In this great age of progress and civilization, uni- versal tendency is toward organization and com- bination. The wealthy capitalists combine and con- solidate, monopolize and control the wealth of the world, while the rapid concentration of wealth and power in the hands of the moneyed classes has had an extremely injurious effect upon all branches of honorable toil, and in this respect none have suf- fered greater depression than the Carpenters and Joiners of New York. This condition of affairs demands our most earnest attention. It is evident that, to protect ourselves, we must combine. There is no hope for us except in unity of action. Single handed we can accom- plish nothing, but united there is no power of wrong we may not openly defy. Therefore it is impera- tively the duty of every Carpenter and Joiner to do all in his power to secure thorough organization and unity of action among the men of the trade. We therefore formed the Greater New York District Council of the United Brotherhood of Carpenters and Joiners of America. OBJECTS AND POWERS. This District Council is organized in conformity with the Constitution of the United Brotherhood of Carpenters and Joiners of America, to exercise legislative and executive functions, whose de- cisions shall be binding upon all members of the United Brotherhood that are working within the jurisdiction of this District Council. It shall es- tablish a uniform rate of initiation fees and dues, frame all working or trade rules and enforce the same, and issue a quarterly working card. It shall have power to make agreements with central organ- izations in this district and send delegates to same when necessary. The District Council shall also order all strikes when it is for the best interest of the U. B. or may delegate said power to its business agents or such persons as the District Council may from time to time decide, and shall decide all disputes between Borough Committees and Local Unions represented in this District Council. All members are required to study these by-laws carefully; pleading ignorance of the same shall not excuse any member from penalties. By=Laws of District Council of Greater New York and Vicinity. Section i. This body shall be known as the Dis- trict Council of Greater New York and Vicinity, and shall consist of representatives from the five boroughs located in the City of New York and vicinity. REPRESENTATION. Sec. 2. The District Council shall consist of one delegate from each Local Union, said representatives to be given credentials with their names and addresses signed by the President and Secretary of their L. U. with seal affixed. No one is eligible to membership in the Council who is not actually engaged at Car- penter work or some of its branches. All delegates to the Council shall be elected in the same manner as the officers of the L. U. and for a period of six months. Sec. 3. A quorum shall consist of a majority of all delegates to the Council. The regular meetings of the Council shall be held every Saturday. Special meetings may be called by the President and Secre- tary-Treasurer, on the written request of ten dele- gates, representing ten Locals, or by a majority vote of the District Council. Meetings to be called to order at 3 P. M. All business within the organization must be submitted to the District Council in writing. Sec. 4. The Council shall have executive powers on all matters relating to the common interest and welfare of all; and in cases of necessity can levy a 5 special assessment on all members under its juris- diction, said assessment to be collected through the Borough Committees. All matters referred to the Local Unions by the District Council for a vote must be returned to the District Council within thirty days from date of issuance. Failing to com- ply with above the vote will not be counted. OFFICERS OF THE COUNCIL. Sec. 5. The officers of the Council shall consist of a President, Vice-President, Secretary-Treasurer, Warden and Board of three Trustees. Sec. 6. The Secretary-Treasurer shall be a salaried officer and shall be elected by the referendum vote of the entire membership of this district ; the member receiving a plurality vote shall be declared elected. Nominations for the above office may be made by any Local Union in this district, at their first meetings in June and December and must be forwarded im- mediately to the Secretary-Treasurer of the District Council. The election to take place on the same night as Business Agents, which is hereinafter pro- vided. All other officers of the District Council shall be elected according to the Constitution. The salary of the Secretary-Treasurer shall be $4.50 per day. DUTIES OF PRESIDENT. Sec. 7. It shall be the duty of the President to preside at all meetings of the Council, conduct the same according to parliamentary rules, enforce a due observance of the Constitution and By-laws; decide all questions of order without debate, subject, how- ever, to an appeal to the meeting, and see that all officers perform their respective duties faithfully. He shall sign all official documents that may have been passed by the meeting. 