A Mason is oblig'd, by his Tenure, to obey the moral Law; and if he rightly understands the Art, he will never be a stupid Atheist, nor an irreligious Libertine. But though in ancient Times Masons were charg'd in eyery Country to be of the Religion of that Country or Nation, whatever it was, yet 'tis now thought more expedient only to oblige them to that Religion in which 4 MASONIC LAW OF SOUTH DAKOTA. all Men agree, leaving their particular Opinions to themselves; that is, to be good Men and true, or Men ot Honour and Honesty, by whatever Denominations or persuasions they may be distinguish'd; whereby Masonrv becomes the Center of Union, and the Means of conciliating true Friendship among Persons that must have remain'd at a perpetual Distance. II. Of the Civil Magistrate, Supreme and Subordinate. A Mason is a peaceable Subject to the Civil Powers, wherever he resides or works, and is never to be con- cern'd in Plots and Conspiracies against the Peace and Welfare of the Nation, nor to behave himself unduti- fully to inferior Magistrates; for as Masonry hath been always injured by War, Bloodshed, and Confusion, so ancient Kings and Princes have been much dispos'd to encourage the Craftsmen, because of their Peaceable-. ness and Loyalty, whereby they practically answer'd the Cavils of their Adversaries, and promoted the Honour of the Fraternity, who ever flourish'd in Times of Peace. So that if a Brother should be a Rebel against the State, he is not to be countenanc'd in his Rebellion, however he may be pitied as an unhappv Man; and, if convicted of no other Crime, though the loyal Brotherhood must and ought to disown his Rebel- lion, and give no Umbrage or Ground of political Jeal- ousy to the Government for the time being, they cannot expel him from the Lodge, and his relation to it remains indefeasible. III. Of Lodges. A Lodge is a Place where Masons assemble and work; Hence that Assembly, or duly organiz'd Societ}- of Masons, is call'd a Lodge, and every Brother ouo-ht to belong to one, and to be subject to its By-Laws and the General Regulations. It is either particular or gen- eral, and will be best understood by attending it, and by the Regulations of the General or Grand Lodge hereunto annex'd. In ancient times, no Master or Fellow could be absent from it, especially when warn'd to appear at it, without incurring a severe Censure MASONIC LAW OF SOUTH DAKOTA. 5 until it appeared to the Master and Wardens that pure Necessity hinder'd him. The Persons admitted Members of a Lodg-e must be good and true Men, free-born, and of mature and dis- creet Ag'e, no Bondmen, no Women, no immoral or scandalous Men, but of g'ood Report. IV. Of Masters, Wardens, Fellows, and Appren- tices. All Preferment among- Masons is g-rounded upon real Worth and personal Merit only; that so the Lords may be well served, the Brethren not put to shame, nor the Royal Craft despis'd: Therefore no Master or Warden is chosen by Seniority, but for his Merit. It is impos- sible to describe these thing's in writing-, and every Brother must attend in his Place, and learn them in a wav peculiar to this Fraternity: Only Candidates may know, that no Master should take an Apprentice, unless he has sufficient Imployment for him, and unless he be a perfect Youth, having no Maim or Defect in his Body, that may render him uncapable of learning- the Art of serving- his Master's Lord, and of being- made a Brother, and then a Fellow-Craft in due time, even after he has served such a Terra of Years as the Cus- tom of the Country directs; and that he should be descended of honest Parents; that so, when otherwise qualify'd, he may arrive to the Honour of being- the Warden, and then the Master of the Lodge, the Grand Warden, and at length the Grand Master of all the Lodges, according to his Merit. No Brother can be a Warden until he has pass'd the part of a Fellow-Craft; nor a Master until he has acted as a Warden, nor Grand Warden until he has been Master of a Lodge, nor Grand Master unless he has been a Fellow-Craft before his Election, who is also to be nobly born, or a Gentleman of the best E"*ashion, or some eminent Scholar, or some curious Architect, or other Artist, descended of honest Parents, and who is of singular great Merit in the Opinion of the Lodges. And for the better, and easier, and more honorable Discharge of his Office, the Grand Master has a Power to chuse his own Deputy Grand Master, who must then, 6 MASONIC LAW OF SOUTH DAKOTA. or must have been formerly, the Master of a particular Lodg-e, and has the Privilege of acting whatever the Grand Master, his Principal, should act, unless the said Principal be present, or interpose his Authority by a Letter. These Rulers and Governors, supreme and subordi- nate, of the ancient Lodge, are to be obey'd in their respective Stations by all the Brethren, according to the old Charges and Regulations, with all Humility, Reverence, Love, and Alacrity. V. Of the Management of the Craft in Working. All Masons should work honestly on working Days, that they may live creditably on holy Days; and the time appointed by the Law of the Land, or confirm'd by Custom, shall be observ'd. The Most expert of the Fellow-Crafsmen shall be chosen or appointed the Master, or Overseer of the Lord's Work, who is to be call'd Master by those who work under him. The Craftsmen are to avoid all ill Language, and to call each other by no disobliging Name, but Brother or Fellow, and to behave themselves courteously within and without the Lodge. The Master, knowing himself to be able of Cunning, shall undertake the Lord's Work as reasonably as pos- sible, and truly dispend his Goods as if they were his own; nor give more Wages to any Brother or Appren- tice than he really may deserve. Both the Master and the Masons receiving their Wages justly, shall be faithful to the Lord, and hon- estly, finish their Work, whether Task or Journey; nor put the Work to Task that hath been accustom'd to Journey. None shall discover Envy at the Prosperity of a Brother, nor supplant him, or put him out of his Work, if he be capable to finish the same; for no man can finish another's Work so much to the Lord's Profit unless he be thoroughly acquainted with the Desio-ns and Drafts of him that began it. When a Fellow-Craftsman is chosen Warden of the Work under the Master, he shall be true both to MASONIC LAW OP SOUTH DAKOTA. 7 Master and Fellows, shall carefully oversee the Work in the Master's absence to the Lord's Profit; and his Brethren shall obey him. All Masons employ 'd shall meekly receive their Wages without Murmuring or Mutiny, and not desert the Master till the Work is finish'd. A younger Brother shall be instructed in working, to prevent spoiling the Materials for want of Judgment, and for encreasing and continuing of Brotherly love. All the Tools used in working shall be approved by' the Grand Lodge. No Labourer shall be eraploy'd in the proper Work of Masonr}^; nor shall Pree-Masons work with those that are not free, without an urgent Necessity; nor shall they teach Labourers and unaccepted Masons, as they should teach a Brother or Fellow. VI. Of Behaviour. /. 