L., 511), established the bureau of in- . spection and supervision of public offices, prescribing and imposing certain duties, among the most important of which is to annually examine into all. the financial transactions of every county office and officer. It is provided that “On every such examination inquiry shall be made * * * * * whether the requirements of the constitution and statutory laws of the state * * * * * have been complied with, and into the methods and accuracy of their accounts.” It therefore becomes necessary, in order to secure exact uniformity in the findings of the several state examiners at work under the supervision of the bureau, to definitely construe the statutory laws fixing the fees of county officials and to make application thereof to the actual services rendered in the various county offices. Those familiar with the indefinite provisions of these laws will realize the difficulty of the task imposed and fully appreciate the fact, as do the members of the bureau, that honest differences of opinion as to the construction of said laws may reasonably exist. A casual examination of the fees received by the various officers of the different counties of the state for the performance of their official duties, is conclusive proof of the widely different interpretations placed upon these laws by the officials themselves, notwithstanding that each of- ‘ficer is equally sincere in his intention to charge only the legal fees due to his office. The bureau has conscientiously sought to know the true law as inter-. preted by the courts, and in all cases of doubt have referred the matter to the attorney general. The. principles of law governing the payment of fees and compen- sation to county officials from the county treasury, as defined by the courts, are expressed in the following excerpts from the State Reports: Commissioners of Butler County VS. 12 C.,C.,) 440. Welliver, Clerk. _ “Except by statute specifically provided, the clerk of court is not entitled to receive any compensation from the county treasury for any services rendered for the benefit of the county or the public however valu- able and necessary such services may be, although the law absolutely re- 4 FEES AND COMPENSATION. quires him to perform the same. If so required for the public, and no pro- vision is made for its payment from the treasury, it must be regarded as gratuitious.” This decision is in accord with that of the Supreme Court in Strawn vs. Commissioners—47 O. S., 408: “The fact that a duty is imposed upon a public officer will not be ° enough to charge the public with an obligation to pay for its. performance ; for the legislature may deem the duties imposed to be fully compensated by the privileges and other emoluments belonging to the office, or by fees per- mitted to be charged. and collected for service.” And in Jones vs. Commissioners—57 O. 8., 189. “That fees are not allowed upon an implication, and where the duty is enjoined and no compensation is allowed, the presumption is that the service is intended to be gratuitous, or that compensation for it is to be regarded as covered by fees in other matters, or by salary, or both.” Also, in Clark vs. Commissioners—58 O. §S., 107. “Tt is well settled that a public officer is not entitled to receive pay for services out of the public treasury, unless there is some statute authoriz- ing the same. Services performed for the public, where no provision is Made by statute for payment, are regarded as a gratuity, or as being com- pensated by the fees, privileges and emoluments accruing to such officer in the matters pertaining to his office.” As the courts have uniformly and consistently held that county officials cannot receive payment from the county treasury for performing services of a public nature except by specific authority of law, the official or tribunal authorized to allow such claims against the county should insist _ that itemized vouchers should be filed by the claimant, in every instance, giving the date of the service, the actual service rendered and the charge therefor, and a citation of the law authorizing the payment of such claims from the county treasury. The fact that a claim is presented is not con- clusive as to its legality, or the reasonableness of the charge, and all ¢ases of doubt as to the law should be referred to the proper legal adviser for | a written opinion, thereon that the responsibility may be Tee established by the state examiners in their annual examinations. The schedules presented by the bureau are for the guidance of the auditing officials and give citations (Bates’ Revised Statutes of Ohio sectional references,) to the laws requiring the service, authorizing payment from the county treasury, and fixing the rate of compensation; the nature of the service rendered; the fees or com pensation allowed; and explanatory notes as to the construction and application of the law as made herein.