6 DUTIES OF VICE-PRESIDENT. Sec. 8. The Vice-President shall conduct the meeting and assume the duties of the President in his absence. The same rules to govern him as apply to the President. DUTIES OF SECRETARY-TREASURER. Sec. g. The Secretary-Treasurer shall keep «. correct record of each meeting, preserve all docu- ments and correspondence, issue all calls for special meetings, have charge of the seal and affix the same to all official correspondence, sign all legal orders, keep a correct account between the District Council, Borough Committees and Local Unions, receive all moneys due the Council, place the same in some bank designated by the Council immediately. He shall not be allowed to retain more than $200 in his possession at any time. He shall pay all orders properly drawn, issue the quarterly working card to all Local Unions represented in this Council, as hereinafter provided, send a list of all new officers to the General Office, forward a copy of the minutes of each meeting to Borough Committees and to each Local Union in the district. He shall send to each Borough Committee and Local Union in the entire district a list of new and suspended mem- bers, together with a list of all members that have been fined in the district. He shall send to each Local Union in their respective districts a copy of the Borough Committee minutes and Business Agents' reports; also furnish each Local Union with a copy of the Quarterly Report of the Board of Trustees. He shall furnish the Board of Trustees with all papers, books and other documents in his possession and meet them to assist in auditing the accounts at any time when called upon by them. 7 He shall have charge of headquarters and report to the District Council any violation of rules govern- ing the same. He shall keep a list of all delegates and their addresses and notify their respective Bor- ough Committees of the absence of any delegate for two consecutive regular meetings. He shall draw all checks, which must be countersigned by the President and Chairman of the Board of Trustees of the Council. He shall make a quarterly written report of the financial standing of the Council and perform such duties as may be required of him in his official capacity. He shall file with the Presi- dent a surety indemnity bond to the amount of $5,000 for the faithful performance of his duties and shall receive such salary as the District Council shall from time to time determine. Sec. 10. The Warden shall have charge of the door and admit all members of the United Brother- hood who are in possession of the current pass word. All visiting members must also present their due card to the Warden, who shall write their names. Local Unions and ledger numbers in a book supplied by the Council, and the Warden shall per- form such other duties as he may be called upon to perform, subject to the order of the presiding officer. Sec. 11. The Board of Trustees shall be respon- sible for all the property and shall have the super- vision of funds and property, subject to such in- structions as they may receive from time to time from the Council. It shall be their duty to see that the Secretary-Treasurer deposits, in such banks as the Council shall decide, all moneys over and above such sum as the Council may decide shall be left in his hands for contingent expenses or legal bills; instructing the officers of the bank to pay no money on account of the Council except on an order signed by the President. Secretary-Treasurer and Chairman of the Board of Trustees and stamped with the seal of the Council. They shall examine the accounts of the Secretary-Treasurer the first meeting night of each month and see that it is correct and shall pre- pare and execute bonds of the Secretary-Treasurer and shall audit the books of the Secretary-Treasurer next meeting after the report of Secretary-Treasurer each quarter, and make a written report of their audit to the Council as soon as possible and perform such other duties as prescribed in these laws, or as the Council may direct. EXECUTIVE COMMITTEE. Sec. 12. This committee shall consist of the follow- ing officers of the District Council : President, Vice- President, Warden and the Trustees, and the Secre- tary-Treasurer, who shall have voice, but no vote. They shall transact all business referred to them by the Council between meetings of the Council, and subject to the approval by the District Council, and perform such other duties as the Council may direct. HEADQUARTERS OF DISTRICT COUNCIL. Sec. 1.3. The Council shall establish a centrally located headquarters, which shall be open from 8 A. M. to 5 P. M. All members visiting same must conform to the rules of its government. Violations of rules will be punished in accordance with the Constitution and By-laws. Also procure furniture and telephone for the proper transaction of business of its officers and also establish an employ- ment bureau. WORKING CARDS. Sec. 14. The Council shall issue a quarterly working card to the Local Unions for each member of the United Brotherhood in good standing in this district, for which there shall be a charge of seventy- five cents per quarter. The revenue from this card shall be used for the general running expenses of the District Council, such as the salary of officers, Business Agents, strike pay and expenses of District Council office. No card shall be issued to Local Unions by the Secretary-Treasurer except upon the presentation of a written order, signed by the President and Secretary, and bearing the seal of the Local Union applying for the same. All Local Unions repre- sented in this Council shall take out a working card for each member in good standing on their books. All members of the United Brotherhood working in this district and not represented in this District Council must apply to the Secretary-Treasurer of the District Council or Borough Committee for the same. It shall be the duty of the