1)1 the Locig-e xvhilc Constituted. You are not to hold private Committees, or separate Conversation without Leave from the Master, nor to talk of anything impertinent or unseemly, nor inter- rupt the Master or Wardens, or any Brother speaking to the Master; Nor behave yourself ludicrously or jestingly while the Lodge is engaged in what is serious and solemn; nor use any unbecoming language upon any Pretense whatsoever; but to pay due Reverence to your Master, Wardens, and Fellows, and put them to worship. If any Complaint be brought, the Brother found guilty shall stand to the Award and Determination of the Lodge, who are the proper and competent Judges of all such Controversies (unless you carry it by Appeal to the Grand Lodge), and to whom they ought to be referr'd, unless a Lord's Work be hinder'd the mean- while, in which Case a particular Reference may be made: but you must never go to Law about what con- cerneth Masonry, without an absolute Necessityappar- ent to the Lodge. 8 MASONIC LAW OF SOUTH DAKOTA. 2. Behavior after the Lodge is over, and the Brethren not g-one. You may enjoy yourselves with innocent Mirth, treat- ing one another according- to Ability, but avoiding- all Excess, or forcing any Brother to eat or drink beyond his Inclination, or hindering him from going when his Occasions call him, or doing or saying anything offen- sive, or that may forbid an easy and free Conversation; for that would blast our Harmony, and defeat our laud- able Purposes. Therefore no private Piques. or Quar- rels must be brought within the Door of the Lodge, far less any Quarrels about Religion, or Nations, or State Policy, we being only, as Masons, of the Catholick Religion above mention 'd; we are also of all Nations, Tongues, Kindreds, and Languages, and are resolv'd against all Politicks, as what never yet conduc'd to the Welfare of the Lodge, nor ever will. This charge has always been strictly enjoin'd and observ'd; but espec- ially ever since the Reformation in Britain, or the Dis- sent and Secession of these Nations from the Com- munion of Rome. J. Behavior when Brethren meet zcitho/it Stra)ig-ers but not in a Lodge Fornid. You are to. salute one another in a courteous manner, as you will be instructed, calling each other Brother, freely giving mutual Instruction, as shall be thought expedient, without being overseen or overheard, and without encroaching upon each other, or derogating from that Respect which is due to any Brother were he not a Mason: For though all Masons are as Brethren upon the same Level, yet Masonry takes no Honour from a Man that he had before; nay rather it adds to his Honour, especially if he has deserv'd well of the Brotherhood, who must give Honour to whom it is due and avoid ill Manners. -f. Behavior in presence of Stra7igers not Masons. You shall be cautious in your Words and Carriage that the most penetrating Stranger shall not be able to discover or find out what is not proper to be intimated- MASONIC LAW OP SOUTH DAKOTA. 9 and sometimes you shall divert a Discourse, and man- age it prudently for the Honour of the worshipful Fraternity. 5. Behavior at Ho7ne and in your Neighborhood. You are to act as becomes a moral and wise Man; particularly, not to let your Family, Friends, and Neig-hbors know the Concerns of the Lodge, &c., but wisely to consult your own Honour, and that of the ancient Brotherhood, for Reasons not to be mention 'd here. You must- also consult your Health, by not con- tinuing- tog-ether too late, or too long from home, after Lodge Hours are past; and by avoiding of Gluttony or Drunkenness, that your Families be not neglected or injured, nor you disabled from working. 6. Behavior tozuards a Strang-e Brother. You are cautiously to examine him, in such a Method as Prudence shall direct you, that you may not be impos'd upon by an ignorant false Pretender, whom you are to reject with Contempt and Derision, and beware of giving him any Hints of Knowledge. But if you discover him to be a true and genuine Brother, you are to respect him accordingly; and if he is in want, you must relieve him if you can, or else direct him how he may be reliev'd; You must employ him some Days, or else recommend him to be employ 'd. But you are not charged to do beyond your Ability, onlv to prefer a poor Brother, that is a good Man and true, before any other poor People in the same Cir- cumstance. Finally, All these Charges you are to observe, and also those that shall be communicated to you in another way; cultivating Brotherly Love, the Foundation and Cape-stone, the Cement and Glory of this ancient Fra- ternity, avoiding all Wrangling and Quarreling, all Slander and Backbiting, nor permitting others to slander any honest Brother, but defending his Char- acter, and doing him all good Offices, as far as is con- sistent with your Honour and Safety, and no farther. And if any of them do you injury, you must apply to 10 MASONIC r.AW OF SOUTH DAKOTA. your own or his Lodg-e; and from thence you may appeal to the Grand Lodge at the Quarterly Communi- cation, and from thence to the annual Grand Lodge, as has been the ancient lauaable Conduct of our Fore- fathers in every Nation; never taking a legal Course but when the Case cannot be otherwise decided, and patiently listning to the honest and friendly Advice of Master and Fellows, when they would prevent your going to Law with Strangers, or would excite you to put a speedy Period to all Law-Suits, that so you may mind the Affair of Masonrvwith the more Alacrity and Success; but with respect to Brothers or Fellows at Law, the Master and Brethren should kindly offer their Mediation, which ought to be thankfully submitted to by the contending Brethren; and if that Submission is impracticable, they must however carry on their Pro- cess, or Law-Suit, without Wrath and Rancor (not in the common wayj, saying or doing nothing which may hinder Brotherly Love, and good Offices to be renew'd and continu'd; that all may see the benign Influence of Masonry, as all true Masons have done from the Begin- ing of the World, and will do to the End of Time. Amen, so mote it be. CONSTITUTION OF T H K. /T^ostU/orsf^ipfuI Orai^d tpd(^eof Soutl; Dal^ota PREAMBLE. We, the representatives of five lodges of Ancient, Free and Accepted Masons of South Dakota, in conven- tion assembled, in order to form a perfect union, estab- lish order, insure tranquility, provide for and promote the g-eneral welfare of the craft, and secure to the fra- ternity within the State of South Dakota the blessings of Masonic privileges, do ordain and establish this Con- stitution: ARTICLE I. The Grand Lodge shall consist of a Grand Master, a Deputy Grand Master, a Senior Grand Warden, a Junior Grand Warden, a Grand Treasurer, a Grand Secretary, a Deputy Grand Secretary, a Grand Lec- turer, a Grand Chaplain, two Grand Deacons, a Grand Tyler, a Grand Marshal, two Grand Stewards, a Grand Sword Bearer, a Grand Pursuivant, the Masters and Wardens for the time being of the several lodges under the Jurisdiction of this Grand Lodge, all past elective Grand Officers of the Grand Lodge who continue members of any lodge under this Jurisdiction. ARTICLE II. This Grand Lodge, so to be organized, shall be styled and known by the name of the Grand Lodg-e of Ancient, Free aiid Accepted Masons of South Dakota. ARTICLE in. The Grand Lodge shall hold Annual Communications, and the Grand Master, or his Deputy in case of his absence from the state, may, on very urgent occasions, call special meetings. 