No account shall be audited by any "Board of Town Auditors, or Supervisors, or Superintendent of the Poor, for any services or disbursements, unless such account shall be made out in items and accompanied with an affidavit attached to, and to be filed with such account, made by the person presenting or claiming the same, that the items of such accounts are correct, and that the disbursements and services charg'ed therein have been in fact made or rendered or are necessary to be made or rendered at that session of the board, and stating that no part thereof has been paid or satisfied ; and the chairman of the board or either of the superintendents may administer any oath re- quired under this section. (Town Law, Sec. 175 ; substantially same as County Law, Sec. 24.) Each clerk of a court must perform all the duties required of him in the course and practice of the court, without fee or reward, except as expressly prescribed by law. (1) Each public officer, upon whom a duty is expressly imposed by law, must execute the same without fe© or reward, except where a fee or other compensation therefor is expressly allowed by law. (2) An officer or other person, to whom a fee or other com- pensation is allowed by law, for any service, shall not charg-e or receive a greater fee or reward, for that service, than is so allowed. (Judiciary Law, Sec. 252. Pub. Off. Law, Sec. 67.) (3) An officer, or other person, shall not demand or receive any fee or compensation, allowed to him by law for any service, unless the service was actually rendered by him ; except that an officer may demand in advance his fee, where he is, by law, expressly directed or permitted to require payment thereof, before rendering the service. (Public Officers Law, Sec. 67.) 4 WILLIAMSON'S DIGEST OF FEES. An officer or other person, who violates either of the pro- visions contained in this section, is liable, in addition to the punishment prescribed by law for the criminal offense, to an action in behalf of the person aggrieved, in which the plaintiif is entitled to treble damages. A public officer, or his subordinate, who shall ask, receive, or agree to receive, any gratuity or reward, except such as may be authorized by law, shall be guilty of a felony, punishable by imprisonment for not more than ten years or by a fine of not more than $4,000 or both. May be taken within this state before a Justice of the Su- preme Court, anywhere within the state; or within the district wherein such officer is authorized to perform official duties, before a judge, clerk, deputy clerk or special deputy clerk of a court, a notary public, or the mayor or recorder of a city, a justice of the peace, surrogate, special surrogate, special county judge or commissioner of deeds, or by a justice of the peace anywhere in the county containing the city or town in which he is authorized to act. (Eeal Property Law, Sec. 298.) For administering an oath or affirmation and certifying same unless otherwise provided $ .12 For taking and certifying the acknowledgment or proof of the execution by one person .25 For each additional person .12 For swearing each witness thereto .06 (Code Civ. Proc, Sec. 3298.) -'S ADJUTANT GENERAL. The adjutant general shall be appointed by the governor. He shall hold office at the pleasure of the governor and his com- mission shall expire with the term of the governor appointing him. (Military Law, Sec. 16.) He shall be paid an annual salary of $ 7,500.00 He shall be allowed annually $15,300.00 or as much thereof as may be necessary for the salaries of four assistants and one store keeper. He and his assistants shall be allowed the necessary office expenses and traveling expenses and subsistance when traveling on duty. (Military Law, Sec. 19.) 6 WILLIAMSON'S DIGEST OF FEES. ADMINISTRATORS. (Also Executors and Guardians.) Shall receive for receiving and paying out moneys, not exceeding $1,000 5 % For the next $10,000 2^% Exceeding $11,000 1 % In all cases, reasonable allowance for actual expenses. If the value of the personal property amounts to $100,000, over all debts, each executor or administrator is entitled to full compensation allowed herein to a sole executor or administra- tor, unless there are more than three, in which case the com- pensation, to which three would be entitled, must be apportioned among them according to the services rendered by them respec- tively, and a like apportionment shall be made in all cases where there shall be more than one executor or administrator. If will provides for a specific compensation, it may be re- nounced in writing within four months, and compensation claimed as above. (Code Civ. Proc., Sec. 2753.) The County Treasurer when acting as public administrator is allowed the same fees as are allowed by law to administrators, in addition to the salary and fees allowed to him as county treasurer. (Code Civ. Proc, Sec. 2593.) In a proceeding to sell real estate, the executor, administra- tor or freeholder must be allowed his expenses and commissions, and such further sum as the surrogate thinks reasonable and a reasonable allowance for the services of his attorney. (Code Civ. Proc, Sec. 2749.) An administrator required by law to give a bond as such may include as part of his lawful expenses such reasonable sum, not exceeding one per centum per annum upon the amount of such bond, paid his sureties thereon, as such court or judge allows. (Code Civ. Proc, Sec. 3320.) ADVERTISEMENTS. (Legal.) The town board of any town may by resolution fix the com- pensation of assessors at more than $3.00 but not more than $5.00 for each day's service. When the assessed valuation in any town exceeds $20,- 000,000 the town board may vote a salary of not ex- ceeding per annum $1,000 In the comity of Xassau the assessors are entitled to, per day $3.00 In the county of Monroe the assessors are entitled to not less than $3.00 or more than $5.00 per day as determined by the town board. In Nassau County in towns having a population of 17,000 or more the town board may fix an annual salary not exceeding $1,200 ASSESSORS. 