Financial Secretary of each Local Union to sign the name of each member upon the quarterly working card in ink. For each neglect of this duty the Secretary shall be punished by a fine of $1 for each offense. REMOVAL OF OFFICERS. Sec. 15. Any officer who is permanently or tem- porarily in the employment of the District Council shall devote the whole of his time to the purpose for which he is employed. Should he during work- 10 ing hours spend time for other purposes than the duty of his office or the advancement of the interest of the United Brotherhood, time so spent shall be deducted from his salary, and for the first offense he shall be fined at the discretion of the District Council. For the second offense he shall be re- moved from office. Sec. 16. Any officer or committeeman who will- fully neglects the duty assigned to him shall be fined or removed from office. All charges must be pre- ferred in writing, addressed to the Council, said charges to lay over until the next regular or special meeting. Due notification to be served by Secre- tary-Treasurer on all parties interested. A majority vote shall decide all questions of this character. Sec. 17. Any delegate to this Council absenting himself two consecutive meetings, without reason- able excuse, or refusing to serve on at least one committee his seat shall be declared vacant and the Borough Committee notified to send another dele- gate in his place. Any member failing to come to order promptly at the request of the chairman shall be fined or suspended from the Council for any period that the Council shall decide. Any delegate to this Council having unpaid fines against his name shall forfeit his rights as delegate until such fine is paid. Sec. 18. (a) The initiation fee in this District shall be five ($5.00) dollars for new members, and for ex-members on first application and admission not less than $10.00; on second application and admis- sion not less than $15.00. Sec. 18. (b) Dues shall not be less than 65 cents per month for beneficial members and 40 cents for semi-beneficial members. 11 BUSINESS AGENTS. Sec. 19. The Business Agents of this district shall consist of four for Manhattan, one of whom shall speak the English and German languages ; one for Shops & Unfair Trim/ and two English-speaking, three for Brooklyn, two for Bronx, two for Queens and one for Richmond, and they shall be elected for a period of six months. No Business Agent shall be a member of the District Council or Borough Committee. Their salary shall be $4.50 per day, with $1 a day for expenses, and shall be paid by the District Council through the Secretary-Treasurer. Sec. 20. At the first meeting in June and Decem- ber each Local Union shall nominate a candidate or candidates for Business Agent for their respective boroughs only and send such nominations to the next meeting of the District Council properly signed and stamped with the seal of the Local, each Local being entitled to nominate as many candi- dates as there are Business Agents required in the borough. All candidates must receive their nomi- nation from the Local Union of which they are a member. Sec. 21. The Council shall, upon the receipt of nominations, have printed a sufficient number of ballots for the use of Local Unions in each bor- ough, having the names of candidates for Business Agent for that borough only; these ballots to be delivered by the Secretary-Treasurer to the Bor- ough Committees and by them to the Local Unions on the night of election not later than 8 P. M. Can- didates for Business Agent shall deposit $2 each with the Secretary-Treasurer of the Council to defray the expenses of election. Sec. 22. The election of Business Agents shall take place on the last Monday in June and Decem- L2 ber. Local Unions not meeting regularly that night must provide for a special meeting. Polls are to be opened by the President promptly at 8.30 and closed not later than 11 P. M. (Borough Inspectors shall insist on the compliance of this law), after which the Recording Secretary will immediately proceed with roll call. Upon the member's name being called, he shall immediately deposit his ballot. The roll call does not apply to any Local Union with a membership of over 500. Inspectors to vote at Local Union where on duty. Sec. 23. The official ballot and none other to be used in the election. Members must mark the ballot with an "X" opposite the name of candidate they wish to vote for. One Inspector, regularly appointed by the Borough Committee, shall super- vise the election in each Local Union. The Local Union shall appoint two tellers to distribute and re- ceive ballots, and the Recording Secretary shall mail the returns to the Secretary-Treasurer, signed by the President, Recording Secretary, the Inspector and the two Tellers, with the seal of the Local Union impressed thereon. The Borough Commit- tee's Inspector shall also bring used ballots and a copy of the official returns to the Council. Should the Borough Committee Inspector be absent for any cause the Local Union can appoint a Teller to act in his place and the vote of the Local shall be legal. All returns not in the Council by the following meeting, the vote of that Local shall be null and void. Sec. 24. The Business Agents shall be elected for the term of six months. The necessary qualifica- tions for Business Agent shall be as follows: To be a competent Journeyman Carpenter of good moral character and capable of reading and writing the 13 English language distinctly, and must have been a member of this district