12 MASONIC LAW OF SOUTH DAKOTA. ARTICLE IV. When any officer of a particular Lodgfe cannot attend the Grand Lodge, he may depute any Brother Master Mason of the same Lodg-e to act for him in the Grand Lodg-e, and such deputation shall be over the signature of the Brother deputing. ARTICLE V. Past Grand Officers may hold offices in particular Lodges, and this shall not deprive them of any privi- lege they may claim in the Grand Lodge as Past Grand Officers. ARTICLE VI. The Grand Master, Deputy Grand Master, Senior Grand Warden and Junior Grand Warden, Grand Treasurer and Grand Secretary shall be annually elected by ballot. The Grand Secretary shall appoint his Deputy, and the Grand Master shall appoint all other officers. ARTICLE VII. In all questions which shall come before the Grand Lodge for its decision, every Subordinate Lodge — whether represented by one or more delegates — shall be entitled to three votes; and every Past and Present Elective Grand Officer one vote; and also everyappoint- ive Grand Officer present, and acting duringhis term, shall be entitled to vote individually, and the Grand Master, or his Deputy when presiding", shall give the casting vote when it is necessary. ARTICLE VIII. The Grand Lodge shall have power to constitute new Lodges by letters patent, under its seal. ARTICLE IX. To establish a uniform mode of working throughout its Jurisdiction, strictly adhering to the ancient land- marks, usag-es and customs of Masonry. ARTICLE X. And in furtherance of this object, it shall be the duty of the Grand Master, by himself or some other Brother MASONIC LAW OF SOUTH DAKOTA. 13 by him appointed, to visit as often as practicable the particular Lodges under the Jurisdiction of this Grand Lodg'e, to lecture and instruct the Brethren, and to correct such errors as may exist among- them. ARTICLE XI. To hear and determine all appeals from. Subordinate Lodges and to decide all disputes between the different Lodges under this Jurisdiction; to demand such fees as may be deemed just and reasonable upon granting Dis- pensations and constituting new Lodges and for other Masonic purposes. ARTICLE XII. To make such By-Laws as may be necessary for their good government, and not inconsistent with this Constitution. ARTICLE XIII. And do all things heretofore accustomed to be done by other Grand Lodges, which are within the ancient landmarks and usages of the Craft. ARTICLE XIV. No alteration shall take place in this Constitution, except in the manner following: Every amendment shall be proposed in writing at a regular communica- tion of the Grand Lodge, and, if concurred in, a fair copy shall be sent by the Grand Secretary to every Subordinate Lodge under this Jurisdiction, who shall pass or reject the same, and certify their proceedings thereon, without any unnecessary delay, to the Grand Secretary; and at the next regular communication, if it appears that two-thirds of the particular Lodges have concurred in the same, it shall become a part of this Constitution. Done in Masonic Convention by the unanimous con- sent of the Lodges present, at Elk Point, South Dakota, on the twenty-third day of June, Anno Lucis, 5875, Anno Domini, 1875. F. J. DEWITT, MARK W. BAILEY, President. Secretary. BY-LAWS OK THE MOST WORSHIPFUL GRAND LODGE OF SOUTH DAKOTA. GRAND LODGE. Section I. Qrand Lodge Communications. The Grand An- nual Communication of the Grand Lodg-e shall be held on the second Tuesday in June of each vear, at such place as the Grand Lodge shall determine, bv a vote at the previous Grand Annual Communication. Sec. 2. Qualifications ot Officers. Xo brother shall be elected to the office of Grand Master, Deputv Grand Master, Senior or Junior Grand Warden, who has not been elected and installed to preside over a regular Lodge, and the officers elected and appointed shall be selected as equally as practicable from the respective Lodges. Sec. 3. Election and Appointment of Grand Lodge Officers. The election and appointment of Grand Lodge Officers shall take place at the Grand Annual Communication in the manner prescribed by Article VI of the Con- stitution. Sec. 4. Vacancies— How Filled. In case of the death, resignation, absence from the state or other incapacity' of the Grand Master, his authoritv and responsibility shall devolve upon the Acting Grand Master, who shall be the senior m rank of the first three officers of the Grand Lodge present, within the state: Deputv Grand Master. Senior Grand Warden, or Junior Grand Warden. In case of other vacancy, the Grand Master shall fill the office by appointment. MASONIC LAW OF SOUTH DAKOTA. 15 Sec. 5. Standing Committees. 1. On Credentials. 2. On Grand Master's Address and reports of Grand Officers. 3. On Work of Lodg-es Under Dispensation and Petitions for Charters. 4. On Chartered Lodges and their Returns. 5. On Grievances and Appeals. 6. On Masonic Jurisprudence. 7. On Finance. 8. On Grand Lodge Library. 9. On Mileage and Per Diem. 10. On Unfinished Business. 11. On Ritual. 12. On Obituaries. 13. On Resolutions. 14. On Foreign Correspondence. Sec. 6. Committee on Foreign Correspondence. The Com- mittee on Foreign Correspondence shall be appointed at the close of each Grand Annual Communication to serve until the close of the next Grand Annual Com- munication. Sec. 7. Reports of Officers and Committees— When to be Pre- sented. All officers and committees appointed to act during recess, having reports to make to the Grand Lodge, are required to present them on the first dav of the Grand Annual Communication. Sec. 8. Questions Involving Masonic Jurisprudence. Mem- bers of the Grand Lodge having questions involving Masonic Jurisprudence to propound to the Grand Lodge or Grand Master, shall present the same in writing. GRAND OFFICERS. DUTIES OF GRAND MASTER. Sec. 9. Annual Address. The Grand Master shall, at the opening of each Annual Communication, submit a written address, setting forth an account of his official acts during the recess of the Grand Lodge, and such suggestions and propositions as he deems advisable to the fraternity and proper for the consideration of the Grand Lodge. 