Amendments enact, 2 That all persons who shall be held unfit for military service in o the field, by reason of bodily or mental incapacity or imbecility, ■1 under rules to Ijo prescribed by the Scereiary of War; the Vice 6 President of the Confederate States, the officers, Judicial and G Executive of the Confederate and State Governments, includino- 7 postmasters appointed by the President and confirmed by 8 the Senate, and such clerks in their offices as are allowed by tko Postmaster General, and now employed, and excluding all other 10 postmasters, their assistants and clerks; and except such State 1 1 officers as the several States may h&vc declared, or may hereafter 12 declare, liable to lailiUii uiity, the niciuijors of both Houses of 13 the Congress of the Confederate States, and of the Legislatures 14 of the several States, and their r:spective officers; all clerks now 15 in the offices of the Confederate and State Gove*rnnients author- ]G ized by law, receiving salaries or fees; all volunteer troops, hcre- 17 tofore raised by any State since the passage of the act, entitled 1 8 '• An act further io provide for the public defence," approved April 10 16th, 1862, while such troops shall be in active service under State 20 authority; Provided, That this exemption shall not apply to any 21 person "who was liable to be called into service by virtue of said 22 act of April IGth. 1SG2 : all pilots and persons engaged in the 23 mc^'chant marine service; tlie president, superintendents, con- 2-1 ductors, treasurer, chief clerk, engineers, managers, station 2j agents, section masters, tv;o expert track hands to each section 26 of eight miles, and mechanics in the active service and cmploy- • 27 ment of railroad comy)anics, not to embrace laborers, porters and 28 messengers ; the president, general superintendent, and oper- 29 ators of telegraph companies, the local superintendent and 30 operators of said companies, not to exceed four in number at any 31 locality but that at the scat of Government of the Confederate 32 States ; the president, superintendents, captains, engineers, chief 33 clerk and mechanics in the active service and employment of all 3 -P^. 34 comp xnies engaged in river and canal navigation, and all captains 35 of boats and engineers therein employed; one editor of each 3G newspaper now being publishec^^ and such employees as the editor 37 or proprietor may certify on oath to be indispensable for con- 38 ducting the publication ; the public printer and those employed 39 to perform the public printing for the Confederate and State 40 Governments ; every minister of religion authorized to preach 41 according; to the rules of his sect, and in the ref:^ular discharge 42 of ministerial duties ; and all persons who have been, and now 43 are members of the Society of Friends, and the Association of 44 Dunkards, Xazarenes and Mennonists in regular membership in Ab their respective denominations : Provided, Members of the Society 4G of Friends, Xazarenes, Mennonists and Dunkards shall furnish 41 substitutes or pay a tax of $500 each into the public treasury ; 'IS all physicians who now arc, and have been for the last five years, 49 in actual practice of their profession; all superintendents 50 of public hospitals, lunatic asylums, and the regular physicians, 51 nurses and attendants therein, and the^ teachers employed in the 52 institutions for the deaf, dumb and blind ; in each apothecary ."y.l store, now established and doing business, one apothecary in 54 good standing, who is a practical apotiiecary ; all superintendents, bo managers, mechanics and miners employed in the product! )n and 4 oQ manufacture of salt to the extent of twenty bushels per clay, and 57 of lead and iron^ and all persons engaged in burning coke, smelt- 53 ing and raannfacture of iron^ regular miners in coal mines, and 59 all colliers engaged in miking charcoal for making bar and pig GO iron, not to embrace laborers, messengers, -Nvagoners and servant?, 61 unless employed at -works conducted under the authority, and by G2 the ofTicers or agents of a State, or in works employed in the Go production of iron for the Confederate States ; also a regiment G4 raised under, and by authority of the State of Texas for frontier Go defence, now in the service of said State, while in such service ; CG Provided, further, That the exemptions herein above enumerated Gl and granted hereby, shall only continue whilst the persons G8 exempted are actually engaged in their respective pursuits or occu- GO pations : Providid, further, That the Secretary of War shall, upon 70 such terms v.nd conditions as may be prescribed by him, and with 7 I the approval of the President, exempt from all military service, or 72 detail for specified purposes, such person or persons, as, with the 73 approval of the President, he may deem essential for the good of 74 the service, or the general interests of the country ; and Provided, 75 further, That the enrolment of persons between forty and fort}'-- 7G five years of age, shall be suspended until the President shall 77 call such persons into the military service. 5 1 Sec. 2. All acts or parts of acts, heretofore passed in conflict 2 with the provisions herein contained, are hereby repealed. [By Mr. Ciiambliss.] Strike out all after the enacting clause, and insert : 1 ** That all persons who shall be unfit for military service in the 2 field by reason of bodily, or mental infirmity, under rules to be 3 •prescribed by the Secretary of War, the officers, Judicial and 4 Executive of the Confederate and State Governments, except 5 postmasters not nominated by the President and confirmed by the G Senate ; and except deputy sheriffs, deputy clerks, commissioners 7 of the revenue and constables ; collectors of the taxes in towns and 8 cities having such officers ; the assistants and clerks in the gene- 9 ral postoffice ; the members of both Houses of Congress of the 10 Confederate States, and the Legislatures of the respective States 1 1 and their respective officers ; and such other persons as the Presi- 12 dent shall be satisfied on account of justice or necessity ought to 13 be exempted, are hereby exempted from military service of the 11 Confederate Statft. 1 Sec. 2. Be if further enacted. That all laws heretofore enacted () 2 by Congress, exempting persons from military service in the 3 army of the Confederate States, are hereby repealed. Afid he it further enacted, That it shall be the 2 duty of all enrolling officers under ".lie act entitled ''An act to 3 enrol the names of every -white male inhabitant "within the 4 district of such agent, betAveen the ages of eighteen and forty- 3 five years, and, in case of the exej^iption of any such inhabitant 6 from military service under. the authority of law, it shall be the 7 duty of such enrolling officers to state opposite the name of such 8 person exempted, or excuse.l,the precise gvou^nd or cause thereof, and a duplicate list of all enrolments, vrith the cause of any 10 exemption, or failure to call any conscript into service stated 1 1 opposite each name, shall by each enrolling odiccr, be filed "witli 12 the judge of probate, or county court of the county Avhere sucli 13 enrolment was made, to be held subject to public inspection.
