Sir : In obedience to tlie resolution of tlic House of Representatives, of the 26tli of February last, referring to this Department the memo- rial of the Mayor and City Council of Baltimore, claiming allowance and j)ay for advances of money and supplies furnislied. during llic late war, in defence of tiiat city and the country adjacent. I have the iionor to transmit, herewith, a letter from the Third Auditor, dated ;he 27th of March, accompanied by an explanatory statement, marked A. This statement particularly sets forth the items, constituting, in the wliole, the sum of fifteen thousand one hundred and iiftj -nine dollars nine cents, heretofore suspended or disallowed on the setllement of the above claim under the direction of the Secretary of War, with the ,' ■i' i-easons for such disallowance or suspen-sion. Tlie claim rests upon services highly meritorious, the good effects of which were felt by the nation ; and a large portion of tlie rejected items appears to lia\ e been thrown out, not from any objection to their equity, but from the fixed rules and limited powers under which the Executive and accounting officers are obliged to act in the settlement of the public accounts. From tliese rules they ditl not feel at liberty to swerve, even in such a case as the present. The want of vouchers formed the objection upon which the disallowance of other items rested : all which is fully- explained in the document above mentioned. The efforts of tiie me- morialists were identified with the common cause of the country at a season of difficulty and peril, and it follows, from the letter and state- ment of the Third Auditor, that they cannot receive adequate indemni- fication for tlie expenditures which those efforts involved, (and they ask notliing beyond indemnification) but through Congress. No. 39.3 To the Senate and House of Representatives of the United States : The memorial of the Major and City Council of Baltimore, Respectfully REruESENTs : That, some years ago, your memorialists preferred a claim against the United States for a large sum of money expended by them in the defence of tlicir country, in the late war with Great Britain, and they exhibited various documents, which are now filed in the office of the Third Auditor, showing tliat tliey were compelled to borrow, for that purpose, and did borrow and pay the rcgulai- bank interest until 1818, when the debt was funded in city six per cent, stock, the sum of seventy-five thousand dollars. No. 89.] 35 There was a very large quantity of gunpowder in the city Maga- zine, which might have been fired by bombs, or malicious persons. An accident to it would have been attended with fatal consequences, independent of its loss at that time. I deemed it. therefore, indis- pensably necessary to remove it to a public Magazine, at Towson's, seven miles from the city. Its lemoval, the necessary repairs to make the Magazine secure, attendance of the keeper when it was delivered, and a superintendent to take charge of it at Towson's, were all charges that could not be avoided. The measure was pre- cautionary, and obviously necessary : and I trust the charges will be allowed, to wit : to the amount of eight hundred and twenty-four dollars and two cents. S. When relieved, he delivered it to Majoi- Jackson, who, no doubt, de- livered it to his successor.