16 MASONIC LAW OF SOUTH DAKOTA. Sec. lo. To Cause Exemplification of Worlc. The Grand Master shall cause the work and lectures, in one or more of the three degrees in Masonry, to be exempli- fied before the Grand Lodge at each Annual Communi- cation. Sec. II. To Appoint Committees. The Grand Master shall, at each Annual Communication of the Grand Lodge, appoint the standing committees as provided for in Section five, to consist of five (5) members each, except the Committee on Foreign Correspondence, vs^hich ma}' consist of one (1) or more. Provided, That the Grand Master may, at any time, appoint any standing committee and authorize it to meet before the Annual Communication of the Grand Lodge. Sec. 12. Decisions of Qrand Master. A • decision of the Grand Master governs only in the particular case in which it is rendered, and until disapproved or set aside b}' the Grand Lodge. GRAND TREASURER. Sec. 13. Duties. It shall be the duty of the Grand Treasurer to lay before the Grand Lodge, on the first day of each Annual Communication, all of his accounts for inspection and adjustment; and he shall immedi- ately pay over to his successor any balance which may be found to be due from him to the Grand Lodge, together with all the books, papers and documents belonging to his ofiice; and shall, moreover, before entering upon the duties of his ofiice, execute to the Grand Master, for the time being, for the benefit of the Grand Lodge, a bond with such security company and in such sum as shall be approved b}- the Grand Master, conditioned upon the faithful discharge of his duties. GRAND SECRET AR.Y. Sec. 14. General Duties. It shall be the duty of the Grand Secretary to close the books and accounts of the Grand Lodge on the twentieth day of May in each year; to submit, on the first day of each Annual Communi- cation, an abstract of the operations of his ofiice during the year, with an account of the receipts and expendi- MASONIC LAW,. He shall, before entering- upon the duties of his office, execute to the Grand Master, for the time being-, for the benefit of the Grand Lodg-e, a bond with such security company and in such sum as may be approved by the Grand Master, conditioned upon the faithful discharg-e of his duties. Sec. 15. Proceedings. The Grand Secretary shall transmit three. (3) copies of the proceeding's of the Grand Lodge to each Lodge under its jurisdiction, one (1) copy to each Grand Officer, and to each permanent member of Grand Lodge, and four (4) copies to each Grand Lodge with whom Masonic relations have been established. Sec. i6. Grand Librarian. The Grand Secretary, by virtue of his office, is hereby constituted Grand Libra- rian, and directed to take charge of the Grand Lodge Library, subject to such regulations as the Grand Lodge shall prescribe. Sec. 17. Trial of Grand Officers. An elective officer of this Grand Lodge is not amenable to trial and sentence except by this Grand Lodge, or a commission deriving its authority therefrom. FORMATION OF NEW LODGES. Sec. 18. Dispensation. The Grand Master, or Acting Grand Master, may, during the recess of the Grand Lodge, upon proper application, issue Letters of Dis- pensation, to continue in force from the date thereof until the thirtieth day of April; but no dispensation shall be issued until the fee therefor shall have been deposited with the Grand Secretary, nor be valid with- out the seal of the Grand Lodge. Nor shall a dispen- sation be granted to form a new Lodge in any town or city where there is a Lodge already existing unless the population exceeds six thousand (6,000). Sec. 19. Prerequisites to Obtain Dispensation. No Dispen- sation shall be granted for the formation of a new Lodge except upon the petition of fifteen (15) known and approved Master Masons, in which petition their first Master and Wardens shall be nominated, which petition shall be accompanied by a recommendation 1riC LAW OF SOUTH DAKOTA. SUSPENSION OR EXPULSION. Sec. 91. Notice to Delinquents. The Secretary of each Lodg-e shall, in the month of January, each year, notity all members who have not paid all dues for the preced- ing year of the amount due from them, and that at the first stated meeting in March following the matter of their delinquency will be considered by the Lodge unless the amount due is paid by that time. Sec. 92. Action on Delinquents. At thefirst stated meet- ing in March of each year every Lodge shall take up the matter of delinquency of dues, and each delinquent, unless he be cleared on the books by remission of his dues, may be suspended by a two-thirds vote oi the members present. Sec. 93. Vote Required to Suspend or Expel. To suspend or expel a member of a Lodge, for any offense, shall require two-thirds of the votes of the members present. Sec. 94. Penalty for the Non-Payment of Dues. The penalty for the non-payment of dues shall be: Ineligibility to vote or hold office, or suspension — at the option of the Lodge. Sec. 95. Penalty Depriving a Member of His Vote on a Petition. No penalty, except suspension or expulsion, deprives a Master Mason from voting in the Lodge of which he is a member when the ballot is taken upon a petition for initiation, advancement or membership. Sec. 96. No Dues Chargeable. When a Mason is sus- pended, for an}' cause, no dues shall be collected from him during the time of his suspension. Sec. 97. Debarred From All Rights. When a Mason is suspended, for any cause whatever, he is for the time of such suspension debarred from all the rights and privileges of Masonry. Sec. 98. Notice of Suspension, Expulsion or Restoration to be Given. In case of the suspension, expulsion or restora- tion of a member, the Lodge so acting shall, within ten (10) days after the date of such action, notify each Lodge in the same count}-, giving the name of the mem- ber so suspended, expelled or restored. Sec. 99. Report to Grand Secretary. In case of the sus- pension, expulsion or restoration of a member, the MASONIC LAW OF SOUTH DAKOTA. 