and in good standing for twelve months previous to nomination. They shall have a voice but no vote in the Borough Com- mittees. Sec. 25. The Business Agent may be suspended from office at any time for dereliction of duty, by the Borough Committee, upon charges preferred against such Agent in writing; such charges shall be acted upon by the Committee of the Whole, said committee to report to the Borough Committee, who shall immediately act upon such report, and if said Agent be found guilty by a majority vote of the committee they shall immediately fix such pen- alty as the Borough Committee shall decide. Sec. 26. If at any time a Business Agent be re- moved, the Borough Committee shall appoint a sub- stitute and the District Council immediately notified of such appointment, whereupon the District Coun- cil shall take immediate steps to have an election for a Business Agent to fill the vacancy. Sec. 27. The duties of each Business Agent shall be to regulate all differences that may arise between members and their employers, enforce the working rules in regard to hours and wages. He shall also furnish a written report of all work done and money collected by him each week to the Borough Com- mittee and Secretary-Treasurer of the District Council. He shall endeavor by all honorable means to increase the membership of the Brotherhood by inducing journeymen carpenters of sound health to become members, at all times look after the welfare of the members in procuring employment where- ever possible and perform such other duties as the President of the District Council or the Borough Committee may direct. 14 Sec. 28. The District Council shall furnish each Business Agent with an official receipt book with a stub attached to each receipt, number on the stub and receipt to be the same. He shall also be fur- nished with order and strike certificate books. Sec. 29. The Business Agent shall use no other form of receipt but that furnished him by the Dis- trict Council. Any Business Agent found guilty of violating this section shall be suspended from office and be subject to conditions set forth in these By- laws. When said receipt book is filled, the Business Agent shall return the stubs and all multilated re- ceipts to be filed. Each Business Agent shall have to account for all receipts and stubs furnished to him. All money collected by Business Agents shall be paid by them to the Treasurer of the Borough Committee at the meeting following the date of collection. All money collected by the Business Agents for Locals in this district shall be sent to them through their delegates to the Borough Com- mittee. Sec. 30. Each Business Agent shall have power to order all local strikes. Where a strike involves over six men he shall consult the Strike Committee and be subject to conditions set forth in these By- laws. He shall settle all grievances that may occur during the interval of sessions of District Council or Borough Committee, shall have power to enforce payment of besides initiation fee, fines of ex-mem- bers and to examine the pay envelopes, and shall insist, where there are any member or members found working for less than the standard rate of wages in their respective boroughs, that they shall be debarred from working for that employer for the space of at least six months, and under no condi- tions shall a Business Agent permit a member to 15 work without the current quarterly working card. Members refusing to show their working card when called on by the Business Agent shall be fined $5 for each offense, and members not having their working card with them while at work shall quit work upon the order of the Business Agent and not return until able to show card to Shop or Job Steward. Sec. 31. All charges preferred by the Business Agents against members shall be referred to the Borough Committee where the offense was com- mitted for trial. Sec. 32. Whenever a general strike is contem- plated in any borough it shall be the duty of the Borough Committee to submit the same to the District Council for their approval, and if the Dis- trict Council decides to sanction such movement, the question shall be submitted to the membership of the entire district for a vote. Sec. 33. Members receiving the nomination for President, Secretary-Treasurer of District Council or Business Agent shall not be eligible unless they receive the nomination from the Local Union of which they are a member. Sec. 34. The District Council shall adjourn sine die the first meeting in January and July, imme- diately after the adoption of minutes of previous meeting, presentation and payment of bills and re- port of Trustees on examination of Secretary-Treas- urer's accounts. BOROUGH COMMITTEES. Sec. 35. All Borough Committees shall consist of at least two delegates from each Local Union. All delegates to the Borough Committee shall be elected in the same manner and for the same space Hi of time as the officers of the Local Union. Ail Borough Committees shall meet at least once every two weeks. Sec. 36. The Borough Committee shall have jurisdiction over all matters appertaining to their respective boroughs. All business within the or- ganization must be submitted to the Borough Com- mittee in writing. The order of business for the District Council shall be the order of business for all Borough Committees. A quorum shall consist of a majority of all delegates, meeting to be called to order at 8 P. M. and adjourn not later than n P. M., except by a majority vote of the delegates present to extend the times. Rules