ELECTION OF OFFICERS. SECTION 1. The election of officers shall take place annually on the second Friday in October, and shall be by ballot, in the following order: First, the Asso- ciation shall elect five (5) Trustees; the Trustees shall then organize by electing a President and a Recording and Corresponding Secretary, who shall be President and Recording and Corresponding Secretary of both Association and Board of Trustees; the Association will then elect a Vice President, Financial Secretary, Treasurer, Sergeant-at-Arms and a General Label Com- mittee of three (3). SEC. 2. Nominations for officers shall be made on the 2d and 4th Friday in September, after which no nominations shall be in order, except in case of a va- cancy. SEC. 3. No candidate for any elective office who is not in good standing on the books of the Association shall be balloted for. SEC. 4. No member shall be eligible to a seat in the Board of Trustees who has not been a member of the Association six months previous to the election. SEC. 5. Members who are under 21 years of age shall not be eligible to any elective office, and no mem- ber who is not a journeyman cigar maker shall be eli- gible as a member of the General Label Committee. Sec. 6. All members outside of San Francisco shall be entitled to vote for officers by sending their votes, sealed, to the Recording Secretary of the Association. Sec. 7. The names of the candidates for each office shall be announced by the President, when each mem- ber who is entitled to a vote shall deposit his ballot, which must be collected by the tellers; a majority of all votes cast shall be necessary to elect an officer. 11 ARTICLE V. DUTIES OF THE PRESIDENT. Src. 1. It shall be the duty of the President to pre- side at all meetings, and conduct the elections and an- nounce the result of the same. He shall preserve order and decorum, and pronounce the decisions of the meet- ing on all subjects; he shall inflict penalties accordin to the provisions of the Constitution and By-Laws, an he shall have the power, in urgent cases, or when de- manded in writing by ten members to call special meet- ings of the Association. Sec. 2. It shall be his duty to sign all orders upon the Treasurer for such sums of money as may, from time to time, be voted by the Association. Sec. 3. It shall be his duty as soon as he gets knowledge of any officer neglecting his duty to suspend said efficer, appoint one pro tempore, and report the same to the Board of Trustees, or at the following reg- ular meeting. SEC. 4. It shall be his duty to appoint all commit- tees, not otherwise provided for by the Association. ARTICLE VIL DUTIES OF THE VICE-PRESIDENT. Sec. 1. The Vice-President is to assist the Presi- dent in the discharge of his duties, and in case of his absence to act as President. Sec. 2. If both President and the Vice-President shall be absent from any meeting, the members present shall elect one of the Board of Trustees as President, pro tem. SEc. 3. In case of vacancy in the office of President from death, dismissal or resignation, the Vice-President shall be vested with his power, and perform all his duties until a successor is chosen by the Board of Trustees. | RZ 725\ D5 - ARN I 12 ARTICLE VIL. DUTIES OF THE RECORDING AND CORRESPONDING SECRE- TARY. Sec. 1. It shall be the duty of tbe Recording and Corresponding Secretary, to keep a true and correct record of the business transactions of the Association, to receive and answer all communications, keep a list of applicants for work, and a list of jobs open that may come to his knowledge; he shall submit a quarterly re- port, and at the end of his term an annual report of all the business pertaining to his office. ARTICLE VIII. DUTIES OF THE FINANCIAL SECRETARY. SEC. 1. The Financial Secretary shall keep a true and correct account between the members and the As- sociation, receive all money, and deliver the same to the Treasurer at the close of each meeting, taking his receipt for the same. et SEc. 2. He shall read off the names of all members who are in arrears three months for dues, at the first regular meeting in each month, and immediately notify such members. Sc. 3. It shall be his duty at the first regular meeting of the following month, to read off the names of all those who have failed to comply with the above Section. SEC. 4. It shall be his duty to hand to the Secretary of the General Label Committee, a list of all suspended or expelled members as soon after the adjournment of each meeting as possible. Sec. 5. He shall state at every regular meeting the amount of receipts and expenditures; he shall submit a quarterly report; his books shall, at all times, be open for inspection by the Board of Trustees, and at the end of his term he shall submit a full report of all the busi- ness pertaining to his office; and deliver all books and papers belonging to the Association to his successor. 