31 Lodg-e SO acting shall, within ten (10) days after the date of such action, forward to the Grand Secretary the name of the Brother so suspended, expelled or restored. Sec. 100. Transcript of Proceedrngs Had on Expulsion to be Sent to CJrand Secretary. Lodges shall, in all cases of expul- sion, as soon as possible after the date thereof, trans- mit to the Grand Secretary a full transcript of the proceedings, together with the evidence taken in the case. Sec 101. Grand Secretary to Notify Lodges. The Grand Secretary shall, once every six (6) months, send an aggregate list of all suspensions, expulsions and resto- rations received by him during the last six (6) months to each Lodge in this Grand Jurisdiction. The Grand Lodge alone has the power to publish the same to the profane. Sec. 102. Applications for Restoration— When to be Presented. Applications for restoration to membership by a sus- pended Mason must be presented at a stated meeting. Sec. 103. Restoration to riembership. To restore a Mason to membership, who has been suspended for any cause, except that of non-payment of dues, shall require the same proceeding as in the case of a petition for affilia- tion, and must receive two-thirds of the votes of the members present in favor of the restoration. Sec. 104. Restoration in Case of Suspension for the Non-Pay ment of Dues. In case of the suspension for the non-pay- ment of dues, the payment of the amount due at the time of his suspension, unless remitted by the Lodge, shall restore a Brother to membership. Provided, That after one year from the date of sus- pension a two-thirds vote of the members present shall be required to reinstate such suspended ixiember to membership. Sec. 105. Sentences Not Appealed From. All sentences of expulsion not appealed from within thirty days next thereafter, are declared "to be affirmed by the Grand Lodge," unless otherwise determined. Sec. 106. Amendments. Any additional section not con- flicting with the provisions of these By-Laws, or any alteration, amendment or proposition to repeal, shall 32 MASONIC LAW OF SOUTH DAKOTA. be submitted in writing at an Annual Communication of the Grand Lodge, and if a majority of the raem.- bers present vote in favor of considering the same, it shall be referred to a Special Committee on By-Laws, who shall report the same back with their recommenda- tion, when, if approved by three-fourths of the mem- bers present, the same shall be a part of these By- Laws. Sec. 107. Revision. If at any communication of the Grand Lodge it may be deemed necessary- to revise these By-Laws, a committee may be appointed for that purpose who shall report at the next Annual Commu- nication, when such revised code may be amended, adopted or rejected, as the Grand Lodge in its wisdom may determine. Sec. 108. Application for Affiliation. An application for affiliation may be received from a Master Mason, mem- ber of a Lodge outside of this Jurisdiction, only when he is a permanent member of the Grand Lodge, or a fully paid up life member of his Lodge, without sever- ing his connection with his home Lodge. MASONIC CODE AND REGULATIONS TRIALS AND PUNISHMENTS. MASONIC CRIMES. Section i. Crimes, What Ai'e. Masonic crimes are: (1.) The commission of any felony. (2.) A violation of any of the duties enjoined by the ancient charg-es of Freemasonry. (3.) The doing of an act, or neglect of a duty, contrary to and subversive of any of the three great duties which every Mason owes and is charged to inculcate, to God, his neighbor and himself. (4.) Conduct which tends to impair the unsullied purity of the Order, or which is in any wise contrary to the obligations and teachings of the institution. (Note. In addition to the foregoing, Sections 90 to 96 inclusive, Grand Dodge By-Laws, provide for sus- pension for non-payment of dues, providing procedure, punishment, etc.) Sec. 3. Selling Liquor. The intentional selling of in- toxicating, malt or brewed liquors in violation of the laws of the State of South Dakota is a Masonic offense, and upon conviction thereof the punishment shall be expulsion. JURISDICTION OF MASONIC OFFENSES. Sec. 3. Lodges, Jurisdiction of.' Everv Lodge has ju- risdiction to try and punish its own members for all Masonic offenses, and also jurisdiction to try and pun- ish all Masons for Masonic offenses committed within the jurisdiction of said Lodge. The Lodge of which a Mason charged with an offense is a member has con- current jurisdiction over such member. When two or more Lodges have concurrent juris- diction over a Mason charged with a Masonic offense. 34 MASONIC LAW OF SOUTH DAKOTA. the Lodge in which formal complaint, or charges, are - first filed shall have exclusive jurisdiction thereof and over such Mason. The jurisdiction of a Lodge extends over Entered Apprentices, Fellowcrafts and Master Masons. . , Provided, That no charges shall be filed in a Lodge against the Master thereof, nor against an elective oSBcer of the Grand Lodge, during his term of office; and no Lodge shall have jurisdiction to try or hear charges against the Master thereof, nor against any Grand Lodge officer, during his terra of office. PROCEDUR.E FOR TRIAL AND PUNISHMENT. Sec. 4. Regulations, What to Govern. This Code and the By-Laws of the Grand Lodge prescribe the Rule and Procedure for the trial and punishment of all Masonic offenses committed within the State of South Dakota, and the Procedure for such trials shall be, as far as practicable, governed by the provisions thereof. Sec. 5. Masonic Offenses, How Prosecuted. All Masonic offenses must be prosecuted upon written charges, signed bv the accuser, or some officer authorized to make the same, except for offenses committed in open Lodge and charges for non-payment of dues. And for convenience of reference such writing shall be known as "Charges." Sec. 6. Charges, Wiiat to Contain. All charges, required to be in writing, shall contain the name of the accuser, the name of the accused, or person charged with having committed the offense, and a statement of the facts con- stituting the offense, in ordinary language, and in such manner as to enable a person of common understand- ing to know what is intended. Sec. 7. Charges May Specify Several Offenses. Written charges may contain more than one offense, and mav state facts constituting more than one offense. If more than one offense is charged or stated, each offense must be distinctly specified, and the acts con- stituting each offense must be distinctlv set forth in ■separate and distinct specifications, and each specifica- tion must be numbered, and the date of the offense charged must be stated as near as practicable. MASONIC LAW OF SOUTH DAKOTA. 