Many interesting documents have been preserved of Consider Tif- fany (4), as well as traditional testimony. He was a member of the Church of England and had little patience with the dissenting sects. During the War of Independence, some time in the year 1778, Consider Tiffany was confined to his farm in the town of Hartland, Conn., on account of his outspoken Toryism. After a confinement of fifteen months, hearing that an effort was being made for his release, he addressed the following letter to the chairman of the committee showing his penitence and sorrow : Mr. Ensign : — I understand that the committee are about to re- lease me, being ashamed of their depriving me of that liberty they did 15 months ago. I can answer the pretended committee that I never did anything that I am sorry for, more than that I have done too much in favor of the United States against genuine reason and the dictates of con- science, and the unerring Scriptures, which error I am unfeignedly sorry for. I am, and always was, a sincere friend of America. But if I had the same opinion of the United States as I have of poor Hartland, I should think it my duty to do my utmost to have them subdued. Sir, I suppose there may be two reasons that induce the committee to release me without my asking them : The first, a guilty conscience for abusing me without a cause ; the second, to dismiss me so that I can be drafted. But, that be as it may, this I will as- sure you, and all men, that T never intend to go into the camps, and if I am forced thither, I inend to fight for that side that I think I ought to. I would further tell you that I retain the same principles that I had five years ago. Don't mean to hurt any man, and am contented to remain in my own business and happy in not seeing the face of my implacable enemies. — Therefore please so use your en- deavors that I remain happy as I now am, and you will oblige your old friend. The following year he went to Ohio, where he resumed the study of law at Medina, and was admitted to the bar in 1834. He later gave up his law practice to devote his time to religious mat- ters. In 186 — he went to Albany, N. Y., where he published, through W. C. Little, a work on "Trusts and Trustees." In 1863 he published "Practice Under the New York Code." He also di- gested the "New York Justices Court of Appeals Code," which was published. In 1866-67 he wrote a work on "Government and Con- stitutional Law" as applicable to the United States and to the sev- eral States. He was appointed by Gov. Fenton reporter to the Court of Appeals. During his three years' term of office he re- ported twelve volumes of Court of Appeals reports, known as "Tif- fany Records." Fayette B. Tiffany entered Amherst College in 1868, where he remained until almost the close of his sophomore year when he was compelled to leave his studies because of serious illness. He was engaged in the lumber business in Bristol, Conn., for some time, in 1878 he moved to Nebraska, where he studied law and was admitted to the bar at Brownville, Neb., in 1879. He began 36 the practice of law at Albion, Neb., in 1880, and met with much success in his profession. In November, 1881, he was elected county judge, and in March, 1883, he was appointed district judge by the Governor of Nebraska, to fill a vacancy. In November, 1883, he was electd to the same position for a full term of four years, and in 1887 was re-elected for another four-years' term. At the end of his second term he resumed the practice of law at Omaha, removing to Colorado Springs, Col., in 1891, where he has since practiced successfully.