for calling a special meeting shall be adopted by the respective Borough Committees. Sec. 37. The officers of the Borough Committee shall consist of a President, Vice-President, Secre- tary, Treasurer, Warden, and Board of three Trus- tees, all of whom shall be elected semi-annually bv ballot, election to be held the first meeting in Jan- uary and July, and the old Borough Committee to adjourn sine die immedately after reading of minutes of previous meeting, presentation and payment of bills, and report on examination of Treasurer's ac- counts by the Board of Trustees. There shall also be a Borough Court, consisting of one Judge and two Associates, one Prosecuting Attorney and one Clerk, who shall be the Secretary of the Borough Committee, he to have voice but no vote. There shall be a Strike Committee of three for the management of strikes in each borough. Sec. 38. The President shall preside at all meet- ings of the Borough Committee. He shall also pre- side at all special meetings called or held by the Borough Committee and shall decide all questions 17 of order, subject to an appeal to the Borough Com- mittee. The President shall appoint all committees that may be necessary, unless otherwise ordered by the Borough Committee. Sec. 39. The Vice-President shall assist the Pres- ident in the discharge of his official duties and fill his place in case of absence, death or removal. Sec. 40. The duties of the Secretary shall be to keep a correct record of the proceedings of the Bor- ough Committee and attest all money orders to the Treasurer. He shall make a record of all orders drawn and for what purpose on his minutes; he shall keep a list of all standing and special commit- tees, with the addresses of the members. He shall furnish chairmen of all committees with a copy of resolutions adopted applicable to their respective duties or documents referred to them. He shall keep a list of the names and addresses of all the delegates who represent the Borough Committee and notify any Local of the absence of their dele- gate for two consecutive regular meetings, and notify all delegates of special meetings in sealed envelopes, at least twenty-four hours previous to said meeting. He shall send a copy of the proceed- ings of each meeting of the Borough Committee to the Secretary-Treasurer of the District Council and send a list of officers of the Borough Committee to the District Council, and he shall at the expiration of his term turn everything in his possession be- longing to the Borough Committee over to his successor. His salary shall be regulated by the Borough Committee. He shall also act as Clerk of Court and conduct official correspondence. He alone shall have charge of the seal. Sec. 41. The Treasurer shall safely guard all money. He shall keep an accurate account of all the IS financial business of the Borough Committee, re- ceive all payments from Local Unions, giving proper receipts therefor, notify Locals when two months in arrears and shall receive from Business Agents all money collected by them. He shall pay all orders drawn on him properly signed by the President and Secretary and no others. He shall report every month a list of unclaimed initiation fees received by him, giving the name, number and Local Union to which candidates are assigned. He shall deposit in a bank all money over $200. No money to be drawn from the bank unless on an order signed by the President, Secretary and Chair- man of the Board of Trustees with the seal attached. His salary shall be regulated by the Borough Com- mittee and he shall give bond to the extent of one thousand dollars. Sec. 42. The Warden shall have charge of the door and admit all members of the United Brother- hood upon receiving the current pass word from them, and such other duties as he may be called upon to perform subject to the order of the presid- ing officer. Sec. 43. The Board of Trustees shall be responsi- ble for all the property, and shall have the super- vision of funds and property, subject to such instruc- tions as they may receive from the Borough Com- mittee. It shall be their duty to see that the Treas- urer deposits in such bank as the Borough Com- mittee shall decide all moneys over and above such sum as the Borough Committee may decide shall be left in his hands for contingent expenses or legal bills, instructing the officers of the banK to pay no money on account of the Borough Committee ex- cept on an order sined by the President, Secretary and Chairman of the Board of Trustees, and stamped 19 with the seal of the Borough Committee. They shall examine the accounts of the Treasurer the first meeting night of each month, and see that it is correct, and shall prepare and execute the bonds of the Treasurer, and shall audit the books and accounis of the Treasurer, next meeting after the report of the Treasurer, each quarter, and make a 'vritten report of their audit to the Borough Com- littee at the next meeting, and at each regular .neeting examine the receipt books of the Business Agents, and see that the amount collected by them is turned over to the Treasurer and perform such other duties as are prescribed in these laws, or that the Borough Committee may direct. They shall receive such compensation as the Borough Committee may decide. DUTIES OF BOROUGH COURT. Sec. 44. All charges of any violation of the work- ing or trade rules of this district must be presented to the Borough Committee in writing- specifying the section so violated, and be signed by the member making the charges: specifications and the names of witnesses must accompany all charges. Said charges and specifications shall be referred by the Borough Committee to the Borough Court. Sec. 45. On the presentation of any charge the Borough Court shall forward to the accused a copy of the charges and specifications, and notify him to appear with all witnesses, and Clerk of said Court shall give defendant one week's notice of date of trial. If the accused neglect or refuse to stand trial, he shall be adjudged guilty of the charges preferred against him. Any witness, notified by the Clerk of said Court, who fails to appear and testify, shall 20 A held in contempt, and shall be fined not less than one t.Si) dollar or more than ten 'Sic' 1 io'.'