Whereas I have in and by my laid Will given fome directions about the fale and difpofition of my mufaeum, or collection of rarities herein more particularly mentioned : Now I do hereby revoke my faid Will as far as relates thereto, and I do direct and appoint concerning the fame in the following Manner. Having had from my youth a ftrong inclination to the ftudy of plants, and all other produc- tions of nature ; and having through the courfe of many years with great labour and expence, gathered together whatever could be procured eitner in B our [ 4 ] our own or foreign countries that was .rare and curious; and being fully con- vinced that nothing tends more to raife our ideas of the power, wifdom, good- nefs, providence, and other perfections of the Deity, or more to the comfort and well being of his creatures than the enlargement of our knowledge in the works of nature, I do Will and defire that for the promoting of thefe noble ends, the .glory of God, and the Good of man, my collection in all its branches may be, if poflible, kept and preferved together whole and intire in my manor houfe, in the pa- rifh of Chelfea, lituate near the phylic garden, given by me to the company of apothecaries for the fame purpofes; and having great reliance and confi- dence that the Right Hon. Hon. and other perfons hereafter named will be influenced by the fome principles, and faithfully and ccnfcientioufly difcharge the truft hereby repofed in them, I do give, devife and bequeath unto the Hon. But I mean all my library of books, draw- ings, manuferipts, prints, medals and coins, antient and modern, antiquities, feals, &c, cameas and intaglio’s, &c, [ 7 1 precious ftones, agates, jafpers, &c. veffels, &c. of agate, jafper, &c. chryftals, mathematical inftruments, drawings and pictures, and all other things ' in my faid collection or mu- feu m, which are more particularly de- fcribed, mentioned and numbered, with ihort hiftories or accounts of them, with proper references in cer- tain catalogues by me made, contain- ing thirty-eight volumes in folio,, and eight volumes in quarto, except fuch framed pictures as are not marked with the word (coll eft ion) to have and to hold to them and their fucceffors dr affigns for ever ; to the intent only that the fame and every part and par- cel of my faid collection or mufaeum may be veiled in the faid Right Ho- nourable and Honourable, and other perfons upon the trufts, and for the ufes and purpofes, and fubjeft to the feveral limitations and directions here- after particularly fpecified concerning the fame: and for the rendering this my intention more effectual, that the faid Col- [ 8 ] . . . le&ion may be preferred and con- tinued intire in its utmoft perfection and regularity ; and being allured that nothing will conduce more to this purpofe, than placing the fame under the direction and care of learned, ex- perienced and judicious perlons who are above all low and mean views, I do earneftly defire that the king, his royal highnefs the prince of Wales, his royal highnefs William duke of Cum- berland, the archbilhop of Canterbury for the time being, the right honour- able Philip lord Hardwick, and the lord high chancellor for the time be- ing ? the lord prelident of the council for the time being, the lord privy feal for the time being, the lord fteward of his majefty’s houfhold for the time be- ing, the lord chamberlain of his ma- jefty’s houfhold for the time being, his grace Charles duke of Richmond, his grace John duke of Montague, his grace Holies duke of Newcaftle, his grace John duke of Bedford, and the two principal fecretaries of ftat$ [ 9 ] (late for the time being ; the right honourable John earl of Sandwich, and the lord high admiral, or the firft lord commiflioner of the admiralty for the time being ; the right honourable Henry Pelham, Efq; and the lord high treafurer, or the firft lord commiffion- er of the treafury for the time being, and the chancellor of the exchequer for the time being, the lord chief juf- tice of the king’s bench for the time being, the lord chief juftice of the common pleas for the time being, the lord chief baron of the exchequer for the time being, the lord bifhop of London for the time being, the lord bifhop of Winchefter for the time be- ing, the right honourable Archibald duke of Argvle, the right honourable Henry earl of Pembroke, the right ho- nourable Philip earl of