13 ARTICLE IX. DUTIES OF THE TREASURER. Sec. 1. The Treasurer shall receive from the Finai- cial Secretary, all money belonging to the Association, giving his receipt for the same, pay all requisitions upon him signed by the President and Financial Secretary; he shall keep a true and correct account of all receipts and disbursements, and report at every quarterly meet- ing or oftener, if desired, by the Association in detail upon the state of the Treasury, and at the end of his term, submit a report in full, and surrender to his suc- cessor in office, all books, papers, funds and property belonging to this Association. SEc. 2. He shall furnish a good and sufficient bond with two sureties to be approved by a majority of the Board of Trustees in such sum as the Association may require for the faithful performance of his duties. Sec. 3: He shall deliver all sums exceeding one hundred dollars, ($100) to the Board of Trustees, tak- ing a receipt for the same. : ARTICLE X. DUTIES OF THE TRUSTEES, SEc. 1. The Trustees shall investigate all claims and bills, also the books of the Secretaries and Treasurer; they shall, whenever any money is to be deposited, re- ceive the same from the Treasurer, and deposit the same within twenty-four hours in the name of the As- sociation in such manner, and at such place as the As- sociation may prescribe. They are empowered to in- vestigate all committees intrusted with receipts and ex- penditures of money, and report all matters of interest at each regular meeting. SEC. 2. The Board of Trustees shall hold a regular business meeting every Tuesday evening for the pur- pose of furthering the interest of the Association, and any member of the Board failing to attend those meet- ings without a reasonable excuse acceptable to the | B77 E725 \N LS « ARNE HH I4 Board, shall be fined as follows: first offence, twenty- five cents; second offence, fifty cents; third offence, expulsion from the Board. Sec. 3. The Secretary of the Board, shall keep a correct record of the proceedings of the Board, and read the same before the Association at each regular meet- ing. SEC. 4. In case of death of any member of the As. sociation, the Board of Trustees shall attend to the funeral and all matters pertaining to his burial. ARTICLE XI. DUTIES OF THE SERGEANT-AT-ARMS. SEc. 1. The Sergeant-at-Arms shall have charge of the hall where the meetings of the Association are being held; he shall attend all meetings, and see that all officers of the Association are properly seated; he shall at all times, execute the orders of the President with regard to preserving order or carrying on the business of the meeting. ARTICLE XII DUTIES OF THE GENERAL LABEL COMMITTEE. SEc. 1. The General Label Committee shall appoint a sub-committee of one for each shop, which is entitled to the Labels according to the Constitution and By- Laws. Sec. 2. The Secretary of General Label Committee, shall keep a correct account of all labels printed, also a record of cigars made in each respective shop, and labels issued to each shop, and report thesame at each regular meeting of the Association. Sec. 3. The General Label Committee shall meet at least once a week at the headquarters of the Asso- ciation. ARTICLE XIII. COMPENSATION OF OFFICERS. The Recording and Corresponding Secretary shall re- members present, 15 ceive $5; the Financial Secretary $3, the Secretary of the General Label Committee $6, the Sergeant-at-Arms $1, and the other two members of the General Label Committee $2 each for their services per month; the Treasurer $3 per month. ARTICLE XIV. PUNISHMENT OF OFFICERS. Section 1. Officers failing to attend any regular meeting shall be fined 25 cts., unless they shall give a reasonable excuse, viz: sickness of himself or family, or absence from the city. Officers receiving compen- sation shall be fined as follows: The Recording and Corresponding and Financial Secretary, for failing to attend any regular meeting, 50 cts., and should they fail to send their books, $1.50 each; the Sergeant-at- Arms, 50 cts; members of the General Label Commit- tee, 50 cts.; and any member who is appointed on a special committee and fails to attend to the duties assigned him, shall be fined 50 cts. Sec. 2. Officers neglecting to perform their duties, may be removed from office by a majority vote of the ARTICLE XV. MEMBERSHIP. SecTioN 1. All persons connected with cigar manu- factaring, desirous of becoming members of this Asso- ciation, must be proposed by a member in good stand- ing; the proposition must be in writing, stating name, age, residence, and branch of trade in which they are engaged. SEC. 2. The initiation fee shall be one dollar ($1). Skc. 3. Every application must be accompanied by the initiation fee, and applicants shall be balloted for at the next regular meeting. SEC. 4. A majority vote of all the members present shall elect. | R772 0\\N 15 - ANN 16 SEC. 5. Kvery candidate elected a member of this Association, must present themselves at the next regu- lar meeting to sign the Constitution and take the fol- lowing obligation. ‘I—-do hereby pledge my word of honor that I will comply with the requirements of the Constitution and By-Laws of this Association, and per- form the duties involved therein to the best of my ability.” SEC. 6. Any candidate failing to comply with the above section, shall forfeit his initiation fee unless a reasonable excuse is given. ARTICLE XVI. BENEFITS. SEc. 