BE IT Ordained, 3y Z/^^- Mayor, Aldermen and Commonalty of the City o/'New- York, in Common Council convened, and it is ^.^^^.j^ Labour hereby Ordained by the Authority of the fame. That no Perfon or Goods bought or or Perfons fhall do any Manner of fervile Work or Labour on ^^'^ ^y^ny P"fo"- the Lord's-Day, called Sunday, (Works of Piety, Charity, or Ne- ceffity excepted) or buy or fell any Goods, Wares or Merchandizes whatfoever on that Day within the faid City, under the Penalty of Ten Shillings for every Offence; And if any Child, Apprentice, Servant or Slave, fhall be guilty of any of the Offences aforefaid, the Or by Children, Parent, Mafler, Miflrefs or Owner of fuch Child, Apprentice, &c. &e. Servant or Slave, fliall Forfeit and Pay the Sum of Six Shillings for every fuch Offence. II. And be it fvrtkerOrdaised, the Authority aforefaid^ That no Public Inn-Keeper, Alehoufe-Keeper,Vi£tualer, or Ordinary- Keeper, fhall entertain or receive Company in their Houfes or other Place or Places, and there fell any Kind of Wine or other Liquor on the faid Day, (unlefs to Strangers, Travellers, or thofe who lodge in fuch Houfes, for their neceffary RefrefBmcnt:) And that no Inn-Keeper, Ale-Houfe Keeper, Victualler or Ordinary- Keepier, do at any Time fuffer any excefiive drinking, or Perfons to be drunk in their Houfes, under the Penalty of Twenty Shillings for each Offence. IV. And EE it further OrdAIned, by the Authority aforefaid. That the High Conflable do order and take Care that Two or more of the Conftables of the Six Wards on the South Side of the Frefh Water, andof the Bowery Divifion of the Out-Wafd, do by turns fucceflively, on every Sunday, in Time of Divine Service, walk through the fe- veral Streets and Lanes of this City with their Staffs, and caufe this Law to be duly kept and obferved ; and to that end the faid High Conflable and other Conftables, are hereby authorifed and required, to enter into all or any of the Public Houfes, Taverns, Ale-Houfes, Vidlualling Houfes, or Ordinaries, and if any Perfons fhall be found tipling therein, or Strong Liquors fold contrary to this Law, they lhall make Complaint and Prefentment thereof, that the fame may puniflied as aforefaid. That the Seal commonly City Seal called the City Seal, (hall be and remain in the Cullody and Keeping of the Clerk of the faid City, and that the fame be put and affixed to all Grants, Leafes, Freedoms, Warrants and other Inftruments and Writings, which fhall from Time to Time be made, granted or iffued by Order of the Common Council of the faid City, or other- wife provided for by the Charter of the faid City, and to Freedoms granted by Order of the Mayor's Court, and that the faid Seal be not put or ufed to any other Purpofe whatfoever. That the fmall Seal, commonly called the Seal of the Mayor's , Court, fhall alfo be and remain in the Cuftody and Keeping of the Scai/^""^* ^""^ faid Clerk, and be put and affixed to all Procefs iffiiiiig out of the faid Court and the Court of General Seffions of the Peace, and to no other Purpofes whatfoever. A LAW Relative to the Admission of Freemen. BE IT Ordained, /y^^- Mayor, Aldermen and Commonalty of the City of New- York, in Common Council convened, and it is hereby Ordained by the Authority of the fame. That all and every Perfon or Perfons hereafter to be made Free of this City, (who were not Born within this City or ferved a regular Apprenticeffiip of Seven Y'ears within the fame) fhall Pay for the Freedom thereof as follows. Freedom Fees. . Every Merchant, Trader or Shop-Keeper, the Sum of Five Poz^rW^ Lawful Money of the State of New- York, including the fe- veral Fees herein after-mentioned ; And every Handicraft Tradef- man, the Sum of Twenty Shillings of like Lawful Money, for the t^fe of the Corporation, with the following Fees on being made Free, that is to fay. Eight Shillings to the Mayor, Six Shillings, to the Recorder, Seven Shillings and Sixpence to the Clerk, and One Shil- ling to the Cryer of the Mayors-Court ; and that every Perfon who was Born or ferved an Apprenticefhip within this City, fliall Pay for being Sworn a Freeman, and being Regiftered, and for a Certificate thereof the Sum of Eight Shillings to the Mayor, Six Shillings to the Recorder, Seven Shillings and Sixpence to the Clerk, and Ojie Shilli?ig to the Cryer and Bell-Ringer of the Mayor's-Court. IL And be it further Ordained, by the Authority aforefaid. That every Perfon hereafter to be made Free of this City, fliall take fuch fuch Oath of Allegiance to the State of New- York, as now Is or hereafter fliall be eftaoiillied