Chefterfiekl,the right honourable Richard earl of Bur- lington, the right honourable Henry lord Montford, the right honourable Ar- thur Onflow, Efq; andthefpeaker ofthe Houfe of Commons for the time being, the the honourable lord Charles Caveri- dilh, the right honourable Charles lord Cadogan, the right honourable John earl of Verney, and the right honour- able George lord Anfon, will conde- fcend fo far as to ad: and be viiitors of my laid mufaeum and colledion. And I do hereby, with their leave, nominate and appoint them viiitors thereof* with full power and authority for any live or more of them to enter my faid col- ledion or mufaeum at any time or times, to perule, fupervife and exa- mine the fame and the management thereof; and to vilit, corred and re- form from time to time as there may be occalion, either jointly with the faid truftees, or feparately, upon ap- plication to them for that purpofe, or otherwife, all abufes, defeds, negleds, or mifmanagements that may happen to arife therein, or touching or con- cerning the perfon or pexfons, officer or officers that are or lhall be appoint- ed to attend the fame. And my will is, and I do hereby requeft and delire, that [ 11 3 that the faid truftees, or any feven or more of them do make their humble application to his majefly or to parlia- ment, at the next feflions after my deceafe, as fhall be thought raoft pro- per, in order to pay the full and clear fum of twenty thoufand pounds of lawful money of Great-Britain, unto my executors or the furvivors of them, within twelve months after my deceafe, in conlideration of the faid collection or mufaeum : It not being, as I ap- prehend or believe, a fourth of their real and intrinfic value ; and alfo to obtain fuch fufficient and effectual powers and authorities, for vetting in the faid truftees all and every part of my faid collection or mufaeum before mentioned in all its branches; and alfo my faid capital manor houfe, with fuch gardens and out-houfes as fhall thereunto belong, and be ufed by me at the ‘time of my deceafe, in which it is my defire the fame fhall be kept and preferved ; and alfo the water of, or belonging to, my manor of Chelfea C com- [ I* ] Coming from Kenfington, fubject to furnifhing or fupplying the Lord Bifhop of Winchefter’s houfe as is now ufed ; and alfo all that the advowfon prefenta- tion or right of patronage of the church of Chelfea : To the end, the fame pre- miffes may be abfolutely vefted in the faid truftees, for the preferving and con- tinuing my faid coi lection or mufeum in fuch manner as they fhall think moft likely to anfwer the public benefit by me intended ; and alfo obtain as aforefaid, a fufficient fund or provifi- on, for maintaining and taking care of my faid collection and premifles, and for repairing and fupporting my faid manor houfe, water- work andpre- mifes, to be vefted in the faid truftees for ever : And I do hereby further di- rect and appoint, that my executors do and fhall, upon payment of the faid fum of twenty thoufand pounds, deliver or caufe to be delivered unto the faid truftees, or any feven or more of them, for, and in the name of all of them, in the prefence of the faid vifitors, or f '3 ] or any five or more of them, as well the poffeilion of my faid manor houfe and gardens at Chelfea aforefaid, as alfo all my collection or mufahim be- fore mentioned and defcribed, and every part thereof in all its branches, whole and intire, as the fame (hall be found in my faid manor houfe, ac- cording to the faid catalogues, and together with the feveral volumes of catalogues thereunto belonging. And further, my will is, and I do hereby alfo direCt and appoint, that in cafe his majefiy or the parliament do accept the faid offer, and do pay the faid fum of twenty thoufand pounds unto my executors or the furvivor of them, that then my faid executors do, within fix months after fuch payment as aforementioned, and obtaining proper powers for effectually veiling in the faid truftees all my faid Collection, and my faid capital houfe and gardens, with their appurtenances, water and advowfon, prefentation or right of patronage of the church of Chelfea as C 2 aiorefaid ; [ 14 ] aforefaid ; together with my heir or heirs at law, and all other proper parties, do and fhall join in and exe- cute fuch adts, deeds, or conveyances, as £hall be thcrught requifite and neceflary for the more perfect and abfolute