.ars for each offense. DUTIES OF CLERK OF BOROUGH COURT. Sec. 46. The Clerk shall attend ail meetings of the Borough Court and take all evidence in writing, and shall, when said Court has come to a decision, furnish the Borough Committee at its next regular meeting with a copy of their findings on each :.ase presented to them: said report to be signed by at least two judges of the Borough Crurt. The Clerk shall also write and send all no- tices and summonses to witnesses, and notify plain- tiff and defendant of the date and place :: :r . ar.i perform such other duties as may be required of him by the Borough Court, and his sa'.arv shah be Regulated by the Borough Committee. The Clerk shall have no vote in the findings of said Court The Prosecuting Attorney shall atter. i ah meet- ings cf the Borough Court and ::he:t aui present all evidence and prosecute all charges, in behalf of the organization, referred from the Borough Committee to said Court. He shall have no vote on the finding of said Court. STRIKE COMMITTEES. Sec. 47. Their duties shall consist of signing all strike certificates issued by Business Agents: keep a correct record of all strikes, their tause. duration and result: amount of money expended on each strike. They shall act with Business Agents as pre- scribed in these laws. They shall have power to order all members at work on a job or shop to appear before them, discipline said members iff found a necessary and shall have authority to impose fines, subject to the approval of Borough Committee and aH laws relating to appeals. This and all other committees shall receive such compensation as the Borough Committee may decide. Sec. 48. Any delegate to the Borough Committee absenting himself two consecutive meetings, without reasonable excuse, or refusing to serve on at least one committee, his seat shall be declared vacant and his Local shall be notified to send another delegate in his place. Any member failing to come to order promptly at the request of the chairman shall be fined or suspended from the committee for any period that the Borough Committee shall decide. Any delegate to the Borough Committee having unpaid fines against his name shall forfeit his rights as delegate until such fine is paid. TRADE RULES. Sec. 49. Eight hours shall constitute a day's work. Working hours shall be between 8 A. M. and 5 P. M., except on Saturday. No work under any conditions is to be executed on Saturday between the hours of 12 o'clock noon and 5 P. M. All work performed on legal holidays. Sundays or other hours than those specified above shall be paid for as double time. Legal holidays are New Years, Lincoln and Washington's birthdays. Memorial Day, Independence Day. Labor Day. Election Day. Thanksgiving Day, Christmas and any day declared a legal holiday by the President of the United States or Governor of the State of New York. No work under any condition shall be performed on Labor Day. Any holiday falling on Sunday to be observed tin- following Monday. Sec. 50. The minimum rate of wages per day in this district for outside men is as follows: Manhattan Borough, $4.50. Kings Borough, $4. Bronx Borough, $4. Queens Borough, $3.50. Richmond Borough, $3.60. For inside or shoo men: Manhattan Borough, $20.75 per week. Kings Borough, $18 per week. Bronx Borough, $18 per week. Queens Borough, $18 per week. Richmond Borough, $18 per week. All existing laws governing the wages in shops of the different boroughs are not to be affected by these laws, and the present rate of wages are to be maintained even in the event of the shop moving into another borough. Sec. 51. All members of this district shall be paid every Saturday on the job or in the shop on or before 12 o'clock M., or they shall take sufficient time in the regular workday to go to the shop or Office to receive their pay. Sec. 52. All carpenters working on jobs outside when required to call at shop in the morning for lumber or any material, making mitre boxes, saw- benches, filing saws or sharpening tools, must strict- ly observe the above mentioned eight hours, com- mencing at 8 A. M., under penalty of $1 for each offense. Journeymen carpenters when required to leave the city to work for a city employer shall work eight hours, receive the standard rate of wages of this district and expenses. Violation of the latter portion of this section shall subject the member to fine of not less than $5. 