by Law, before the Mayor, Deputy Mayor, and any Four or more of the Aldermen ; and aifo the fallowing Oath or Affirmation, to 'wit : I A. B. do Swear (or folemnly Affirm as the Cafe may be) that I, as a Freeman of the City of New- York, will maintain the lawful Franchifes and Cuftoms thereof, and keep the fame City harmlefs as much as in me lieth, and that I will in all Things do my Duty as a good and faithful Freeman of the fame City ought to do. Buv.k,c;ts, and having Six Fire-Places and under Nine, Four; and having Nine Fire-Flaces and upwards, Six ; and of every Brew- Houfe, Dillillery and Sugar-Houfe, Nine Buckets ; and of every B.ike-Houfe, Four Buckets ready in their refpeftive Houfes and Baildings aforefiid ; arid • that the fame be found and procured by the Penbns inhabiting the faid Houfes, and the Price thereof be al- lowed by the Landlord out of their Rent, and that the faid Buckets be Marked with, at leafl, the Liitial Letters of the Landlord's Name. And if any Houfe- Keeper or other Perfon aforefaid, fliall Negled: to procure and have ready in their refpedtive Dwelling- Houfes and ether Buildings before-mentioned, the Number of Leather Buckets in Manner herein before directed, luch Houfe-Keeper lhall tor every Month he fhall fo Negledt, Forfeit the Sum of Six Shillings for each Bucket. And if any Perfon or Perfons fliall detain from the Owner any Bucket or Buckets which fliall be ufed at any Fire as aforefaid, above Forty-Eight Hours after fuch Fire is extinguifhed, the Per- fon fo detaining fuch Buckets {hall Forfeit and Pay to the Owner fdr each Bucket fo detained the Sum of 'Twenty Shillings ; and if the Owners of any Buckets are not known, the fame fhall be fent to the No Buckets to b« City-Hall of this City, and be delivered to the Marlliall or Keeper thereof, in Order that they may be referved for the Owner. IV. And se it further Ordained, by the Authority aforefaidy That the Fire-men fhall from Time to Time and at all Times during their continuance in their Olnce, have and enjoy the Benefits and Fire-mens Dut^ Privileges hereafter-mentioned; and be fubjed: to and demean and Privileges, themfelves according to the Rules and Regulations following, to wit: lit. That as often as any Fire fliall break out within this City^ the faid Fire-men fliall immediately upon Notice thereof repair to their refpediive Fire Engines, and draw them to the Place where fuch Fire fliall happen, and there, by the Direction of the Mayor, Recorder and Aldermen, Sheriff, Engineer or Overfeer of the Fire Engines, or any of them who fliall be pre- fent. Work and Manage the faid Fire Engines, and other Tools and Inftruments, with all their Power and Skill, for the fpeedy extinguifliing fuch Fire, and when fuch Fire is extinguifhed. Shall return the faid Fire Engines and other Tools and Inftru- ments, well wafhed and cleaned, to their refpedlive proper Places of Depofit. 2dly. That if any Fire-man fliall be abfent frorri any fuch Fire, Fire-meh not to (without reafonable Caufe) he fl:iall, for every fuch Default, be Abftnt. Forfeit and Pay the Sum of Twelve Shillings. 3dly. That for the better keeping the faid Fire Engines in good Order and Repair, and Preferving the flime from Decay, the faid Fire-men fliall, when the Seafon of the Year wfll Permit^ (by the Order and Direilion of the Overfeer of the faid Fire Engines) once in every Month, and at any Time or Times when required by the Mayor or any Three or more of the AL-i C dcrmeii [ 8 ] Fire Engines to be kept in good Or- der. Fire-rncn for Negleifl of Duty to be difplaced. dermen of the faid City, for the Time being, or by Order of Common Council of the faid City, draw out the faid Fire En- gines in Order to their being Examined, and fhall Work, Ma- nage and Exercife the fame, and Wafli and Cleanfe them, and be careful that they be in good Order and Condition and fit for Service upon any Emergency, and then return the fame to their refpcdlive Places of Depofit ; and that if any Fire-man fhall Negledl his Duty herein, he fliall, for every fuch Default, Forfeit and Pay the Sum of Six Shillings. 