vefting, conveying, and a {Tur- ing the faid premiffes in, and to the faid truftees and their ailigns or fuc- cefTors for ever, for the ufes, intents and purpofes herein mentioned and intended. And my Will is, and I do hereby impower and diredt, that the faid truftees, or any feven or more of them, do and fhall, in convenient time after payment of the faid fum of twenty thoufand pounds unto my faid execu- tors, or the furvivors of them as afore- faid, meet together from time to time, as often as ihall be thought lit, and there make, conftitute and eftablifh (to be afterwards ratifyed and approved by the vifttors hereby appointed, or any five or more of them) fuch ftatutes, rules, and ordinances, and to make and [ *5 ] and appoint fuch officers and fervants for the attending, managing, preferv- ing, and continuing of my faid mu- feum, or colledtion and premiffes, for ever, with fuch falaries, payments, or allowances to them refpedtively, as fhall feem meet and neceffary. And further, my Will is, and I do hereby order and diredt, that in cafe any difference or difpute ffiall happen to arife by or between the faid truftees touching the faid premiffes, which can- not be adjufted or fettled among them- felves, then and in fuch cafe, and as often as the fame ffiall happen, the vffitors hereby appointed, or any five or more of them, ffiall and are hereby authorized and impowered, to hear and determine in the moft fummary way, fuch difference or difpute, whofe order or determination ffiall be final. And it is alfo my Will and defire, that all fuch other powers and autho- rities may be added or veiled, as well in the faid intended truftees, as in the vjfitors hereby appointed, as ffiall by [ 16 ] the legiflature be thought moll proper and convenient, for the better manage- ment, order, and care of my faid col- lection and premiffes. And further, it is my Will, and I do hereby declare and direCt, that the faid advowfon, prefentation, and right of patronage of the church of Chelfea, fhall be filled up from time to time, as often as the fame fhall become va- cant, by fuch perfon or perfons as the truftees hereby appointed, or the ma- jor part of them, fhall eleCt, prefent, nominate, or appoint. And I do hereby further requell and defire, that the truftees hereby appointed, or the major part of them, with the confent of the. vifitors, or major part of them, and alfo my heirs and executors, and every of them, will concur, as far as in them refpedtively lies, in promoting this my intention, and of perpetuating my faid collection as afore mentioned, with their bell endeavours, and for obtaining payment of the faid fum of twenty thoufand pounds as aforefaid. . [ <7 I and for fettling and alluring the faid mufaeum or collection and premifies, manor- houfe and garden, with their appurtenances, water, and advowfon, upon the truflees hereby appointed, and for making a proviiion or fund for maintaining and fupporting the fame for ever, as before mentioned : And in order that there may be always a fufficient number of truftees fubli fl- ing as far as may be, my Will is, and I do hereby direct and defire, that with- in convenient time after the deceafe of anyfeven of the faid truftees herein be- fore particularly named, or any other fevenof the truftees for the time being, or any lefs number, if they fo pleafe, then and in fuch cafe, and fo often as the fame fhall happen, the furvivorf of fuch truftees, or any feven or more of them, fhall and may at their meetings proceed to the election or choice of fuch other perfon or perfons as they fhall think fit to be truftees, in the room of fuch of them as fhall happen fo to die j and the perfon or perfons [ .8 fo elected and chofen, (hall be inverted with the fame powers and authorities in and over the premifles, as the truf- tees hereby named, fo as that the number of truftees never exceed fifty at any one time. And my Will alfo is, and I do di- rect, that (for continuing a fufficient number of vifitors ) upon or after the deceafe of any five of the vifitors here- in before particularly named, or any five of the vifitors for the time being, or of any lefs number if they fo pleafe, then and in fuch cafe, and fo often as the fame fhall happen, the furvivors of fuch vifitors, or any five or more of them, fhall and may eledt and chufe fuch other perfon or perfons as they fhall think fit, provided they be not truftees in