The whole number of persons pardoned by the Governor du- ring the year, is one hundred and ninety-six, 196 Sentences commuted, 3 Restorations to right of citizenship, 29 Respites have been granted in thirteen cases. Of the pardons, one hundred and three were from the different State prisons. Of these, the number convicted of arson, was, 2 Arson, 4th degree, , 1 Assault, with intent to kill, 7 u " to commit a rape, 1 u on a watchman, 1 Administering poison, 3 Burglary and larceny, 2 Burglary, 3d degree, 4 Burglary, 17 Bigamy, 1 Buggery, 1 Burglary, 2d degree, 3 Carrying slung shot, 2 Forgery, 1 Forgery, 2d degree, 4 Forgery, 3d degree, 2 " " and petit larceny, 2d offence, 1 Grand larceny, 29 Highway robbery, 1 Incest, ... 1 Manslaughter, 3 " 2d degree, 1 Murder, 1 Obtaining goods under false pretences, 1 Perjury, 2 4 [Senate Passing counterfeit money, . 5 Petit larceny, 2d offence, 1 Procuring an abortion, 1 Larceny, 2 Larceny, burglary and arson, 1 Rape, 7 Robbery, 4 Using slung shot, 1 The number pardoned from the different penitentiaries, was seventy. The crimes of which t&ey were convicted were : Assault and battery, 31 Assault, 1 Assault on an officer, 2 Bigamy, 1 Disorderly, 14 Drunkenness, 2 Malicious mischief, 1 Misdemeanor, 1 Not given, 3 Petit larceny, 11 Receiving stolen goods. 2 Violating excise law, I The number pardoned from the different jails was twenty-two, and the crimes as follows : Assault and battery, 5 Assault with intent to commit a rape, 1 Assisting prisoner to escape, 1 Disorderly, 3 Embezzlement, 1 Keeping disorderly house, 1 Passing counterfeit money, . . 2 Riot, 5 Violating excise law, 3 All of which is respectfully submitted. ( To the Legislature: The Secretary has the honor to transmit to the Legislature the following tables, in compliance with the provisions of an act, en- titled, "an act, respecting convictions in criminal courts, and to procure statistical information concerning convicts," passed April 26th, 1839. The tables are made from the reports of clerks of criminal courts, and sheriffs of counties, returned to this office, pursuant to law, during the year 1853. They are believed to be correct, so far as the reports to this office are correct. But these are frequently found to be inaccurate and unsatisfactory, and therefore, tables, compiled therefrom, cannot give an entire satis- factory account of the criminal statistics of the State. Table marked A. gives the number of convictions for criminal offences in courts of record, in each county of the State specified, during the year 1853, as reported by the clerks. The sentences were : To be hung, 13 To be imprisoned in state prison, 662 do in jail or local prison, 320 do in house of refuge, 56 To be lined, 551 To be fined and imprisoned, 171 Suspended, or not given, 71 Table B is an abstract of table A, presenting the aggregate ol the convictions for the different offences in each county in the State. 6 [Senate Table C gives the whole number of convictions for the different offences throughout the State, males and females being separately- classed. The whole number of convictions was 1844 ; of these 1757 were males and 87 females. Male3. Fern's. For offences against the person, 410 8 do property with violence, 182 3 do property without violence, .... 517 56 Offences not included in the foregoing, 647 20 Table D exhibits the number of convictions and for what of- fences, in our courts of record, in each year, from 1839 to and including 1853. Table E gives the color, social relations, nativity, education, orphanage, or the contrary, and habits, in regard to temperance, of those convicted in courts of record, during the year, in the counties specified ; so far as the same are reported by the sheriffs. These reports are evidently imperfect, as there are a large number of convictions reported by the clerks, more than reported by the sheriffs. The sheriffs of the counties of Allegany, Cayuga, Essex, Hamilton, Kings, Lewis, Madison, Ni- agara, Oneida, Onondaga, Otsego, Richmond, Suffiolk, Sullivan, Tioga, Tompkins, Ulster and Wyoming, have made no report of convictions in courts of record to this office. These are nearly one third of the counties in the State, and some of them the most populous and important. Other sheriffs have reported but par- tially. The sheriff of the county of Rensselaer has reported but two convictions, the clerk of the same county reporting 17. I speak of this only as a specimen of these reports and not as being singular. These facts will account for the great difference which appears between the aggregate of cases reported by the clerks and those reported by the sheriffs. Table G gives the occupation of persons convicted in courts of record, as given by the sheriffs. Table H is an abstract of the returns of the clerks of criminal courts, giving the number of indictments tried, at the several • 8 [Senate terms of each in each county, the number of convictions had thereon, the acquittals, the cases in which the .fury disagreed, the number of persons convicted on confession, and the number dis- charged without trial. Table I is an abstract of table H and shows the whole number of indictments, convictions, acquittals, &c, in each county. From this table it appears that the whole number of indict- ments tried and reported, was 1 ,536 On which defendants were acquitted, ....... 450 On which defendants were convicted, 1 ,059 On which jury did not agree, 27. Persons convicted on confession, 1 ,056 Number on which persons were discharged without trial,. 470 Table K is an abstract of the clerks of counties, made in pur- snance of section 7 of the act of 1839, requiring such clerks to transmit to the Secretary of State copies of all certificates filed with them of convictions made by courts of special sessions, the month in which the conviction was had, the sex, offence and sen- tence of each convict is given. Table L is an abstract of K, and gives a summary of the same returns, classified by counties. Table " N" is an abstract of the same returns, in respect to the sex, age, c^lor, married or single state, nativity, education, or- phanage or the contrary, previous conviction or the contrary, and temperance or intemperance of those convicted.
