CONDITIONS OF SALE
1. Any bid which is merely a nominal or fractional advance may
be rejected by the auctioneer, if, in his judgment, such bid would be
likely to affect the sale injuriously.
2. The highest bidder shall be the buyer, and if any dispute arise
between two or more bidders, the auctioneer shall either decide the same
or put up for re-sale the lot so in dispute.
3. Payment shall be made of all or such part of the purchase
money as may be required, and the names and addresses of the pur-
chasers shall be given immediately on the sale of every lot, in default
of which the lot so purchased shall be immediately put up again and
re-sold.
Payment of that part of the purchase money not made at the
time of sale shall be made within ten days thereafter, in default of
which the undersigned may either continue to hold the lots at the
risk of the purchaser and take such action as may be necessary for
the enforcement of the sale, or may at public or private sale, and
without other than this notice, re-sell the lots for the benefit of such
purchaser, and the deficiency (if any) arising from such re-sale shall
be a charge against such purchaser.
4. Delivery of any purchase will be made only upon payment
of the total amount due for all purchases at the sale.
Deliveries will be made on sales days between the hours of 9
A. M. and 1 P. M., and on other days—except holidays—between the
hours of 9 A. M. and 5 P. M.
Delivery of any purchase will be made only at the American Art
Galleries, or other place of sale, as the case may be, and only on pre-
senting the bill of purchase.
Delivery may be made, at the discretion of the Association, of
any purchase during the session of the sale at which it was sold.
5. Shipping, boxing or wrapping of purchases is a business in
which the Association is in no wise engaged, and will not be performed
by the Association for purchasers. The Association will, however,
afford to purchasers every facility for employing at current and
reasonable rates carriers and packers; doing so, however, without any
assumption of responsibility on its part for the acts and charges of
the parties engaged for such service.
6. Storage of any purchase shall be at the sole risk of the pur-
chaser. Title passes upon the fall of the auctioneer’s hammer, and
thereafter, while the Association will exercise due caution in caring
for and delivering such purchase, it will not hold itself responsible if
such purchase be lost, stolen, damaged or destroyed.
Storage charges will be made upon all purchases not removed
within ten days from the date of the sale thereof.
7. Guarantee is not made either by the owner or the Association
of the correctness of the description, genuineness or authenticity of any
lot, and no sale will be set aside on account of any incorrectness,
error of cataloguing, or any imperfection not noted. Every lot is
on public exhibition one or more days prior to its sale, after which
it is sold “as is” and without recourse.
The Association exercises great care to catalogue every lot cor-
rectly, and will give consideration to the opinion of any trustworthy
expert to the effect that any lot has been incorrectly catalogued, and,
in its judgment, may either sell the lot as catalogued or make mention
of the opinion of such expert, who thereby wouid become responsible
for such damage as might result were his opinion without proper
foundation.

slender trees whose green foliage has touches of light yellow, the
wedding breakfast has been set, and the company, in brilliant attire,
have glasses raised ready for the toast which the young bridegroom
has risen to propose.

city in the distance, lying under a haze, and tall towers and palms
silhouetted against a hot red horizon. The caravan takes a long,
winding course, and is headed toward the spectator, six Arabs mounted
on camels being individualized in the lead, with half a dozen persons
on foot, one of them walking beside a laden ass. At right of the flat
desert road is a large pool, with persons at its bank.

standard of a tall lamp that extends much higher than his head.

scape, winnowing grain. As she pours it from a basket held in her
arms to one on the ground, chickens behind her profit by the oppor-
tunity to feed. Back of them a stone wall comes into view, and at left
haystacks appear in a broad field.

In a palace room a cardinal and a gentleman in richly embroidered
velvet coat, lace cuffs and jabot, face each other across an ormolu
mounted table, absorbed to the point of fixation in a game of chess.
The features of the cardinal are immobile but tranquil, those of his
opponent pursed and knitted; heads rest on hands, and a spider has
wrought a web connecting both with the chandelier above. Another
gentleman and a cleric in purple, standing in a doorway, regard the
spectacle with joyous amazement.

her white lamb are lying on the grass, in the sunshine, a black ram
recumbent but alert beside them, and another creamy-fleeced sheep
standing at the right. Height, 40 inches; length, 53% we age
ATTRACTIVELY situated among trees and flowering shrubs is a terrace
in front of a Bavarian inn, where a number of people from the city
are sitting at tables, eating. In the foreground a little girl in trim
and dainty attire is distributing cakes and delicacies to a group of
village children. The little tots are so delighted at the unexpected
treat that they have quite neglected a baby, who is crying on the
ground, his shoes kicked off. At the end of the terrace is a swing,
where several children are collected. At the upper right appear the
house-tops and church spire of the village.

In the patio of a marble palace of Spain, a cardinal in his brilliant
robes is seen astride a white horse caparisoned in brilliant accord, about
to take his leave of two ladies richly dressed, who speed him from the
foot of the marble stairway. The younger of the two, comely and
with reddish hair, clasps her hands devoutly, smiling quietly with equal
devotion, and the cardinal, with an inspiration of satisfaction, raises
his hand in benediction, while the elder woman, sheltering her face with
a fan, looks at his Eminence shrewdly, with a not unkindly tolerance.
A cleric in black is slipping a bottle of champagne into the cardinal’s
saddle-bag.