the room of fuch of them as fhall happen to die j and the perfon or perfons fo elected and cho- fen, fhall be inverted with the fame powers and authorities in and over the premifles, as the vifitors hereby nam- ed, fo as the number of vifitors never exceed [ i9 ] exceed more than thirty at any one time. And I do hereby declare, that it is my delire and intention, that my faid mufeum or collection be preferved and kept in my faid manor-houfe at Chelfea aforefaid, by the faid truftees and vilitors, and that the fame may be, from time to time, vilited and feen by all perfons defirous of feeing and viewing the fame, under fuch fta- tutes, directions, rules, and orders, as fhall be made, from time to time, by the faid truftees, or any feven or more of them, to be afterwards ratified by the faid vilitors (or any five or more of them, as aforefaid) that the fame may be rendered as ufeful as pollible, as well towards fatisfying the defires of the curious, as for the improvement, knowledge and information of all per- fons ; and it is for this purpofe I have hereby repofed a fincere trull: and con- fidence in my right honourable, ho- D nourable, [ *0 ] nourable, and other truftees and vic- tors hereby appointed. But in cafe payment of the faid fum of twenty thoufand pounds {hall not be had and obtained, and made unto my executors, or the furvivors of them, within twelve months next after my deceafe, and no fuch ad: of parliament fhall be obtained for fettling, preferv- ing, eflablifhing, maintaining, and continuing my faid colledion and pre- milfes in manner aforefaid ; then, and not otherwife, my Will is, and I do in fuch cafe hereby dired, that my faid executors or the furvivors of them, do and fhall fell and difpofe, or caufe to be fold and difpofed of all and every part of my faid colledion ,or mufaeum as before defcribed, together with the catalogues thereto belonging unto, or for the ufe of the royal academy of fciences at Peterfburgh, provided that the faid royal academy of fciences at Peterfburgh, or the managers and di- rectors [ 21 ] reftors thereof, or others on their be- half impowered, do artd fhall, within twelve months next after notice there- of, lignified or given to the embaffa- dor, relident or envoy of or from the Czarina or Emprefs of Ruffia, or of the Emperor of Ruffia for the time being, by my faid executors or fur- vivors of them, pay or caufe to be paid unto my executors, or the furvivor or furvivors of them, and to be deemed as part of my perfonal eftate, the full and clear fum of twenty thoufand pounds of lawful money of Great- Bri- tain ; and in cafe payment of the faid fum of twenty thoufand pounds fhall not be made at or within the time men- tioned above for that purpofe, by the managers or directors of the faid Royal Academy of Sciences at Peterfburgh, or any other on that behalf impowered, then my Will is, and I do hereby di- redl and appoint, that my executors or the furvivors of them, do and {hall fell and difpofe, or caufe to be fold and dilpofed of, all and every part of D 2 my [ ] my Paid colle&ion cr mufaeum as be- fore defcribed, with the catalogues thereunto belonging, unto or for the ufe of the royal academy of fciences at Paris, provided that the faid Royal Academy of Sciences at Paris, or the managers, directors or others impower- ed on their behalf, do and lhall with- in twelve months next after notice thereof fignified or given, to the em- bafiador, relident, or envoy of or from the court of France, by my faid exe- cutors or furvivors of them, pay or caufe to be paid unto my executors or the furvivor or furvivors of them, and to be deemed in like manner as part of my perfonal eftate, the full and clear fum of twenty thoufand pounds of lawful money of Great-Britain ; and in cafe payment of the faid fum of twenty thoufand pounds laft men- tioned fhall not be made at or within the time above-mentioned in that be- half, then my Will is, and I do here- by direct, that my executors or fur- vivors [ 23 ] vivors of them, do and (hall fell and difpofe or caufe to be fold and difpofed of, all and every part of my faid col- lection or mufaeum as before defcrib- ed, with the catalogues thereunto be- longing, unto or for the ufe of the royal Academy of Sciences at Berlin, provided that the faid royal Academy of Sciences at Berlin, or the managers or directors thereof, or others im- powered on their behalf, do and