton lint shall not exceed 1 pound in weight . Regulations 12, 13, and 14 do not concern the shipper. Form of Certificate Prescribed Reg. 15. In cases where certificates of cleanliness based on actual inspection of a consignment by an approved official are required, a certificate in the form shown on page 9 shall be utilized. REGULATIONS ON THE IMPORTATION OF POTATOES Shipper's Declaration of Crigin and TTart Certificate Required Reg. 16. iTo person shall introduce or cause to be introduced into Southern Rhodesia from overseas any potato tubers, unless he produces and delivers up to an inspector: -8- (1) A statement on oath from the consigner stating fully in what country and what particular place or places in that co-ontry the potatoes were grown, and containing particulars clearly establish- ing the identity of the consignment. (See prescribed form, p. 10.) (2) A certificate from the Department of Agriculture of the declared country, or a certificate from some official institution of that country which the Director of Agriculture, Southern Rhodesia, has' agreed to recognize in lieu of such Department, certifying at a date not more than 30 days before the time of the dispatch of the consignment that wart disease ( Synchytrium endobioticum (Schilb.) Perc.) has not been known to exist, as far as it is aware, within 5 miles of the places in which the potatoes are declared to have been grown. (See prescribed form, p. 9.) Provided that the certificate made necessary by regulation 16 (2) shall not be required in respect of any consignment from a country: (a) If the government thereof has certified to the Administra- tion of Southern Rhodesia that the said disease has not been known to exist in that country and if the government has undertaken to inform the Administration of Southern Rhodesia of any outbreak, and if information recording an outbreak has not been received; or (b_) If the consignee produces from the Department of Agriculture or other aforesaid recognized institution of the declared country of origin a certificate, dated within 9 months of the day of arrival of the potatoes concerned, to the effect that the specified disease has not been known to exist, as far as it is aware, in the shire, county, department, rr other such territorial division comprising the place or places in which the potatoes are declared to have been grown; but if required by an inspector, the consignee shall deliver up an attested copy of the certificate herein provided for. Potatoes Infested with Root-knot Nematode not Admitted Reg. 17. Any consignment of potatoes imported from any source, if found on inspection to be infested with the pest known as root gallworm or root-knot eelworm ( (Heterodera radicicola^ marioni Cornu) or with any other species of eelworm injurious to plants, shall be refused admittance into Southern Rhodesia or destroyed. -9- Wart-Infected Potatoes Destroyed Reg. 13. Should any consignment on arrival be found to be infected with wart disease, it shall be totally destroyed by fire. Regs. 19 and 20 relate to the transit of plants through Southern Rhodesia- Reg. 21 relates to penalties.