11 In towns "with assessed valuation exceeding twenty million dollars, the town board may determine that compensation of assessors shall not exceed $1,000 per year. (Town Law, Sec. 85.) For attendance at conference with state tax commis- sioner within county, for each day $4.00 Mileage, both ways 08 (County Law, Sec. 241-a.) ASSIGNEES. (Trusts and Trustees.) Of non-resident, absconding, insolvent or imprisoned debtors are entitled to deduct out of moneys in their hands all necessary disbursements, and a commission on the whole sum which will have come into their hands at the rate of (Dr. and Cr. Law, Sec. 187) 5% Tor benefit of creditors (Dr. and Cr. Law Sec. 26) .... 5% But if the total amount of percentage shall not equal $100 the Court may grant siieh a sum, as which with such percentage shall equal $100. May be allowed for official bond. (Code Civ. Proc, Sec. 3320) 1% ASSIGNMENT. The assignee or assignees in any assignment shall receive for his or their services not to exceed 5% of the whole sum that comes into his or their hands, iinless such sum does not amount to $1,000.00, in which case the court shall allow such additional sum as shall with such percentage equal $200.00. If assignee continues the business, the court may allow addi- tional compensation. Actual and necessary expenses of assignee may be allowed by <50urt. (Dr. and Cr. Law, Sec. 21.) ATTACHMENT. Attendance officers appointed for Indian Schools shall re- ceive such sum per day necessarily employed as shall be fixed by the Commissioner of Education. (Educ. Law, Sec. 954.) ATTORNEY GENERAL. To consist of the Supervisors, Justices and Town Clerk. For each day's sei's'ice performed, by each $2.00 (Town Law, Sec. 85.) Towns, on request of twenty free-holders, may vote to elect town auditors. (Town Law, Sec. 150.) The following fees shall be paid to the Secretary of State upon the registration or re-registration of a motor vehicle : Twenty-five horse power or less $5.00 Twenty-five, but less than thirty-five horse power 10.00 More than thirty-five but less than fifty horse power . . . 15.00 Fifty or more horse power 25.00 If vehicle is originally registered after Augiist 1st, then the registration fee for that year will be one half the above fee. Does not apply to state, city, or countv owned vehicles. (Highway Law, Sec. 282," Sub. 6.) AUTO OMNIBUSES. Motor vehicles used as omnibuses for the transportation of passengers shall pay an annual fee as follows: Vehicles seating five passengers or less $] 5 . 00 Vehicles seating not less than six, nor more than seven 24.50 Vehicles seating not less than eight, nor more than ten 30.50 Vehicles seating not less than eleven, nor more than six- teen 43.00 Vehicles seating not less than seventeen, nor more than twenty 52.00 Vehicles seating not less than twenty-one, nor more than twenty-two 55.00 Vehicles seating not less than twenty-three, nor more than twenty-six 61.50 Vehicles seating not less than twenty-seven, nor more than thirty 67.50 In excess of thirty passengers an additional fee of $2.00 for each additional passenger, as measured by seating capacity. If vehicle is not originally registered until after August first, then the fee shall be one half the above for that year. 14 WILLIAMSON'S DIGEST OF FEES. Shall not apply to omnibuses operated pursuant to a fran- chise over streets wholly within a municipality. An omnibus operated within a municipality exclusively un- der a franchise shall pay without regard to seating capacity an annual fee of $10.00. If not originally registered prior to August first, the fee shall be one half the above. AUTO TRUCKS. Motor vehicles used for the transportation of goods, wares and merchandise shall pay the following fees based ou the combined weight and carrying capacity : Two tons or less $10.00 More than two tons, but not more than three 15.00 More than three tons, but not more than four 20.00 More than four tons, but not more than five 25.00 More than five tons, but not more than six 30.00 More than six tons, but not more than seven 35.00 More than seven tons, but not more than eight 40.00 More than eight tons, but not more than nine 45.00 More than nine tons, but not more than ten 50.00 More than ten tons, but not more than eleven 55.00 More than eleven tons, but not more than twelve .... 60.00 More than twelve tons, but not more than thirteen . . . 65.00 More than thirteen tons, but not more than fourteen . . 