DEPOSITS of one dollar and upward, not exceeding the sum of three thousand dollars, shall be received, but this limi- tation shall not apply to deposits arising from judicial sales or trust funds. Each depositor, on making his or her first deposit, shall be required to subscribe his or her assent and agreement to be governed by the by-laws and regulations of the institu- tion, and shall give his or her age, place of nativity, residence, occupation, the name of his or her employer, and such other information as may be required. All deposits shall be regularly entered in the books of the Bank, and also in the book to be furnished to the depositor, which shall be kept by him or her as a voucher for his or her deposits. All moneys received by this institution shall be in specie or in bills taken in deposit by the incorporated banks in the city of New York, and all payments shall be made in the same manner. The trustees shall be at liberty to return, in whole or in part, the amount at the credit of any depositor, whenever they may think proper. Drafts may be made personally, or by the order in writing of the depositor (if the Bank have the signature of the party on their signature-book,) or by letters of attorney duly authenti- cated; but no person shall have the right to demand any part of his or her principal or interest, without producing his or her Bank-Book, that such payment may be entered therein. The Bank shall not be liable to pay any moneys to depositors except on three months' previous notice in writing to the Cashier or attending Committee at the Bank; but moneys may be volun- tarily paid by the Bank daily, and without such notice, and with- out thereby waiving the right of the Bank to such notice and 4 time of payment. No draft shall be made without the permis- sion of the Cashier, for less than one dollar, nor for f^ctionar parts of a dollar, unless it be for the whole amount rqpiaining# on deposit, or for interest only. ^* ^ * All payments made to persons producing the^ d#p^^t bgoks, ' whether with or without an order or letter of att^rney^ purport- ing to be signed by the depositor, shall be deemed g^o^%nd valid payments to depositors respectively, and discharge the Bank therefrom. Depositors alone are responsible for the safe keeping of their books, and the proper withdrawal of money. No with- drawal will be allowed without the book, and the book is the order of withdrawal. In case of the loss or destruction of the pass-book, a new book can only be issued after the public has been notified by an advertisement, published in such daily newspaper, and for such length of time as the President may direct, calling upon any person having a claim to the missing book to present the same to the Bank, or submit to having the pass-book declared canceled and extinguished, and a new book issued in lieu there- of. Before publishing such notice, the depositor, or his or her legal representative, shall file with the Bank a satisfactory affi- davit, showing the loss or destruction of the book. All accounts to which no deposit and on which no draft shall have been made for twenty years in succession, shall be closed; nor shall the amount deposited, nor the interest that has accrued thereon, draw any interest thereafter. All notices in relation to deposits or depositors, published by or under the direction of the Trustees in one or more of the public newspapers of the City of Brooklyn, six days successively, shall be deemed and taken as actual notice to each depositor. On the third Monday of January and July of every year, there shall be paid such interest as by decision of the Trustees the profits of the institution will allow, on all sums of three dollars and upward, which shall have been deposited for three months previous to the ist day of January or July; but no interest shall be paid on the fractional parts of a dollar, nor shall any interest be allowed on any sum withdrawn previous to the ist day of January or July, for the period which may have elapsed since the last dividend. The interest accrued and entered to the credit of depositors on the 1st day of January or July, shall be added to the principal from those dates respectively, the same as an original deposit. Deposits made on or before the ist business day of January, and remaining in bank on the ist day of July, will be entitled to G months' interest. Deposits made on or before the ist business day of April, and remaining in Bank on the first day of July, will be entitled to 3 mon' hs' interest.