35 Sec. 8. Charges, Where Filed. All written charg-es must be filed with the Secretary of the Lodg-e having jurisdiction over the offense stated therein, or having jurisdiction of the accused, as the case may be. Sec. 9. Charges, When Presented to the Lodge. It shall be the duty of the Secretary, whenever charges are filed, to immediately inform the Master or acting Master of the Lodge of the filing of the same. And it shall be the duty of the Secretary, by order of the Master, to read such charges, so filed, in open Lodge, at the next stated meeting thereof, unless, for a good reason, the Master shall deem it advisable to have them read at a special meeting. Sec. lo. Charges, Who May Make. It is not essential that the accuser shall be a Mason. Charges may be preferred by a profane. But to further the adminis- tration of justice, it is made the especial duty of the Junior Warden, in the absence of other accusers, to prefer charges for an offense committed when the Lodge is not at labor; but the neglect or the refusal of the Junior Warden to perform such duties will not prevent any other member from preferring and prose- cuting any charges for an offense committed, which, mav come to his knowledge. Sec. II. riaster, Duty of. When Charges are Filed. It shall be the duty of the Worshipful Master, when charges are filed with the Secretary, to order the same to be read and presented, either at the next regular meeting or at a special meeting of the Lodge called for that purpose. And it shall be the duty of the Worshipful Master, whenever charges are read and presented to the Lodge, to at once appoint a special meeting thereof for the purpose of the trial of the accused upon said charges. And the Worshipful Master shall also order the Secre- tary to serve said charges upon the accused, in the manner provided in Section 12 hereof, and he shall also order a citation to be issued to the accused requiring him to appear and answer said charges at the time fixed for the trial thereof. Sec. 13. Charges, How Served. It shall be the duty of the Secretary, when so ordered by the Master, to serve 36 MASONIC LAW OF SOUTH DAKOTA. on the accused, named in the charges filed with him, the citation and an attested copy of the charges, (which citation must be over his signature and the seal of the Lodge,) and in which shall be stated the time and place appointed for the trial. The service of the citation and copy of the charges upon the accused named therein, shall be in the following manner: If the residence of the accused is known, and is within thirty miles of the Lodge in which charges are filed and presented, service of said citation and charges must be made at least ten days before the time of trial. By delivering the citation and an attested copy of the charges to the accused personally, or if he cannot be conveniently found, by leaving the citation and- an attested copy of the charges at his dwelling house, with and in the presence of a member of his family, over the age of fourteen years; if the accused reside in the family of another, by leaving the citation and an attested copy of the charges with a member of such family, in which he resides, over the age of fourteen years. If the residence of the accused be at a greater distance than thirty miles from the Lodge in which the charges are filed and presented but within the State of South Dakota, then and in that case the citation and an attested copy of the charges must be deposited in the postoffice, addressed to the accused at his postoffice, or place where he gets his mail, and the postage paid thereon, at least twenty days before the time fixed for the trial. If the residence of the accused be unknown, the citation and an attested copy of the charges, must be deposited in the postoffice, addressed to the accused at his last known postoffice address, or place where he receives his mail, at least thirty days before the time fixed for the trial, and the postage paid thereon; if the accused is a non-resident of the State of South Dakota, and his residence be known, the citation and an attested copy of the charges must be deposited in the postoffice, addressed to him at his postoffice address, or place where he gets his mail, at least thirty davs before the time fixed for the trial, and the postage paid thereon. MASONIC LAW OF SOUTH DAKOTA. 37 Sec. 13. Secretary, Duty of to Retain Copy and Hake Record. The Secretary must, in all cases, retain a copy of the citation issued as provided herein, and must also keep a record of the date and manner of the service of the citation and a copy of the charges. Sec. 14. Citation, What to Contain. The citation re- ferred to in Sections 11, 12 and 13, of this Code, must be directed to the accused named in the charges filed against him, and must contain a brief statement of the nature of the charges, and must state the time and place fixed for the trial thereof, and must require him to appear and defend the charges therein referred to, and must be signed by the Secretary, and the seal of the Lodge be fixed thereon. Sec. 15. Citation and Cliarges, Who to Serve. It is made the duty of the Secretary or any other member of the Lodge, under the direction of. the Master, to serve the citation and charges upon the accused; and the person so serving the same must certify the time, place and manner of the service thereof. Sec. 16. Appearance, How. In proceedings upon charges for un-Masonic conduct, the appearance of the accused shall be in one of the following methods: 1. By his personal appearance at the time and place stated in the citation for the trial. 2. By the authorized appearance for him of any Master Mason in good standing, at said time and place. 3. By his written communication, or that of his counsel, filed with the Secretary, at any time before or at such meeting, in which he may state his objection to the charges, or any one of them, or his plea of guilty or not guilty, or state any other matter of defense, or any explanation or extenuation of the offense charged. Sec. 17. Charges, Objections to. The accused may file with the Secretary written objections to the charges filed against him, or to any one of the specifications contained therein, upon the ground that the same does not state facts sufficient to constitute a Masonic offense, c^nd may also object to further proceedings being had upon such charges for the reason that the same has not been served as prescribed by this Code. 38 MASONIC LAW OF SOUTH DAKOTA. Sec. i8. Plea of Accused. The accused may enter a plea of guilty or not guilty, or may make answer to the charges, and state any matter of defense, or explana- tion or extenuation thereof. Sec. 19. No Appearance. In case of the service of the citation and charges, as provided for in this Code, and the accused fails to file with the Secretary an objection, or a plea, as provided in this Code, or if he fails to appear at the meeting to which he is notified and cited to appear, or if he appears in person or by counsel, and fails to object, or to plead in any manner, a plea of "not guilty" shall be entered by the Secretary, under the direction of the Master, and the trial of the accused upon the charges shall proceed as soon as practicable. Sec. 20. Objections, How Disposed of. All objections filed to the charges or to any specifications therein, as herein provided, shall be decided by a majority vote of the members present, at the time of the trial. Sec. 21. Objections, Effect of. If the objections to the charges or to anvof the specifications contained therein are sustained, new charges and specifications may be made, embracing the offense contained in the charges, or the specifications dismissed or set aside. Sec. 22. Trial, How Conducted. At the time of the trial the charges shall be read to the Lodge, and to the accused, if he be present, and a statement may be made, under the direction of the Master, of the sub- stance of the proof which will be adduced in support of the charges. The accused or his counsel mav also make a statement in his own behalf. Thereupon evi- dence in support of the charges may be presented, and at the conclusion thereof evidence may be adduced bv the accused in his own behalf. Rebutting evidence may also be presented in support of the charges. At the conclusion of all of the evidence, a statement mav be made under the direction of the Master of the Lodge in support of the charges. A stateinent mav also be made by the accused, or his counsel, in his own behalf. Then a closing statement may be made in sup- port of the charges. Any member of the Lodge mav also make a statement with reference to the charges or proof adduced upon the trial thereof, or any other MASONIC LAW OF SOUTH DAKOTA. 