70.00 For each vehicle with a combined weight and carrying capa- city in excess of fourteen tons an additional fee of ten dollars for each ton in excess of fourteen tons. See Constables; also Code Civ. Proc., Sec. 3323. See Witnesses ; also Code Civ. Proc., Sec. 3327. BOARD OF COUNTY CANVASSERS. Consists of the Board of Supervisors of the County. In the counties vfithin the City of New York the Board of Canvassers shall consist of the members of the Board of Alder- men of the City of New York, elected as such within the coun- ty. Said board shall also be the city board of canvassers of such city. In the City of Buffalo the Board of Aldermen shall be the city board of canvassers of such city. The county board of canvassers of a county containing a city or cities shall be the city board of canvassers of such city or cities. The County Clerk, or in his absence or if unable to act, the Deputy County Clerk shall be Secretary of the Board, in all counties except Erie; in Erie County the Commissioner of Elections. (Election Law, Sec. 430.) Supervisors : Each full day's pay $4.00 Except in counties of Albany, Columbia, Dutchess, Erie, Herkimer, Montgomery, Niagara, Oneida, Onondaga, Orange, Rensselaer, Eockland, Saratoga, Schenectady, Steuben, Suffolk, Ulster, and Westchester. In cities, except cities of the first and second class, consist of mayor, and at least six persons (one a physician) appointed by the Common Council. In villages, consists of board of trustees. In towns, consists of Town Board. Every such board shall appoint a competent physician, not one of its members, to be the health officer. (Pub. Health Law, Sec. 20.) Fees of health officer and other persons employed by, fixed by the board. (Id. Sec. 21.) Every such board shall complete the registration of all births and deaths, the cause of death and findings of coroner's juries. Making and delivering certificate of birth or death .... $ .25 For registration of same (to be paid by municipality) not exceeding .25 Fee for copy, certified to 1.00 If no birth or death has occurred, he shall receive for such report .25 For every burial, removal or transit permit issued by him 25 (Id., Sec. 390 and 391.) Health ofiicer in villages and towns to report, in writing to State Department of Health promptly, all cases of infectious or contagious diseases as required by said board. For reporting each case, a sum not exceeding $ .25 (Id., Sec. 25)— See Vital Statistics. Each member of board of health in each of the towns in Orange and Rockland counties shall be paid for each day's attendance at meetings of board $3.00 Mileage going and returning 10 (Town Law, Sec. 586.) BOARD OF PRISONERS. Board of Supervisors may make an agreement with the Board of Supervisors of any other county having a penitentiary therein, or with any person in their behalf by them appointed, for the board of prisoners sentenced thereto for not less than 60 days. Notice shall be published stating terms of contract BOARD OF PRISONERS. 17 in not less than two newspapers for not less than four weeks, as the board shall direct. (Prison Law, Sec. 320.) For fees for conveying. Debtor arrested on execution. Keeping, if in house other than jail, expense of person in custody ; but if he makes oath that he is unable to support him- self, support is a county charge. Code Civ. Proc, Sec. 110. (County Law 240, Prison Law 342.) BOATS. See Inspection of Passenger Vessels. BOUNTIES. Boards of Supervisors have power to make laws and regu- lations for destruction of wild beasts and weeds. (County Law, Sec. 12, Subd. 7.) CATTLE LAW. Not lawful to run at large in any public place. (Code Civ. Proc, Sec. 3082.) If plaintiff recovers justice must allow him, besides the cost of the action : For each horse, colt, ass, mule, swine, bull, ox, cow, or calf ; $5.00 For each sheep or goat 1.00 (Code Civ. Proc, Sec 3083.) If such running at large is caused by the wilful act of another than the owner, the owner may collect of such person, in addition to other costs, for each animal seized $20.00 (Code Civ. Proc, Sec 3099.) CIVIL SERVICE, The Governor by and with the consent of the Senate, shall appoint three commissioners who shall constitute the State Civil Service Commission. Each commissioner shall receive in addition to his necessary expenses an annual salary of $5,- 000.00. The chief examiner shall be paid, in addition to his neces- sary traveling expenses, per annum, $3,600.00. One half of which shall be paid by the state and the other half by the county or city in which such district located. (Liquor Tax Law, Sec. 6.) The State Commissioner of Excise shall appoint not mor& than 60 agents who shall receive an annual salary for the first year of $1,000.00, for the second year, a salary of $1,250.00, and thereafter an annual salary of $1,500.00, in addition to actual expenses, or in his discretion the State Commissioner of Excise may fix a per diem allowance for subsistence of not more than $3.00 nor less than $1.00 per day together with such neces- sary expenses as may be incurred provided that no such per diem allowance for subsistence be paid for any day or days when agent is engaged in official work in the place of his resi- dence. COMMISSIONER OF HIGHWAYS. See Highway Commissioners. Salary not exceeding per year $10,000 (Highway Law, Sec. 11.) COMMISSIONER OF JURORS. In counties where a Commissioner of Jurors is ap- pointed, having a population of less than 100,000, the salary of such commissioner is fixed by the board of supervisors, except in the counties of ISTas- sau, Niagara, Saratoga, Herkimer and Scheneta- dy, where it shall be fixed by the board which makes the appointment, not exceeding $1,200.00 In counties of over 100,000 and not more than 150, 000 the annual salary is fixed by statute at 1,500.00 In counties of more than 150,000 and not more than 300,000 the annual salary is fixed by the board of supervisors not exceeding 3,000.00 (Laws of 1899, ch. 441, Sec. 4.)
