Few persons are aware of, and will scarcely credit, the enor- mous amount of money, and other property lying unclaimed in Great Britain and her colonies. This amount, which, without ex- aggeration, may be calculated by millions, will at first sight prob- ably appear almost incredible, but a few facts will prove that such is the case. In the Court of Chancery, in the possession of the Accountant General, the amount alone is more than five millions of Pounds sterling. (£5,000,000.) In the Treasury, the amount taken possession of by the crown, also amounts to many millions of Pounds sterling. And although advertisements have been inserted in the public papers for the proper claimants, this money has been principally left by persons who have died intestate. With regard to the money in the Bank of England, the fol- lowing extract from the London Times will speak for itself, viz: "The unclaimed dividends handed over to the Commissioners, and by them invested in the public funds, amounted, in the year 1863, to no less than £2,879,975, Sterling, Stock. " There is also in the hands of the Commissioners, more than half a million stock, on which no dividend has been claimed for many years. Here alone we have nearly three millions and a half Pounds Sterling, unclaimed by parties interested, many of them, probably, being unaware that they are entitled to any portion of this large sum. In India, there is a large amount of unclaimed money; which has been left by persons who have died there within the last sixty years " recoverable on proof of relationship. Anotner item of unclaimed property is the ' ' Army and Navy Prize Money, " which amounted, on the 31st of December, 1862, to £1,235,840 Sterling, and which is in fact due to the widows and orphans or legal representatives of the officers and soldiers present at the capture of Java, in the year 1811. In Australia, and the other colonies" there are also large sums of money, unclaimed at present, which have been left by British, American and other subjects, who have died intestate within the last thirty years. Many millions are in possession of the government, both real and personal estate, which have escheated to the Crown for the want of heirs at law, to claim them. These can now, in most cases, be recovered by persons legally entitled on producing proper proofs of relationship, though some of the property may have been in possession of the crown for 100 years. Many persons ask, why should unclaimed estates be more common in England than in America ? This country, as is well known, was settled principally by persons from England, Scotland and Ireland ; so imperfect have been the means of communication between America and Europe, that thousands who came here, never heard from their relatives after they emigrated. Consider how many hundreds of emigrants leave England, and how many old branches of families have died out there, leaving large sums of money by will or otherwise in trust, to their friends or relatives in America. In very many cases the persons entitled have never heard of such property being left them, and others have heard of it, but not having the means here, or disposition to attend to their claims; consequently, large sums of money, and other property, now remain unclaimedinEngland,belonging to persons in America. Unclaimed Money and Property Eegistry, AND OFFICE FOR THE PROSECUTION AND RECOVERY OF CLAIMS IN AMERICA, GREAT BRITAIN AND OTHER PARTS OF THE WORLD, By JOHN P. JAYNE, Attorney and Solicitor, No. 7 MURRAY STREET, NEW YORK. The undersigned has been successfully engaged in the prose- cution of claims in the United States and England for many years, and having recently returned from London, where he has visited all the departments where the Records of Unclaimed Property are to be found, and there examined several hundred cases in the Court of Chancery and other Courts of Record in England, and having also made researches of the Records • in Edinburgh and Glasgow, Scotland, Dublin and Waterford, Ireland, and in France and Germany, is now able to give some reliable information in many cases of unclaimed money and property from his personal knowledge. The undersigned has correspondents in all parts of the Globe through whom information can be obtained relative to money or property. The London Times and other papers taken by him daily and received by every mail steamer, so that no cases advertised in England can escape his notice. He has made arrangements with an American lawyer, now residing in London, an attorney o± integrity, good reputation, ability and means, to assist him in the prosecu- tion of cases in England. He intends for the present to remain inAmerica, in order to obtain cases from persons who are entitled to property, and to collect and prepare evidence of the cases, from the claimants, and forward them to England from time to time; but should a sufficient number of good cases come forward from American claimants to warrant his services in London, he will at once proceed to England and have the cases disposed of in Chancery and other Courts in England. He is also prepared to furnish any reference as to his character and integrity, that claim- ants may desire . The undersigned would further inform those who believe they are entitled to property in England or in other parts of the globe, that he has the largest collection of information, relative to un- claimed money or property to be found either in Europe or Ameri- ca, That while in London, he procured the official record reports 4 of the Bank of England and Unclaimed dividend cases of the Court of Chancery embracing all orders and decrees of said Court and other Courts of England. He has also procured all the Index Registers that have ever been published in Europe, and upwards of 20,000 Heir-at-law, and Next of Kin advertisements from the London Times, Gazette, and other English papers, of which a large portion call for persons in America. To facilitate the aoove object, the undersigned has, et great expense and trouble, brought