23 Sec. S3- Any member who docs an unreasonable amount of work or who acts as a leader for his employer for the purpose of getting all the work possible out of the men working in the same shop or job with him, shall be fined for first offense $10; for second offense he shall be suspended or expelled and no member shall work for an employer known as a "lumper." Sec. 54. Only one apprentice shall be allowed to ten men, and the age of such apprentice at begin- ning of apprenticeship shall not be over eighteen years. Whenever an employer wishes an appren- tice, a written agreement about the terms and con- ditions must be entered into by the employer and apprentice, and submitted to the Borough Com- mittee for ratification. Local Union can initiate applicants as improvers, but must keep an exact date of their initiation and in no case can said im- prover work over two years as such, after which if he remains a member he must be capable of de- manding the minimum rate of wages. Only one improver will be allowed to every ten journeymen. Sec. 55. Members called out on strike must sign the strike book at Borough Committee's headquar- ters during working hours at least once a day, whereupon Business Agent will furnish them with strike certificates stating number of days out; said certificate to be presented by the member to the Local Union of which he is a member for payment. Any member in good standing who is called out on strike by the Business Agent, shall be paid one dollar a day for time lost, and in no case shall a member be paid unless strike lasts over three days, in which case he shall be paid from the commence- ment of the strike; no fractional part of a day shall 24 be paid, and no strike pay shall be paid to members belonging to Locals not represented in this Council. All strike certificates are to be redeemed by the Local Unions at the District Council. Sec. 56. Any member paying back any part of his wages shall, upon conviction thereof, be fined not less than ten dollars and suspended from his shop or job for the first offense, and expelled from the United Brotherhood for the second. Sec. 57. No member of this organization shall furnish either benches, clamps or hand screws for his work. Any member moving benches, etc. (as above), into or out of any shop shall be fined not less than $25 for the first offense, for the second not less than $25 or expelled. It shall be the duty of every shop delegate or any other member of the organization having knowledge of any member vio- lating this section to notify the Business Agent in writing at once, and failing to do so, said member shall be fined $5. Sec. 58. Any foreman hiring laborers to do car- penter work or permitting any other than a Union Carpenter to do any work involving the use of car- penters' tools, or allowing them to do any cutting, bracing, etc., on buildings or in shops, shall for the first offense be fined $10, and for the second offense he shall not have the right to act as foreman for the term of one year, nor shall . members of this district be allowed to work under a non-union foreman. Sec. 59. Any member making a false statement in regard to wages, hours or trade rules of this district shall upon conviction thereof be fined not less than $10 or be suspended from the United Brotherhood, as may be determined. All charges of 25 violation of any of the trade rules of this district shall be tried by the Borough Court. Sec. 60. The first man starting to work on a job or in a shop shall act as job steward, when three or more men are employed on the job, they shall hold job meetings periodically (not less than once a month or oftener if necessary), for the purpose of electing said steward. Each member in his turn must be selected as steward, providing he is a mem- ber of a Local Union represented in this District Council. It shall be the duty of said Steward to examine the cards of all men starting to work, and report to the Business Agent any irregularity; on large jobs requiring it, more stewards may be ap- pointed. Sec. 61. The Steward shall have power to ex- amine the pay of all members on the job, and if a Steward should be victimized for attending his duties the Borough Committee shall investigate the case and take such steps as they find proper. If any Steward should be laid off during his term of service as such, the members remaining on the job shall immediately fill the vacancy. The first Steward on every job shall notify the Business Agent in writing of the location of said job. No member will be per- mitted to work with any carpenter not in possession of a current quarterly working card without imme- diately notifying the Business Agent; failing to do so, he shall be fined the sum of one dollar. Sec. 62. Members of Locals other than delegates may be admitted to the meetings of the Borough Committee by giving the current pass word, except when any Local stands suspended. Sec. 63. Each Local shall pay to the Borough Committee a per capita tax of five cents per mouth 215 for each member in good standing, semi-beneficial members included. Borough Committees shall have power to levy an additional assessment if the occasion requires. Anv Local Union two months in arrears to the Borough Committee shall be suspended. Sec. 64. All Locals shall pay delegates to the Borough Committee the sum of not less than fifty cents for attendance at each meeting other than working hours. Sec. 65. The Financial Secretary of each Local Union shall immediately after the first meeting in each month send a list of suspended and new mem- bers and the number of members in good standing for the preceding month to the Secretary-Treasurer of the District Council and Secretary of the Bor- ough Committee. Any Financial Secretary not complying with this rule shall be fined the sum of one dollar, fine to be paid into body where offense has been committed. Sec. 66. All members shall be notified by mail to attend all meetings where special business