The Congress of the Confederate States of •1 America do enact. That whenever the President i 3 consider an increase of the forces in the field necessary^ 4 to repel invasions, or for the public sni'eiy in the pending war, lie is authorized to call upon the several State in 6 his discretion, for any number of troops to serve for the 7 term of three years or during the war. 1 Sec. 2. In making such requisition, the President shall 2 take into consideration the number of troops from each 3 State already enlisted for the war, at the time of the 4 requisition, and shall, as far as practicable, equalize the 5 same amongst the States according to their resped G population. 1 Sec. 3. That all such troops shall he assigned to, and 2 and form part of, the companies, squadrons, battalions, 3 and regiments heretofore raised in their respective States 4 and now in the service of the Confederate States, and ■> the number that may remain from any State after filling '6 up existing companies, squadrons, battalions, and regi- 7 ments from such State to their maximum legal number 8 shall be organized into companies, squadrons, battalions, !> and regiments, as the case may be, under the laws of 1<> such State. 1 Sec 4. That if the Governor of any State shall refuse 2 or fail for days, after any such call shall have o been made upon him by the President, to comply with -i said requisition, then all white male citizens between the ages of thirty-live and forty-five years, in such State, are 6 hereby made subject, in all respects, to an act entitled '7 "An act further to provide lor the public defence," 8 approved April 16, 1862, and the President is authorized to enforce said act against such persons. And, in the TO event, at any time, if it shall happen that any of the 11 States shall have no Governor for the time being, upon 12 whom the President can make such call, then all the 1'8 white male citizens of such State, between the ages of 14 thirty-five and forty-five years, are made subject to the 15 said act, and the President is authorized to enforce it 16 against such persons. 1 Sec. 5. That the persons brought into military service 2 by this act shall be assigned to the company from their 3 State now in the service of the Confederate States, which -t they may prefer to join, subject to such regulations as 5 the Secretary of War may establish, to secure the filling 6 up of existing companies, squadrons, battalions and regi- 7 ments, from the respective Slates : Provided, That per- 8 sons liable to military service under the provisions of this 9 act and able-bodied men over the age of forty-five years 10 may volunteer and be assigned to duty in such company 11 from their State as they may select: Provided, That 12 said company shall not, by reason thereof, be increased 13 beyond its legal maximum number : And provided fur- 1 4 ther, That the right of volunteering in, or being assigned 15 to, an}' company shall not interfere with the objects of 16 this act or produce inequality or confusion in the differ— 17 ent arms of military service. 1 Sec. 6.