together a Register of Chancery heirs, Next of Kin, Legatees and persons wanted from the year 1760, down to 1869, comprising nearly 35,000 names; also registers of the official notices of intestate and unclaimed estates of American and British subjects dying in India, Australia, New Zealand and other parts of the world; together with the largest library of works of reference in the United States, calculated to assist in tracing out persons and property in America and England. The undersigned would respectfully call the attention of the reader to the fact, that the principal part of the names in this book have been purposely selected for the reason that they call for a party or parties in America entitled to money or property in Eng- land, and he will now undertake the prosecution of claims for the recovery of property in England for persons in America on the most favorable terms. * Claims, and Cases, investigated at this office on the most reasonable terms. The following letter is republished, for the purpose of explain- ing the law relative to Aliens. Annexed to this letter will be found several precedents of cases to show that property can be recovered in England. From The Solicitors' Journal & Beporter, London, England, August 28th 1869. ' ' English Estates and Ameeican Hetes. " Sir, — In answer to a letter written by Mr. J. P. Benjamin, and published in your Journal of this date, please publish the following: Numerous applications have been made to me with reference to Mr. Benjamin's letter upon American heirs to English estates, which was published in the papers throughout the United States; and it may be a matter of public interest to write the recent statute regu- lations that refer to the rights of aliens. They will be found in all cases to give one quite different notions of the law from those un- practically conveyed by Mr. Benjamin. 1 ' In the first place, by the express provisions of 7 and 8 Vict, c. 66, s. 4. an alien may now take and hold every species of per- sonal property, except chattels real, as fully as if he were a natural born subject, including those acquired by testatmentary disposi- tions. He may be an executor or administrator, and, as to per- sonal property, "may be a trustee like anybody else." It thus appears that the incapacity of aliens now consists in three things. 1. They are incapable of any political rights, including that of holding any office of trust, or becoming a member of the Privy Council, or of Parliament. 2. They cannot hold landed estate except for a term not exceeding twenty-one years. 3. They cannot own British ships. Secondly, there are also in the same statute, regulations by which an alien may become entitled to all the rights and capacities of a natural born subject, except the capacities before ramed. Thirdly, by force of an earlier statute (11 & 12 "Will. 3, c. 6, s. 6) all persons (including naturalised aliens) may inherit and make their titles by descent from any of their ancestors (lineal or collate- ral), although their father or mother, or other ancestors, by, from, through, or under whom they derive their pedigrees, were born out of the British realm. It is true that real estate devolves upon the eldest son, and upon his eldest son in succession, and is not divided in shares among all the children. Such is the law of primogeniture, and hardly a person living but understands it; but Mr. Benjamin ap- plies the same principle of law to estates generally, and thus lends the weight of his authority to false doctrine. Real estate does not escheat to the Crown upon the extinction of one branch of a family, but the heir-at-law is to be found in the next living branch. And with regard to the estates claimed by Americans, for the most part, they belong to the next of kin. Bank stocks in Bank of England, and funds in the possession of the Accountant-Gen- eral of the Court of Chancery, or otherwise held in trust, have very frequently been distributed among parties now residing in the United States of America. During the short period of my residence in London I have become acquainted with the facts in many cases which is sufficient authority. In the Times for June 12th, 1869, there is a report of the Shard case, Partington v. Attorney- General, House of Lords, which involved £50,000 sterling, all of which was distributed among the next of kin in America. In the Court of Chancery there is a suit now pending, con- cerning property left by John Harrison, of Liverpool, during the eighteenth century. That property will unquestionably be paid over to parties residing in New Bedford, Mass. , America. Other suits in the Court of Chancery reveal properties that are in the process of recovery by the next of kin residing in America. It will be remembered that whenever a decree has been made by the Court of Chancery in favor of an alien concerning real es- tate, a petition of right to the House of Lords or Parliament for the sale of such real estate, has never failed to secure an alien his desired rights in the premises. And I think it will be found in all cases that, however correct in theory, as learned from the old au- thorities, Mr. Benjamin has taken an impracticable view of the subject, and conveys erroneous impressions of the law. English barristers and other lawyers have said so much that I feel authorised in attempting to explain the subject to the parties interested in estates in England. In regard to those humbugs and swindlers who pretend to have found large estates and fortunes, and who, by false statements, made for the purpose of defrauding, no doubt have duped many persons out of large sums of money. I agree with Mr. Benjamin that this class of persons should be exposed and broken up, and put down, that honest professionals may live. John P. Jayne. London, August 21st, 1869. Precedents of Cases Recovered. In 1858, an estate of over Fifty Thousand Pounds was recovered from the Crown (which had been left by Frances Mary Shard, of Torbay, County of Devon, England;, for the descendant^ of one George Davis, a