 An Ordinance of the Lords and 
 
 Commons aflerabled in Parliament, for 
 advancing by way of Loane, the fummc of 
 Fourcy thoufand pounds,&c. 
 
 He Lords and Commons affembled in 
 Parliament, finding the many Battells 
 S ieges and other fervice performed by the 
 Army under the Command of Sir Tho¬ 
 mas Fairfax^,;mi the necefiarie recrui¬ 
 ting and iupplying'thereof at fo great a 
 diftance hath occafioned a ferre greater expcnce, 
 then was at firft conceived, And alfo the great Ad¬ 
 vantages, which through the bleffing of God, the 
 Common-wealth hath received by the unwearied 
 indeavours of the faid Army; Doehold'it neceirai'y,that 
 a Confiderable fumme of money bee forthwith ad-^ 
 vanced for the fupply of the faid Array^ and defraying 
 of the charges incident thereunto, Have Ordained, and 
 doe hereby Ordaineby authority of Parliament, that 
 the fumme of forty thoufand pounds Ihall be forthwith 
 advanced by way of Loane for the intents andpurpofes 
 aforefaid,by,andonfuchperfonsof abiiitie as (hall vo¬ 
 luntarily, or by AffelTment lend the fameon the Securi-- 
 ty,and Termes'hereafterexpre{fed. And in regard many 
 perlbns of abiiitie-through difaffeftion or otherwife, 
 have been llbw in the like Services tending to the gewd 
 and prefervatibh of the PubliquCj It is therefore by the

 land pounds; That the Committee appointed hy feve- 
 rall Adis of Common.Coiinfcll for gathering of the 
 Arrears, or any rcven ormoreof themftiallbe a Com¬ 
 mittee to Regiikr and take the Subferiptions of allpef- 
 fbns that-fhall voluntarily lend and advance moneys 
 as aforefaid, and to afTelTc fiich peiTon or perfons as iliall 
 not according to their Abilities, voluntarily and pro- 
 portionably advance the fame/And to AlfelTe fuch part

 Andbe.it Ordained by authority aforefiid. That all-

 hereof, and negledlihg or refufmg to pay the faid ieverall- 
 fummes fo aflcfTed unto the faid Treafurers at Warre 
 withinteii dayes after notice given, or left at his or their 
 ufuall place of aboad, or at the dwelling Houfeor place

 • And if any peribn flhall ncgled, or. refufe to pay the 
 futn affefsed, until! a Diftref e be taken for the fame 
 then, that every perfon or perfons fo neglcding or, refu¬ 
 fing as aforefaid, (hall pay fuch reafonable charge for 
 every fuchi diftrels, removall, or fale of his, her, or their 
 goods as the faid Committee (of Lords and. Commons, 
 or any five of them one thereof being a Peere) appointed 
 by theOrd.inance of the ip of March. 1^45 .thall allow to 
 be imployed for the better execution of this Ordinance. 
 
 And if no fufficient Diftrefs can be hadj, or taken- of 
 the goods of the perfons that (hall be AlTefsedj.by vertue 
 of this prefent Ordinance, then fuch peribn or perfons 
 Iball be by vertueof a Warrant from the Committee 
 of Lords and Commons as aforefaid who: are hereby 
 authorifed to grant the fame, be committed to fafe -Cu- 
 ftodie, there• to remaine untill lucli perfon -or perfons 
 fhall fatisfie the faid-fummcairefsed upondhem by ver¬ 
 tue hereof, which money fo brought ihtothe Trealurers 
 at Warre fhall be ifsued forth by Warrant from .the 
 faid'Committeeof Lords and Commons appointed by 
 Ordinance of ,the zp of March zkteCna , except¬ 
 ing what fhall be byorderof theCommitfee appointed 
 by this prefeiit Ordinance deduifted for payment of per-

- And for the better: incouragetnent and fecuring of 
 fuch perfonsas {hall advance the faid fumme or any pare 
 thereof, The Lords and Commons doe hereby Ordaine 
 that fuch perfbn or-perfons aslhallpay or lend any mo¬ 
 ney upon or by vertue of this Ordinance, and pay the 
 'fametbtheTreafurers at warre aforefaid, (hall be re¬ 
 paid the feverall fummes which (hall bee by them ad- 
 v^ced,out of. the receipt of the Exiefe and new Impoft, 
 with intereft after the irate of eight pound per centum^pe^ 
 Ahnum^Qt fo long tinie as they {hall fotbeare the fame. 
 
 AndtheCommilfionersof Excize and newimpoll 
 for the time beiiig, are hereby authorized and required 
 to pay unto the feverall Lenders^their Executors and. af- 
 figneSj^t the end of fix moneths, the intereft for fo much; 
 money as {hall bee advanced by vertue hereof and the 
 principalland remainderoftheintereft thereof after the 
 rate a Wfaid, in due eourfc, order and ranke as the fame 
 ftandscharged upon thefaid Excife andImpoft,unto.the: 
 perfons that doeadvance the fame. . ' 
 
 And the receipt of the faid Treafurers at Warre or 
 anytvvoof them, one. being an Alderriian, fhe other a 
 Gommoner,fhall intereft and inritle every p.er{bn or per- 
 fbns to whom it {hall be given, his or their Executors, 
 AdminiftratOrs or affignes, into the fecurity and benefit 
 of this prefent Ordinance with Intereft aforefaid. 
 
 And it is furtherOrdained that no Ordinance nor af- 
 fignemetit, not paft in the faid receipt of the Excife be- ^ 
 fore an Ordinance of the fecoad of September lad, for 
 the payment of fifty tho'ufand. pounds in courfe^ for 
 the ferviceoftheArniy under theiComm'andofSir Th'o- ’

 it {hall be paid in its courfe from that time accordii^ly, 
 
and th(>'aforementioned receipts of the Treafurers at

 chaigetothe Commiflioners of Excife and every of 
 them,for payment pf the faid fummes to the feverall per-

 And it is further Ordained, that all Majors,, Sheriff, 
 Conftablesand Headboroughs, and all Officers of the 
 Trayned Bands an 4 . Auxiliaries within the faid limits, 
 (hall be. aydirigtd‘fhe faid rtfpeftive Committees, and 
 iuchasthey flrallimployih the execution'of this pre- 
 fent Ordinance. 
 
 And the faid refpeAive Committees fhall have pow¬ 
 er to.irnppfe upon fuch Officers or perfons fo rieglecling. 
 theirduties thertin,. fuch Fine or Fines as to- them'fhall 
 feeme meet,not exceeding forty fli'illings for any oiie of- 
 fence,and to caufe the fame to be leavied by diftrefle and 
 faleofthegoodsasaforefaid... 
 
 Arid.it is further Ordaihedij that all peirfons ailing in 
 purfuance of this Ordinance, fhall be favcdThahnrelle by 
 authority of Parliament. 
 
 Atid that rio priviledged places fhall be exempted from 
 
 Provided that fuch perfons as fhall make itappeareto 
 the laid Conamittee of Arreiresby their Proteftation 
 or Oath that hee or they are 'ndr worth one thoufand 
 pounds,fhall not be by this Ordinance . 
 
 Provided aV«yes that this Ordinance, for ariy claufe 
 therein concayned, fhall not extend to any of the Peers 
 of thfs Realm,or to the Members of the Houfeof Com¬ 
 mons, or Affiftant,attendant or Officer of the Houfe of
