Dec. 12, 1861 — Read first, to bo read second time. 1. Be it enacted by the general assembly, that in addition to 2 the requirements of the several acts incorporating joint stock 3 companies for the construction of turnpike and plank roads, every 4 such company, heretofore or which may be hereafter incorpo- 5 rated, shall be required to cut down and remove all dead and 6 dangerous timber, for a space of 100 feet on each side of its road, 7 and for each failure, shall be fined at the discretion of a jury, not 8 less than five nor more than one hundred dollars. 2. All fines recovered under the first section of this act shall 2 be paid into the treasury and placed to the credit of the literary 3 fund. 3. This act shall be in force from and after the first day of 2 April 1862. pH8.5