second cousin of the intestate, who came to America in 1742. You will readily see that the pedigree proved in this case was a very old one. A property in England was willed by a Richard Yerbury in 1754. Of this property, persons of the name of Goldsboroughs, on the eastern shore of Maryland, recovered $24,000 in 1863. A property left in England in 1742, to William and Mary's College, of Vir- ginia; in 1868, $8000 of this was recovered. The estate of John Lawrence, who died in 1814; Sixteen Thousand Pounds was recovered for his next of kin, in America, in 1863. The estate of the Rev. Win. Townley; Seventy-three Thousand Pounds was recovered from the Crown, for his next of kin, a shoemaker, in 1853. Tho estate left by John Harrison, of Liverpool, who died in 1807: this property will be recovered within s'"x months, and paid to the heirs, D. R. Green and J. H. Green, of New Bedford, Mass. I could enumerate many other similar estates recovered by American citizens, from England, but this is enough to show that some old estates are recoverable. \ Instructions to Claimants. ENCLOSE LETTER STAMP TO PAY RETURN POSTAGE. Give the name of the person and date of death, who was last in possession of the property you claim in England or abroad, and if you claim as a lineal descendant from such last possessor, trace the pedigree from such person to yourself as far as you are able . If you claim as a collateral descendant from such last possessor, trace the whole family pedigree from a common ancestor from whom both yourself and such last possessor have descended. If you claim under a will,trace to yourself the whole family pedigree from the devisee or legatee. In tracing pedigrees,mention the names of all persons descended from such last possessor, common ancestor, devisee or legatee, giving the names of all persons who have married into such family, with the date and place of each birth, marriage, death or funeral. Give the name of the place where each marriage and death took place. Mention the date and the name of the place of your own and your ances- tor's departure from Europe,the name of the vessel in which the voyage was made, and the place of landing, with place of settlement. State particularly the locality of the property claimed, when and how you first heard of your claim, with the means of information and character of your informant. State what records are contained in your Family Bible, what tombstones relating to your family, and contents of old family letters and other old papers in your possession. Give every fact or tradition relating in any way to your claim. State what steps have been taken, if any, to recover the property claimed, with names of persons employed, and their reports relative to the same. Any person desiring one of Jayne's Index Books, can have one sent by forwarding their name and Post Office address plainly written. Any person may have a copy of the original Advertisement, relating to their case, together with such information as will determine whether he or she is the person wanted, by enclosing a fee of $2,00, and no charge for searching Index Registers ior the names of persons. Persons Wanted in America and Abroad. 3*1 I beg to inform the readers of my Index .Register, that the fore- going completes the list of unfinished Cases of this class, in the Court of Chancery, containing unclaimed stocks and dividends. This list was made up to April, 1860, by order of the Lord Chancellor and consists of all the causes, matters, and accounts that have not been dealt with since 1845. I find from personal examination of the Records last year, that many of these suits are as far back as 1778, and some as recent as 1840, and that these t Cases all seem to have money in them, sums from £1,000 to £30,000. The Index Kegister was the first to publish this list in the United States. I trust that the publication of it will be appreciated, when it is known that there are tens of thousands of pounds, remaining unclaimed in the various causes, that many of the unsettled estates of testators, intestates and lapsed Legacies have found their way into Chancery, and all of them easily recoverable by the Legal Representatives, or the proper Heirs, or Next of Kin of the parties to the suits. I beg to state that my space and the expense will not permit me to publish any of the particulars relative to these Cases, therefore any person who may desire information respecting these Cases is required to enclose a fee of one Dollar to JOHN P. The descendants of the last named person, John Sweetapple, have recovered their share of dividends £4, COO in the Court of Chan- cery last year, 1870, m London. About fiv * years ago, the descendants of Kathaniel Gifford, a member of this society, recovered their share in Chancery, about £40,000, in London. 38 Persons Wanted in America and Abroad. Tliis American Land Company was established in England, the money now standing in the names of the above eleven persons, only two eases having been settled, the^money is there, the descendants of the above named persons onTproving their pedigrees can recover the same. From records found, proves that\thedargest proportion of these descendants came to^America. I advise all persons of the name to look up the pedigrees of their ancestors. JOHN P. JAYNE. The Tontine Society of New York, in 1794, was a similar Land Company to that of that the West New Jersey, herein mentioned. The Tontine Society now being' reduced to seven surviving members, stockholders, viz : Maria Bayard, Mrs. Duncan, P. Camp- bell, Gouvernor Kemble, Mary Ray, Widow, William Bayard, Robert Benson, H. Gates Stevens, all aged persons, they or their descendants are very soon entitled to about £65,000. JOHN P. JAYNE. Precedents of Cases recovered last year, 1870. The descendants of John Sweetapple in 1870, recovered in Chancery, the dividends due them [in the West New Jersey Land Society, which was established in 1692, ££,000, and also £54,000 from the Shadwell Water Works, established 1694, through the Court of Chancery.