fhall, within twelve months next after notice thereof fignified or given to the ambaf- fador, or relident, or envoy of or from the king of Pruffia, by my executors, or furvivors of them, pay or caufe to be paid unto my executors, or the fur- vivor or furvivors of them, and to be deemed in like manner as part of my perfonal eftate, the full and clear fum of twenty thoufand pounds of lawful money of Great-Britain ; and in cafe payment of the faid fum of twenty thoufand pounds laft mention- ed fhall not be made at or within the time [ *4 ] time before mentioned for that pur- pofe, then my Will is, and I do here- by direCt my faid executors, or furvi- vors of them, do and fhall fell and dife pofe of, or caufe to be fold and dif- pofed of, all and every part of my faid collection or mufaeum, as before deferibed, with the catalogues there- to belonging unto or for the ufe of the Royal Academy of Sciences at Madrid; provided that the faid Royal Academy of Sciences at Madrid, or the managers or directors thereof, or others impowered on their behalf, do and fhall, within twelve months next after notice thereof iignified or given to the ambaflador, or relident, or envoy of or from the court of Spain, by my executors or furvivors of them, pay or caufe to be paid unto my executors, or to the furvivors or furvivor of them, and to be deemed in like manner as part of my perfonal eftate, the full and clear fum of twenty thoufand pounds of lawful money of Great-Britain. And [ »5 ] And my Will is, and I do hereby further direct, that fuch notice and notices fhall be given and fignified to the refpe&ive ambaffador, or refident, or envoy of or from the court of Ruffia, France, Berlin and Madrid, within three months next after failure or de- fault of payment of the fum of twenty thoufand pounds afore mentioned from the parliament as afore mentioned. And in cafe the faid refpective offers fhall not be accepted by parliament, nor by any of the faid foreign acade- mies, nor any fuch payments well and truly made by any others on their re- Ipedtive behalfs, within the refpedtive times before mentioned, unto my ex- ecutors or the furvivors of them as aforefaid ; Then my Will is, and I do hereby further direct and appoint, that my executors or the furvivors or furvivor of them, do and fhall be at liberty, with all convenient fpeed, to fell and [ =6 ] difpofe of, or caufe or procure to be fold and difpofed of, all and every part of my faid collection or mufaeum, in the moil fpeedy and advantageous manner ; and the monies arihng by fuch fale or difpolition, I do hereby direCt, will, and appoint, fhall be paid to my executors or to the furvivors or furvivor of them, and fhall be con- lidered as part ol my perfonal eflate j Provided always, and my Will is, that the truftees or executors, hereby in- tended and appointed for any of the purpofes herein mentioned, fhall not be anfwerable for or chargeable with the aCts or deeds of each other, but with or for his own wilful acts and deeds only. And further my Will is, and I do hereby direct, that in cafe my laid collection fhall be fold or difpofed of to either of the faid foreign academies before-mentioned, or in cafe of their refufai or non-acceptance by my ex- ecutors, £ 27 3 ccutors, or the furvivors of them ; that then my faid manor houfe and garden, with their appurtenances, and the water, and advowfon, ihall go to and belong to fuch perfon or perfons, and in fuch manner as I have given and devifed the reft of my faid manors, lands, and tenements at Chelfea or elfewhere. In witnefs whereof I the faid Sir Hans Sloane have to this codicil, con- tained in two ikins or pieces of parch-- ment, fet my hand and feal this tenth day of July in the year of our lord one thoufand feven hundred and forty- nine. And whereas I have in and by the faid former codicil, or by fome other, given and devifed my advovvfon of the re&ory and parifh church of Chelfea to my faid vifttors and truftees, or to fome of them, upon truft to prefent a proper perfon thereto, when the fame fhall become vacant : now I do by this my codicil revoke that part of my faid former codicil concerning the faid advovvfon, and do hereby give and devife the faid advowfon to fuch per- fon or perfons as fhall from time to time have and enjoy my manor of Chelfea, and that he, fhe, or they, from time to time, fhall prefent there- unto, whenever the fame fhall be- come vacant.