Tue spirit of the morning comes as a lithe nymph borne upon the aerial
wings of the dawn, tripping so lightly over the earth that her delicate
foot uses a stream in the foreground merely as a mirror, not disturbing
the limpid surface. Her slender figure is nude, save for a diaphanous
drapery which trails from her upraised left arm, falling behind her
back and winding forward lightly over her fleet limbs. Her long and
curling hair falling unconfined hangs to below her waist, and her face
is seen in profile to the left as she turns in passing and bends her head
downward to scent a tall lly that blossoms by the water’s edge. In
the atmospheric background a vague haze, and the hues of daybreak
over a landscape just coming into visible being.

clouded sky, creamy and gray. Horses are already aboard, others are
being loaded on, under the direction of officers, and the yard of a
country station is filled with cavalrymen, dismounted, and with their
packs. Other members of the forces, and villagers, are seen without
the gate, at the right, while in the distance ahead of the train appear

A composition of eight figures, the scene a crypt with dark reddish
beams and shadowed ceiling, and gray and creamy walls and floor.
At right the stern military judge sits at a table, with back to the
spectator and head turned slightly to his left, where the red-bearded
Scot stands facing him, clad in kilt and white shirt, which is open at
the front and reveals his hairy chest. Four red-coats stand rigid,
guarding him, and a fifth guards the low entrance door at the left,
while their commander stands sword in hand a little in front of them,
eyes on the bare-headed victim and observed profil perdu.

THe spectator looks between slender trees which form an open screen
in the foreground, across a broad pool or backwater of a sluggish
stream, its dark blue surface broadly spread with white, which traverses
the breadth of the picture. The foreground is a green rolling bank
lying in the sunlight and accented by transparent shadows of the sap-
lings, between which at the water’s edge the grass grows coarser and
reeds and aquatic plants grow taller. On the far side of the stream
are dense woods, green and blue, with sunshine touching feathery
foliage at the left, and shadows deepening toward the right.

Tue full title and explanation of the picture appears on the back of
. the canvas, in the following note:
“Receiption [sic] of Dr. Franklin and his fellow delegates (Deane and Lee) by
King Louis the XVI and his wife Marie Antoinette, at Versailles, after the treaty
signed between France and the United States of America. Year 1778. Painted by
Filippo Baratti, London, 1892.”
The royal couple are on a dais spread with gold-edged crimson, the
king in purple, standing, the queen in rose-white with a light emerald
mantle, seated. Before them stand the three American delegates, Dr.
Franklin in black velvet, his associates in green and rich apricot.
Standing about the splendid hall are ladies and gentlemen of the
Court and palace attendants, in brilliant costume, to the number of
nearly two score.

Iw low lateral rolls_a high field crosses the picture, its surface covered
with thickly growing purple heather, cut by paths and softly glowing
in subdued sunshine. In the middle distance it falls away abruptly, to
green lowlands dark in shadow and seen through a variable bluish
haze. Just at the slope of the heather field, in the sunlight, a shepherd
stands in the midst of his flock, and afar off across the shadowed fields
the misty horizon reveals a low and far reaching range of mountains.

Tue stately monarch is enthroned upon the back of a huge elephant, a
an attendant holding a sun umbrella above him, the mahout and two
dogs seated on the elephant’s head, and two scarlet coated attendants
standing on a riding shelf slung at the elephant’s side. A second
elephant bearing an official under a canopy is a little in the rear, and
horsemen fall in from the left, while a white clad throng flock down the
great steps of a huge gate in the background, above whose flanking _
walls are seen the palmate domes of the mosque within, white under a
turquoise sky.

Fut length; three-quarters to the left. Le Bien Aimé, in the flower = 4
of early manhood, wears a suit of blue armor embellished with bands of |
gilt ornament. His ermine-lined mantle is sewn with French lilies
and he wears a blue sash. His left hand is on his hip, and his right
is laid on the plumed helmet which, together with the baton and
gauntlets, is placed on the red-draped table on the left. In the right
foreground is a gilt stool, upholstered in rose. He wears the ribbon
of the Order of the Golden Fleece. His head is relieved against a
dark green curtain.
The highly ornamental frame is decorated with festoons of arms, and the device
of two dolphins in lozenges at the corners.
From the Chateaw de Minard, which belonged to the Marquis de
Marigny, brother of the Marquise de Pompadour, who was Min-
ister of State.
It was purchased direct from Van Loo.

An assemblage of American fashion and freedom at New York’s
famous Springs, in the vision of a foreigner and in the costumes of the
latter part of the nineteenth century. At the right the corner of a
stone building, with a pillared porch extending well across the picture,
and a green grove viewed beyond it under a brilliant summer sky. In
the corner of the porch an orchestra plays, under the folds of an
American flag, and on porch, steps and the flagged promenade in
front of them are men, women and children, to the number of more
than two score, in light and colorful summer costumes. ‘T'wo pet dogs
add diversity to the composition.