1. If any member of this Association is out of employment or sick, he shall be exempt from dues and assessments during such time, provided he notifies the Financial Secretary of the same. SEc. 2. Donations may be given to any member in distress or for other beneficial purposes, whenever two- thirds of all members present deem it necessary. SEC. 3. In case of death of any member of this As- sociation, the Trustees shall have the power to draw from the Treasurer, the amount of one hundred dollars upon an order issued by the President, and counter- signed by the Recording Secretary, and deliver such money as a funeral benefit to the nearest relative of the deceased, and take a receipt for the same; but in case of no relatives being near, the Trustees shall defray all burial expenses not exceeding one hundred dollars, and give a correct account of the same at the next meeting. SEc. 4. In case of death of any member of this As- sociation, every member of the Association shall be as- sessed pro rata to defray funeral expenses. ARTICLE XVII CHARGES AND OFFENCES. 17 who shall violate the principles, rules or regulations of this Association, or disregard the requirements and laws thereof, shall be answerable therefore, and shall be tried and punished as the laws of the Association may direct. SEC. 2. No member of this Association shall be put on trial for any offence unless charges be preferred in writing, and a copy served on him and he have the op- portunity of defending before a committee appointed to hear the case who shall report to the Association, he shall have the privilege of defending himself by counsel, provided said counsel shall be a member of this Associa- tion in good standing. ARTICLE XVIII. FORM OF TRIAL. SEC. 1. All charges made against a member shall be handed to the Recording Secretary in writing, which complaint shall be read at a regular meeting of the As- sociation, after which the Secretary shall notify the accused when the matter will be taken up for considera- tion, at which time, if the charges are not withdrawn, a committee of five members shall be appointed. Sec. 2. It shall be the duty of the committee to whom a charge has been referred, to examine the par- ties, their proofs and witnesses carefully and impar- tially; they shall give due notice of the time and place of trial, and give fair opportunity for the accuser and accused to be present, the committee shall reduce their opinion as to the guilt or innocence of the accused in writing, and present the same, together with the re- cord of their proceeding and the testimony received, to the Association. The report of the committee shall be read, and after discusion the Association shall take a ballot, and a majority of the votes cast shall be the i — : i judgment of the Association. Sec. 1. Any officer or member of this Association a Ee pe || B72 5\\ N10 - ANNE 18 ARTICLE XIX. PENALTIES, Penalties shall be as follows: 1st. Expulsion. 2d. Suspension. ad. Fined. 4th. Reprimand. The vote on all penalties shall be by ballot. ARTICLE XX. DISSOLUTION OF THE ASSOCIATION. This Association cannot dissolve so long as seven members have paid their dues and express a willing- ness to fill the offices and be governed by this Consti- tution. ARTICTE XXI. No subject of a religious or political character shall be discussed in any of the meetings of this Association. ARTICLE XXII. This Constitution may be amended by a two-thirds vote, after two weeks notice of such amendment shall have been given, in writing, at any regular meeting. ARTICLE XXIII. The meetings of this Association shall be held on the second and fourth Friday of each month, at such place as may be agreed upon by a ma- jority of the members. SEc. 2. The meeting shall be called to order at eight o'clock in the evening from the second Friday in March to the second Friday in October, and at half past seven o'clock in the evening between the second Friday in October and the second Friday in March. Sec. 3. Special meetings may be called by the President, or by written request of ten members, after due notice in at least two daily papers of the intentions of such special meetings, provided that no business shall be transacted at any special meeting other than that specified in the call for the same. ARTICLE II. Section 1. The monthly dues of each member shall be 25 cts., and must be paid in advance. SEC. 2. Any member neglecting to pay, and in arrears for dues to the Association to the amount of $1, shall be suspended, unless otherwise provided by the Association. Sec. 3. Employers shall not receive labels for cigars made by suspended members. ARTICLE III. Section. 