4thly. That if any Perfon who is Appointed and Regiftered as a Fire-man fhall Negledl or Refufe to do his Duty as fuch, in at- tending Fires, or in Working, Managing and frequent Exer- cifing. Trying and Ufing the faid Fire Engines, Tools and other Inflruments provided for the better Extinguifhing of Fire, fuch Fire-man making Default, fhall (befides the Fines and Penalties before-mentioned) be removed and difplaced from the Office of a Fire-man. Regulation as Hay, &c. to V. And be it further Ordained, by the Authority aforefaid. That no Perfon or Perfons whomfoever fhall have, keep, or put any Hay or Straw in Stack or Pile in his, her, or their Yard, Garden or in any other Place on the South-Side of a Line beginning at the Out-Let of the Swamp of Leonard Lefpenard, Efquire, into Plud- fon's River, thence to and along the North-Side of the Dwelling- Houfe of Nicholas Bayard, Efquire, thence to and along the North- Side of the Dwelling- Houfe late of Thomas Jones, Efquire, and thence to and along the North-Side of the Dwelling-Houfeof Abra- ham Cannon, to the Eafl-River, except in clofe Buildings proper for the Purpofe : And alfo that no Perfon or Perfons fliall have, keep, or put any Hay or Straw in any Houfe, Stable or other Building to the Southward of the Line aforefaid, which is or fhall be within Ten Feet of any Chimney, Hearth or Fire- Place, or Place for keeping Afhes, under the Penalty of Twenty Shillings for every Offence. And that if any Perfon or Perfons fliall continue to keep Hay or Straw in any fuch Houfe, Stable, Building or other place aforefaid, above Forty -Eight Hours after Convidtion thereof as aforefaid, he, fhe or they fhall be fubject to the like Penalty, and fo as often as it fliall happen as aforefaid. VL And be it further Ordained, by the Authority aforefaid^ That if any Perfon whatfoever do Fire or Difchargeany Gun, Piftol, No Guns to be Rocket, Cracker or Squib, or other Fire Works, in any Street or difcharged in the other Place whatfoever within the Limits lafl aforefaid, fuch Perfon Streets, &c. &c. offending fhall for erery Ofi?"ence, Forfeit and Pay the Sumof !r,?« Shilliyigs, A LAW for the better Securing this City from the Dahger of GuN-PoWDER. WHEREAS the better to fecurc the Inhabitants of the City of New- York from the Dangers they have been expofed to by large c 9 i large Quantities of Gun-Powder being lodged in the Magazine at the Frefh Water, and being kept in Houfes, Shops and Stores with- p^g^jj^y^ in the faid City, a fuitable and convenient New Magazine or Powder- ^ ' Ploufe is eredled and built at Inclembergh, in the Out-Ward, for the reception of all the Gun-Powder which is or fhall be imported into the faid City : I. That the Common Council of the faid City fliall from Time to Time AppoiHt a Sober, Difcreet and Sufficient Inhabitant of the faid Keeper of th«i City, to be Store-Keeper of the faid Magazine or Powder-Houfe, Magazine to be ap. lately ereded as aforefaid; that it fhall be the Duty of the P°i"tcd, faid Store- Keeper to Receive and Store in the faid Magazine or ^^ho is to to be Ac Powder-Houfe, all fuch Gun-Powder as fhall be thereto brought countable to the to be fafely kept and Stored, and that he fhall be Accountable OwnerofGunPow- tlierefor to the Owners thereof, (Lightning and other unavoidable Stored, Accidents excepted) : That he fhall as often as required, every g,,^ ^Lxttnii at the Day (except Sunday) between the Hours of Ten and Twelve in Magazine to Re- the Forenoon, and Two and Four in the Afternoon, give his At- Gun-Powder, tendance to Receive into and Deliver out of the faid Magazine or Powder-Houfe, all fuch Gun-Powder as fhall be brought thereto to be Stored, or as fliall be required to be delivered thereout as afore- fiid : That upon his receiving into his Cuftody any Quantity of Gun-Powder, he fliall enter the fame in a Book to be kept for that ^nd enter the fame Purpofe, fpecifying the Names of the refpedive Owners, the ;;g^^eNam'"e of the' Quantity of Gun-Powder, and the Size, Marks and Numbers of Owner, &c. &c. the Cafks, and at the fame Time give his Receipt in Writing for the fame to the Owners thereof. III. And BEIT further Ordaiu'e.-d, by the Authority aforefaid. That the Store-Keeper of the faid Magazine or Powder-Houfe, for the Time being, fhall and may Demand, Take and Receive (for the ^^^^^ ^^^^^ ^ Ufc of the Corporation) for the Storage of all Gun-Powder Received ^.