is about to be transacted. Any member failing to attend such special meeting when properly notified by the Recording Secretary shall be fined not less than twenty-five cents, unless excused by the Local Union. Sec. 67. A suitable stamp or punch shall be pro- cured for the Board of Trustees to stamp due cards, which shall be deposited by all members at first meeting of each quarter, for comparison with the books. Any member failing to leave his card shall be fined $1. Sec. 68. Any person failing to present himself for initiation on a Business Agent's receipt, within 27 the space of fifteen days shall, unless the time is extended by the Local Union, forfeit his initiation fee. Sec. 69. Any member having a claim against a Local and not claiming it in six months, the claim shall be null and void. LABEL. Manufacturers of trim or any other de- scription of woodwork, who employ members of our organization and sign an agreement to live up to the Trade Rules of the Greater New York and Vi- cinity District Council, shall be entitled to have the Union Label applied to their product before leaving the factory. Sec. 71. Every Label must bear the factory num- ber stamped thereon. Whenever a Label is applied without the factory number thereon, it shall be re- garded as forged. Sec. 72. Every Union shop or factory shall have a delegate. Said shop delegate shall be the author- ized person to apply the Label, if said shop or fac- tory is complying with our Trade Rules. The shop meeting shall be held at least once a month and shall elect said delegate. Every one working in said 28 shop shall do delegate duty for one month; the member working there longest preceding, all others to follow in rotation. Sec. 73. The Borough Committee shall elect a Label Committee who shall meet at least once every two weeks, and all shop delegates shall be requi r ed to report to said committee the conditions of their shop, receive labels from same, account for their use, and shall be responsible for the proper dis- charge of their duty to said committee. The com- mittee shall be responsible for the use of the label and the conditions of the shops, where same is applied. It shall be the duty of the Secretary of said committee to keep a correct and accurate ac- count of all the labels printed, their numbers and the shops to which they have been issued, and to furnish such other information regarding the use of this label as may be called for by the Borough Committee. Sec. 74. In case of any grievances or violation of agreement by the employer the Label Committee shall have the power to withdraw the Union Label from such employer. It shall have power to make agreements with employers and to supply shop dele- gates with labels, subject to the approval of the Borough Committee. Sec. 75. Shop Delegates, failing to report to the Label Committee, shall be fined 50 cents for each offense. . Sec. 76. For misuse of the Union Label the shop delegate shall be fined $25.00 for the first offense. For the second he shall be expelled. Sec. 77. The Committee shall make a quarterly report of its work in writing to the Borough Com- mitee and report at any other time to said body when called upon to do so. 29 Sec. 78. Any member of this United Brother- hood, who is required to put up material not bear- ing this Union Label, shall forthwith report the facts to the Business Agent in writing; failing to do so he shall be fined. ALTERATIONS OR AMENDMENTS. Sec. 79. Any alteration or amendments to the foregoing laws must be submitted by some Local Union to the Borough Committee who shall pre- sent them to the District Council, and they, upon receipt of same, must submit them to the Local Unions for a vote. Sec. 80. All by-laws heretofore adopted for the government of District Councils in Greater New York are hereby repealed. 30 Rules of Order, RULE I. DEBATE ON COMMUNICATIONS. (a) The Chairman shall dispose of all communi- cations, subject to approval of the House; communi- cations requiring action to be referred to Unfinished Business, and shall not be debateable on first reading, except on motion to suspend the regular order of business. (b) The Chairman may allow a few explanatory remarks on a communication by the representative in- terested, but under no consideration shall debate be allowed to ensue, until a motion is put before the House. RULE II. ORDINARY OR LIMITED DEBATE. (a) When a motion is placed before the House, the Brother who made same shall give his reasons for so doing. If a debate ensues, the chairman shall keep same under control and within proper and rea- sonable bounds. If the debate becomes general or prolonged he shall allow no Brother to speak more than once, and for not more than ten minutes. (b) The maker of the motion shall— after the Chairman has ascertained if all have spoken who wish — be allowed to make the final remarks, said re- marks to close the debate, and the Chairman shall 31 forthwith put the motion to a vote. But should the maker of the motion, after having made his explana- tory remarks, again demand the privilege of the floor while debate is in progress, he shall forfeit his right to make final remarks. (c) Should circumstances warrant it, a Brother may be allowed to speak twice, but not oftener, and on second occasion may be limited by the Chairman. RULE III. UNLIMITED DEBATE. A motion to suspend the foregoing rules on debate shall always be in order (except when the mover of a motion has already been granted privilege of mak- ing final remarks), but shall require a two-thirds vote.