1. Members desiring to withdraw from this Association, if in good standing, and clear of all char- es, may be furnished a withdrawal card; such mem- 20 bers may be re-admitted upon producing said card, roviding such member has not violated any of the aws governing this Association. SEC. 2. Members employed or doing business out- side of San Francisco shall inform the Corresponding Secretary of their whereabouts, and pay their dues reg- ularly to this Association. ARTICLE IV. Section 1. Members having been expelled for vio- lation of the Constitution or By-Laws of this Associa- tion, may be re-admitted upon the payment of an ad- mission fee agreed upon by a majority of the members present. Sec. 2. In case any cigar maker obtains employment in a shop entitled to the Label of the Association, he shall be notified by the Shop Committee that if he de- sires the labels for his work, he must join the Associa- tion at the following meeting; and should he fail to be roposed, no labels shall be issued for his work unless fe deposits his proposition fee with the Shop Com- mittee. ARTICLE V. SecrioN 1. Members suspended for non-payment of dues, fines or assessments may be reinstated on pay- ment of the initiation fee of one dollar, and all arrears. ARTICLE VI. Section 1. The general Label Committee shall con- sist of three members elected by ballot, annually, on the second Friday in October. Sec. 2. Every manufacturer who employs white labor exclusively shall have the privilege of making application for the Label. Sec. 3. Every manufacturer applying for the use of the Label shall be taxed $1, at the time of making such application. - 21 Sec. 4. No labels shall be iggued to gny, manu. facturer employing Chinese. s iT rw SEC. 5. Section 4 shall not be altered or amended unless by a unanimous vote of the Association, and a vote on that subject must be by roll-call. Skc. 6. Should any manufacturer be found guilty of placing the Association Label on cigars made by Chinese, or cause them to be placed on such cigars, he shall forfeit the right to the use of same, and if the person so offending be a member of this Association, he shall be ignominiously expelled, and shall be publicly exposed as an enemy to white labor. SEc. 7. No labels shall be issued to any manufac- turer for cigars made previous to his making application for labels. ARTICLE VII. Sec. 1. The General Label Committee shall meet every Thursday evening at the headquarters of the As- sociation, and transact such business as may come be- fore them. Sec. 2. The Secretary shall keep a correct record of their proceedings, and of all the receipts and ex- penditures. Sec. 3. The Secretary of the Label Committee shall receive the reports of the sub-committee, and record the same to the account of the different manufacturers. SEC. 4. The Secretary shall attend to the printing and issuing of labels, and keep a correct account of the same. SEC. 5. Should the General Label Committee be at any time informed of any violations of the laws govern: ing the Label, they shall immediately investigate the matter, and if satisfied that there is cause for complaint they shall have full power to withhold the Labels from such parties, and report the same to the Association. TE SUATLS. ANN 1 ys 2 §gc. 6. The sub committee shall report, or send their reports once a week to the General Committee on Labels, at the headquarters of the Association, the number of cigars made in their respective shops by members of this Association, and apprentices. Sub- committees in the interior shall report at least once a. month by mail. Sec. 7. Any member of the sub-committee failing to report, as stated in Sec. 6, shall be fined as follows: first offence, 25 cts.; second offence, 50 cts.; third of- fence, expulsion from the Committee; and if found to give an incorrect report, he shall be expelled from the Association. SEC. 8. A Constitutional excuse for failing to report shall be accepted. SEc. 9. The sub-committee shall notify all non- members working in their respective shops, to join the Association, and failing to do so, the number of cigars made by them shall not be included in their reports. Sec.’10. These By-Laws shall be subject to the same mode of procedure for amendment as is laid down in the Constitution for amendments to that document, with the exception of Sec. 4, Art. Reports of special committees. Unfinished business. New business. Receipts of the evening. Adjournment. RULES OF ORDER. RULE. 1. A Quorum shall consist of twenty-five (25) members. RuLE. 2. A smaller number shall have power to adjourn a meeting to some other time, if half an hour after the time appointed for the meeting, no quorum shall be present; a resolution contemplating such ad- journment is as binding as if ro from a quorum. But no other business shall be valid, unless the afore- said number of members shall have been present at the opening of the meeting. RuLE 3. It will be presumed that a quorum is al- ways present, if present at the opening of a meeting, and all business transacted will be legal and valid, although a number of members necessary to constitute a quorum should have left, until a motion for a count- ing of the members present shall be made (which motion, when made, must be put, although it be not seconded). If upon such call it appears that a quorum is not present, the meeting is, from such time, disquali- fied to transact business until a quorum be again pres- ent. Ruik 4. The meeting shall be opened by the dec- laration of the presiding officer. RuLE 5. Any member present may demand that the meeting be opened at the appointed time. RULE 6. In the absence of the first presiding officer (President) the second (Vice-President) shall take the char. RuLk 7. After the meeting is opened, every mem- ber present shall observe decorum and order, and take his seat. 25 RuLe 8. After the meeting is called to order, the President shall cause the minutes of the preceding meeting to be read. RuLe 9. Upon the reading of the minutes, any member is authorized to move to correct the same, which corrections shall be entered in the minutes, un- less objections thereto be made by some other member, in which case the motion to correct shall be put to a vote, and decided by the whole meeting. RuLk 10. After the reading of the minutes, the reg- ular business shall be proceeded with. RuLE 10. All business and motions shall be sub- mitted by the presiding officer to the meeting. RuLE 11. No motion shall be put, debated, or voted upon, unless the same be seconded by at least one member. RULE 12. When any motion is regularly pending, no other motion can be put or received except privil- eged motions or subsidiary motions. - PRIVILEGED MOTIONS. 1st—For adjournment. 2d—To lay on the table. 3d—For the previous question. These motions are not subject to debate, shall be in order at all times, and shall take precedence of each other in the above order. SUBSIDIARY MOTIONS. 1st—Permission to withdraw a motion. 2d—Temporary suspension of the rules. .3d—Motions to amend. 4th—To refer. 5th—To postpone to a definite time or indefi- nitely. 6th—For the order of the day. 7th-—Points of order. 26 These and all other motions arising out of the main question, must be decided before the main question is put. RuLE 13. Any member may participate in debate. The presiding officer however, must first call some other member to the chair before he can move or de- bate any question. RuLE 14. After the meeting is opened, no member shall speak without having first addressed the chair, and obtained the floor. RuLE 15. The chairman of the committees submitt- ing a report, shall have the conclusion of the debate touching such report ; and the mover of any proposi- tion touching the proposition. RuLk 16. The chairman shall name the person to whom he accords the floor. Such member shall then rise, uncovered from his seat, and address the chair- man, and no indecorum or personalities shall be per- mitted him. RuLk 17. If any member wander from the question in issue, or make use of indecent or offensive language, he shall be called to order by the presiding officer, and if such member refuse to obey the call to order twice, the chairman shall order him to leave the meeting. RuLe 18. No member shall be interrupted while speaking, except by a call to order. RULE 19. Any member deeming himself aggrieved by recall to order, may appeal to the meeting, when the chairman shall take a vote, whether the call to or- der shall be sustained. RULE 20. A motion having been made, seconded, and put, and the debate thereon closed, the chairman shall take a vote thereon. RuLe 21. If upon any motion there be a tie vote, the chairman shall cast the deciding vote. ~ 27 RuLe 22. Any member having voted with the side which prevailed in such vote, may move for a recon- sideration of such vote : but such reconsideration can only be had in the meeting next after taking the vote. RuLE 23. If the result of any vote appear doubtful, or the announcement of the same by the presiding officer be deemed incorrect, any member may demand a division; and if such motion be seconded, the votes shall be counted. RULE 24. In such case the chairman shall appoint two tellers, and the result shall not be deemed correct un- less both agree therein. RuLk 25. A member cannot speak more than once on the same subject, if others desire to speak ; but no member shall speak more than twice, and no longer than ten minutes without permission of the majority of members present. RuLk 26. No member shall retire from the meeting without permission from the presiding officer. RuLE 27. No member shall move from his seat after the tellers commence their count, until the result is announced. RuLe 28. Committees shall be chosen by the Asso- ciation or appointed by the President, as the Associa- tion may agree upon. RuLE 29. No absent member can be appointed on any committee. Rui 30. Any member declaring upon his word, that it will be impossible for him to perform the duties of a committee, shall be excused. RULE 31. Excuses shall be received only before the appointment or election. RuLE 32. For the purpose of debating an important matter, a meeting may resolve itself into a committee. RuLk 33. Each committee shall elect its own chair- man, during the meeting when appointed, and imme- diately to announce the same. Ruck 34. The chairman of each committee shall submit its reports. A majority of a committee shall compose a quorum. RuLE 35. A committee shall be discharged after re- porting, or announcing that they cannot perform the duties imposed upon the same, concerning which the meeting shall decide. LE 36. Any correction based upon any section of these rules, shall at once be recognized, and any mo- tion, debate, or resolution not consistent with the same, shall be deemed void as soon as any member proves such inconsistency.