^^^ ° into the Magazine or Powder-Houfe aforefaid, (Gun-Powder be- longing to the United States or this State excepted) the Rates or Sums of Money following, viz. For every Barrel of Gun-Powder One Shilling and Four-Fence, for every Half-Barrel One Shilling, and for every Quarter Bar- rel or fmaller Caflc Eight-Fence, for any Timeiefs than a Year. And if fuch Gun- Powder fhall lie in the faid Magazine or Powder- Houfe for any longer Time than One Year, double thofe Sums for each Cafk of Gun-Powder above-mentioned. IV. That the Inhabitants who are Houfe-holders to the fouthward of Frefh-V/ater, Ihall once in every Week, between the Firft Day of March and the Firft Day of December yearly, and on the refpedive days which lhall for that Purpofe be appointed from Time to Time by the Alderman of each relpedive Ward, before the Hour of Twelve in each Day, caufe rll the Dirt and Filth in their refpedive Yards and in the Street oppofite to each of their Lots, and between fuch Lots and the middle of the Gutter, to be fwept, coileded and laid in Heaps, that the fime may be ready to be taken rp and remov- ed by the Scavenger or Scavengers of the faid City, from Time to Time to be appointed by the Common Council, which Scavengers refpedively (hall have and be entitled to the excluiive Right, Benefit and Advantage of all the Dirt and Manure which fliall be fo fwept up and coileded in the feveral Streets of the Wards for which they fliall refpedively be Scavengers : And if any Perfon fliall take or carry away any Dirt or Manure, which by this Law is vefted in the Sca- vengers refpedively, he fliall forfeit and pay Four Shillings for each Load of fuch Dirt and Manure, to be recovered by the Scavenger or Scavengers of the Ward in his or their own Name, and for his or their own Benefit, provided fuch Dirt or Manure (hall be removed by fuch Scavenger within the Time and in the Manner it ought to be removed according to the true Intent of this Law : And if any Perfon fliall Negled or Refuie to do and Perform what is fo enjoined on him or her, he or fhe fliall, for every fuch Negled or Refufal, for- feit the Sum of Three Shillings ; and it fnall be, and hereby is made the Duty of the Scavengers, Conftables and Marfhalls, to give In- formation to the Alderman of the W ard, of every fuch Negled, or Refuffl, who fhall forthwith proceed againft the Ofi^ender for the fdd Penalty as the Law direds. Recorder or Alder- man, is hereby empowered and required to give Judgm^ent agreeable to the Report of the faid Perfons fo to be named, or of any Two of them ; and in Cafe the faid Play is judged to be unmerchantable, the faid Mayor, Recorder or Alderman, fhall Award the Owner or Seller, or Infpedor of the fame Hay, to pay the Cofts of the faid Trial or Examination ; but if fuch Hay, upon fuch Examination, fhall be found to be well cured, dry and merchantable according to the Diredlions of this Law, the Charges of fuch Examination fliall in fuch Cafe be paid by the Purchafer, or fuch other Perfon at whofe Requeft the View and Examination was made. A L A W regulate the Sale i?/'Fire-Wood in this City. E IT Ordained, by the Mayor, Aldermen and Commonalty of the City a.i^'eh, by the Authority aforefaid. That no Cord- Wood fhall be fold other wife than according to the following Regulation, that is to fay. The Rungs or Stantions of each Cart or Sled which fhall be em- ployed in the carrying of Cord-Wood fhall be three Feet eight Inches high from the Floor of the Cart and no higher ; and the Breadth of the faid Carts between the two foremoft Rungs or Stantions fhall CaS^&cl^trJn. be two Feet five Inches, and between the two hindmofl Rungs or tain ^ of a Cord. Stantions fhall be two Feet nine Inches and no more; in which Space between the faid Rungs or Stantions (and even with the top thereof) every Cart-Man who fhall Cart any Wood, fhall flow as much and as clofe together, as it can conveniently be put ; which Wood fo loaded fhall be deemed and is hereby declared to be a Quar- ter of a Cord, and fliall and may be bought and fold accordingly. IV. And be it further Ordained, by the Authority aforefaid. That if any Perfon or Perfons fhall fell or buy any Cord- Wood con- tr;:ry to the above Regulation (refufe Wood herein after-mentioned only excepted) or if any Cart -Man fhall Cart any Cord- Wood brought to this City for Sale, but in Carts or Sleds made and con- ftructed as by this Law is directed, and loaded as is above-mention- ed, he or they fo offending therein, fhall for every Offence forfeit and pay the Sum of Twenty Shillings. And to prevent, as much as poffible, any Alteration in the Mea- fure of the Wood from the wearing of the Rungs or Stantions of the Carts, V. Be it further Ordained, by the Authority aforefaid. Nor Ballaft, &c. to be ta'.en from the Wharves. Nor Timber or Filth, &c. kept ofi VI. And be it further Ordained, by the Authority aforefaid. That no Sloop, Boat or other Veffel whatfoever, (except fmall Craft, fuch as Ferry-Boats, Market-Boats, Pettiaugers and Canoes) fliall come within the Slip, at the End of the Common Sewer which leads under the Fly-Market, and empties itfelf into the Eafl-River, un- der the Penalty of Forty Shillings for every Tide they fhall lie with- in the fame.