39 matter connected with the trial. When the case is ready to be submitted to the Lodg-e for its decision, the accused shall retire. His counsel shall also retire unless he be a member of the Lodge, and a vote shall then be taken upon the question; "Have the charges been sustained?" If the charges contain more than one specification, a vote shall be taken upon each specification separately. The vote shall be taken by secret ballot, and two- thirds of all the votes shall be required to sustain the charges or any one of them. Sec. 23. Punishment, Hanner of Determining Degree of. If the accused is found guilty of un-Masonic conduct, and charges against him have been sustained as herein pro- vided, the degree of punishment shall be determined by the Lodge. Punishments are of three kinds: 1. Reprimand. 2. Suspension, which is always indefinite; or 3. Expulsion. If there be different degrees of punishment for the offenses set forth in the charges, which are sustained, the Lodge shall then determine the punishment by secret ballot. The punishments stated above can be inflicted only upon a two-thirds vote of the members present, which vote shall be taken by secret ballot. The Master shall distinctly state the questions to be submitted and voted upon before a vote is taken. The Secretary of the Lodge shall keep a correct record of all the proceedings had and done upon the trial of the charges, including a distinct statement of the plea, answer or objections to the charges and the decision of the Lodge, and rulings of the Master upon the trial, or in connection therewith. Sec. 24. Sentences, How Enforced. When the judgment of the Lodge is reprimand, the Master shall at once proceed to administer the reproof; if the punishment be suspension, it shall remain until abrogated, as pro- vided in this Code, or in the By-Laws of the Grand Lodge. If it be expulsion, the case shall be submitted- to 40 MASONIC LAW OF SOUTH DAKOTA. the Grand Lodgeatits next Annual Communication; but the judgment and sentence shall not take effect until affirmed by the Grand Lodge, but shall, in the mean- time, operate as a suspension of the accused as a mem- ber. Sec. 25. Judgment or Decision, How Announced. J- he re- sult of every vote taken upon the trial of charges shall be announced b}- the Master and recorded by the Sec- retarv, and the Master shall also pronounce judgment or sentence, if the Lodge so decides, upon the accused, which shall also be recorded. If charges, or anv specification contained therein, are not sustained bv a vote of the Lodge, upon the trial thereof, as herein provided, the result thereof shall be stated by the Master and recorded by the Secretary, and the accused shall be released from further obliga- tion to appear and answer thereto. And no charges nor specifications therein shall be filed or presented against the accused for the same offense as is contained in those so dismissed. Sec. 26. Trials, Duties of Master. The Master presiding at the trial shall decide summarily all questions arising relating to admissibility of evidence, and shall enforce all of the requirements of this Code, the By-Laws of the Grand Lodge and the Rules and Regulations of the Order relating to trials and punishments, so far as the same mav be applicable to the case. Sec. 27. Record of Conviction for Crimes, Effect of. An ex- emplified copy of the judgment or sentence bv a court of record shall be taken and accepted as conclusive evi- dence upon the trial, for an offense specified in written charges, of all the facts and recitals therein contained. Sec. 28. Commission to Take and Report tlie Evidence May Be Appointed. Whenever written charges are presented to a Lodge it shall be competent for the Lodge, bv a majority vote, to provide for the appointment of a Com- mission, consisting of not less than three nor more than five members of said Lodge, to take and report the evidence submitted by the 'respective parties. AVhenever it is decided by the Lodge that said Commis- sion shall be appointed, it shall be the dutv of the ^Master to appoint such Commission, and it shall be the MASONIC LAW OF SOUTH DAKOTA. 41 duty of such Commission to, at once, appoint a time and place when it will hear the evidence and the allegations with reference to such charges, and to notify the ac- cused, the person or persons making the charges, and the Master of the Lodge, of such time and place, at least five days before the time fixed for the hearing. Sec. 29. Evidence, to Be Written. All of the evidence submitted and received upon all trials, upon written charges, shall be reduced to writing and filed with the Secretary of the Lodge immediately after the close of such trial. And it shall be the duty of the Secretary to at once forward the same, with a full transcript of all the proceedings had in connection with the trial, together with the sentence or finding of the Lodge with reference thereto, to the Grand Secretary. Sec. 30. Trials, WIjo Admitted Ttiereto. All trials held in Lodges upon written charges shall be held at a stated meeting of the Lodge called for that especial purpose by the Master, or acting Master, and no visitor shall be allowed to be present at such trial except witnesses and counsel for the accused; and the accuser, if he be not a member of such Lodge, except with and bv the consent of the accused. Sec. 31. Trial, in What Degree to Be Held. The Lodge shall be opened and the trials had upon the highest degree of which the accused is a member, except when a vote is taken. No vote shall be taken by the Lodge except when opened upon the third Degree. Sec. 32. Secretary Shall Report Suspension and Expulsion. It shall be the duty of the Secretary to at once report to the Grand Secretary all suspensions and expulsions, but the same shall not be published, nor be made public in any manner, without the consent of the Grand Lodge. Sec. 33. Witnesses, Who Competent. All persons who are competent to testify as witnesses under the I9.WS of the State of South Dakota shall be permitted to testify upon Masonic trials. Masons should be allowed to testify upon honor. Profanes shall be allowed to testify after having been sworn to testify the truth, the whole truth and nothing but the truth, But the Lodo-e must be called from labor during the time that a profane is present. 