Upon the appearance of eight Members, including the President, the President, or in his absence, a President pro tcm. shall take the chair as President, and the Members be called to order. II. Whenever the President may wish to leave the chair, he shall have power to substitute a Member in his place, provided that such substitution shall not continue beyond the day on which it is made III In case the President shall not attend, the Clerk, on the appearance of eight Members, shall call the Board to order, when a Piesident pro tern, shall be appointed by the Board for that meeting, or until the appearance of the President. VI Immediately after the President shall have taken the chair, the minutes of the preceding meeting shall be read by the Clerk, to the end, that any mistake therein may be corrected by the Board. 5 V. The President in all cases has the right of voting ; and when the Board shall be equally divided, including his vote, the question shali be lost VI Whenever it shall be moved and carried, that the Board go into the Committee of the whole, the President shall leave the chair, and shall appoint a chairman of the committee of the whole who shall report the proceedings of the committee. The rules of the Board shall be observed in the committee of the whole, except the rules respecting a call for the ayes and noes, and limit- ing the time of speaking. VII On motion in committee to rise and report, the question shall be decided without debate. Ylll No amendment shall be allowed in the Board on any question which has been decided in committee of the whole, unless by the consent of two thirds of the members present. IX The President shall cause the clerk to make a list of all ordinances, resolutions or reports on the table, which shall be con- sidered «• the general orders of the day." Original communications and petitions stall be first taken up — then any unfinished subject — then the special orders of the day—then the general orders of the da\, unless the Board shall decide differently. It shall be the duty of the clerk to certify and send to the other Board, every act, ordinance, and resolution, which has originated in and passed the Board of Aldermen, and which requires a concurrent vote of the Board of Assistants, and to deliver to the 6 Mayor, certified in like manner, all such ordinances and resolutions which shall have been received from the Doard of Assistants, and concurred in by the Board of Aldermen ; and which are required to be submitted to him for approval ; and the clerk shall certify to the other Board, the proceedings of this Board, in reference to all acts or business originating with the other B.ard- XV. The President shall preserve order and decorum, and shall decide questions of order, subject to an appeal to the Board XVI. Every member, previous to his speaking, shall rise from his seat and address himself to the President. XVII. When two or more members shall rise at once, the Pre- sident shall name the member who is first to speak. XVflf. No person shall speak more than twice to the same question, without leave of the Board, nor more than once until every member choosing to speak shall have spoken, nor more than once upon the previous question. XIX. No question on a motion shall be debated or put, unless the same be seconded. When a motion is seconded, it shall be stated by the President before debate, and ever^ such motion shall be reduced to writing, if any member desire it. XX. After a motion is stated by the President, it shall be deem- ed to be in the possession of the Board, but it may be withdrawn at any time before decision or amendment. XXI. When a question is under debate, no motion shall be re- ceived unless 1. To amend it. 4. To postpone it. 2. To commit it. 5. For the previous question, or 3. To lay on the table. 6. To adjourn. XXII. A motion to adjourn shall always be in order, and shall be decided without debate. XXIII. The previous question, until it is decided, shall preclude all amendments and debate of the main question, and shall be in this form, — " Shall the main question now be put ?" XXIV. Every member who shall be present when a question is put, shall vote for or against the same, unless the Board shall ex- cuse him, or unless he be immediately interested in the question, in which case he shall not vote ; but no member shall be permitted to vote upon a question when a division is called, unless present when his name is called in its regular order. 7 XXV. A member called to order shall immediately set down, unless permitted to explain, and the Board, if appealed to, shall decide on the case, but without debate. If there be no appeal, the decision of the chair shall be submitted to. XXVI. All questions shall be put in the order they are moved, except in filling up blanks— the longest time and the largest sum shall be first put. XXVII. upon a division of the Board, the names of those who vote for. and those who vote against the question, shall be entered upon the minutes, not only in the cases required by law, but when any two members require it. XXVIII. In all divisions taken by the Board, on the call of a member, it shall also be the duty of the Clerk to enter on the min- utes the name of the member so calling for the division. XXIX. All appointnemts of officers shall be by ballot, unless dispensed with by the unanimous consent of the Board, and a majority of the whole number present shall be necessary to constitute a choice. XXX. No member shall absent himself without permission from the President. XXXI. All committees shall be appointed by the President, unless otherwise ordered by the Board. Committees appointed to report on any subject referred to them by the Board, shall report a statement of facts, and also their opinion thereon in writ- ing ; and no report shall be received unless the same shall be signed by a majority of the committee. XXXII Whenever the doors are directed to be closed, all persons excepting the members and the clerk shall retire. XXXIII. Every petition, remonstrance, or other written ap- plication, intended to be presented to the Common Council, is to be delivered to the President or any other member of the Board, on any day, but not later than four o'clock on the day on which the Common Council convene, except on extraordinary occasions ; and the President, or other member to whom it shall be given, shall examine the same, and endorse thereon the name of the applicant and the substance of such application, and sign his name thereto, which endorsement only shall be read by the President unless a member shall require the reading of the paper, in which case the whole shall be read. 8 XXXIV. The Standing Committees, to consist of three members each, shall be as follows : 1. Applications for Office. 2. Assessments. 3. Arts and Sciences and Schools. 4. Charity and Alms-house. 5. RVTjES of order OF THE BOARD OF ASSISTANT ALDERMEN, OF THE CITY OF NEW-YORK, PASSED JUNE 3, 1833. I. Upon the appearance or eight Members, including the Pre- sident, the Members shall be called to order. II. In case the President shall not attend, the Clerk, on the appearance of eight Members shall call the Board to order, when a President pro. tempore shall be appointed by the Board for that meeting, or until the appearance of the President. Special Orders of the day. 6th General orders of the day. 7th Motions and Resolutions. 8th Messages from the Mayor, or from the Poard of Aldermen, may be considered at any time. V. Each Board sliall transmit to the other all papers on which any ordinance or resolution shall be founded. 2d. When an ordinance or lesolution which sliall have passed in one Board, is rejected in the other, notice thereof shall be given to the Board in which the same may have passed. 3d. Messages from one Board to the other, shall be communi- cated by the respective clerks of each Board, unless the Board transmitting tbe message, shall especially direct otherwise. 4th. It shall be in the power of either Board to amend any amendment made by the other, to any ordinance or resolution. 5th. In every case of a difference between the two Boards upon any subject, either Board may request a conference, and appoint a Committee for that purpose, and the other shall also appoint a Committee to confer. The Committee shall meet at such hour and place as shall be agreed upon by their Chairmen, and state to each other, verbally, or in writing, as either shall choose, the reasons of their respective Boards, and confer freely thereon. And they shall be authorized to report to their respective Boards, such modifications or amendments as they may think advisable. 6th. It shall be in order for either Board to recede from any subject matter of difference subsisting between the two Boards, at any time previous to conference, whether the papers on which such difference has arisen are before the Board receding, formally or informally. 15 7th. The two Boards shall meet together in Common Council, for the purpose of making appointments, on the first Wednesday in each month, and oftener if they, by concurrent resolutions shall so determine, in the chamber of the Board of Aldermen, at which meetings, the President of the Board of Aldermen shall preside, or in his absence, the President of the Board of Assistants. A majoiity of each Board shall be requisite to form a quorum, and the vote shall be taken by ballot. 8th. The commissions or notifications of all appointments shall issue under the seal of the Common Council, signed by the Pre- sident of the Board of Aldermen and clerk of the Common Council.