42 MASONIC LAW OF SOUTH DAKOTA. APPEALS. Sec. 34. Appeals— How Hade. 1. Every Mason feeling- aggrieved by the judg-mentor sentence rendered ag-ainst him, may appeal therefrom to the Grand Lodge by filing with the Secretary of the Lodge in which said judgment or sentence is rendered or made, a notice of appeal, in writing, within thirty days next thereafter, which notice shall be sufficient, if it states generally, that the person so appealing appeals from the judg- ment or sentence of the Lodge, specifying the day when the same was rendered or made, and the effect thereof, \Nhether reprimand, suspension or expulsion, as the case may be, and signed by the person appeal- ing. And it shall be the duty of the Secretary, upon receiving such notice, to at once transmit to the Grand Secretary all of the papers and files relating to the matter appealed from, and also a full and complete transcript of the proceedings of the Lodge relating to the same, as well as the evidence taken in the case, if the evidence was taken in writing. And the Secretary shall also immediately notify the accuser and the Mas- ter of the Lodge of such appeal. 2. Any Brother deeming himself aggrieved by a judgment of suspension or expulsion, or bv one refus- ing to suspend or expel, may appeal therefrom to the Grand Lodge by a notice in writing, to be filed with the Grand Secretary at least ten davs before the Annual Communication of Grand Lodge, together with copies of all papers, including transcripts of evidence, and copy of record of trial Lodge, showing action of Lodge taken at every step in the case. RESTORATION. Sec. 35, Restoration, Petition For, All persons under sen- tence of expulsion are in nowise to be considered or regarded as Masons, and cannot become members of the Order except upon petition to the Lodge from which they were expelled; and the petition of such expelled person shall take the same course as an application of a candidate for the Degrees; and if such applicant is admitted he must be re-obligated, MASONIC LAW OF SOUTH DAKOTA. 43 OFFENSES COMMITTED IN OPEN LODGE. Sec. 36. Offenses Committed in Open Lodge, How Dealt With. In every case where a Masonic offense is committed in open Lodg-e, no written charg-e or citation shall be necessary to give the Lodge jurisdiction, but jurisdic- tion at once attaches, and the facts constituting the offense shall be briefly stated by the Secretary in the proceedings by order of the Master. The Master shall thereupon direct the member to show cause at once why he should not be punished for such offense. If no showing is made, the Lodge shall proceed to fix the punishment. If a showing is made by the accused, the same shall be proceeded with summarily, at the conclusion of which the Master shall state the question to be determined by the Lodge as follows: "Brethren, shall the Brother be excused?" The answer shall be by ballot, with the words "Yes" and "No," and a majority vote shall decide. If not excused, punish- ment shall be imposed. The accused Brother shall retire before the taking of such vote. The degree of punishment shall be determined by the Lodge in the same manner as provided for in cases of trial upon written charges. (Note. The usual Masonic offenses committed in open Lodge are: Appearing in a state of intoxication. The use of profane language. Quarreling; and other un-Masonic conduct.) JURISDICTION OF GRAND LODGE OVER MASONIC OFFENSES. Sec. 37. Exclusive. The Grand Lodge of South Dakota shall have exclusive jurisdiction to receive charges, hear, try and determine the same, filed or made against Masters of Lodges, and elective Grand Lodge Officers during their term of office; and for such purpose the Procedure, Rules and Regulations providing for charges, trials and punishment in Lodges shall govern and apply to the Grand Lodge, in such cases, so far as practicable. 44 MASONIC LAW OF SOUTH DAKOTA. Sec. 38. Jurisdiction of Appeals. In all cases of appeal to the Grand Lodge, and in all cases of expulsion where no appeal has been taken, the Grand Lodge has juris- diction over the whole case, and may, upon investiga- tion — 1. Confirm the finding and sentence of the Lodge. 2. Dismiss the appeal; whereupon the sentence, if suspension, remains in full force; if expulsion, the sentence goes into immediate effect. 3. Reduce the sentence from expulsion to that of suspension; in which case theoriginal sentence becomes void and that of the Grand Lodge is substituted. 4. Set aside the proceedings for good cause and remand the case back for a new trial. 5. Set aside the punishment as inadequate, and remand the case for further consideration; in which case the Blue Lodge will review the sentence, inflicting the punishment only, and not retry the case. 6. Reverse the decision of the Blue Lodge, for good and sufficient reasons, and decree the restoration of the appellant to the rights and privileges of Masonry and to membership in the Lodge. Sec. 39. Commission to Take Evidence, nay be Appointed. A commission to take the evidence may be provided for bv a majoritv vote of the Grand Lodge, the same to be named bv the Grand Master, not to consist of less than three nor more than five persons, to take the evidence whenever charges are filed with the Grand Secretarv against any person over whom the Grand Lodge has exclusive jurisdiction. Sec. 40. Commission to Take Evidence, Duties of. It shall be the dutv of the commission appointed as provided for in Section 39 to give at least ten davs' notice to the accused and to the accuser and to such other persons as may be considered necessary, of the time and place when the evidence will be received and taken upon the charges. It shall be the duty of said commission to reduce all of the evidence taken to writing, and to make a report to the Grand Lodge their findings of facts thereon, but said commission shall have no power to fix sentence or impose punishment. MASONIC LAW OF SOUTH DAKOTA. 45 Sec. 41. Charges, How to be Withdrawn. Written charges may be withdrawn with the written consent of the accused and accuser or accusers, if he or they, as the case may be, be a Mason, but not otherwise. If the accuser or accusers be profane' or profanes, his or their consent shall not be necessary for such with- drawal. Sec. 42. Restoration for Non-payment of Dues. Whenever a member is suspended for non-payment of dues, he may be restored to membership as provided for in Sec- tions 102 and 103, Grand Lodge By-Laws. FORMS. I. Petition for Initiation. To the Worshipful Master, Wardens and Brethren of Lodg-e, No. -.-, A. F. & A.
