His "Treatise on Insurance very far surpasses all preceding works in the extent, value, and practical application of its principles. He professedly carried his researches into the antiquities of the Maritime Law, and illus- trated the Ordinances, by what he termed the Jurisprudence of the Tribunals ; and he discussed all incidental questions so as to bring within the compass of his work a great portion of International and Commercial Law connected with the doctrines of Insurance. In the language of Lord Tenterden, 'no subject in Emerigon is described without being exhausted,' and the eulogy is as just as it is splendid. Emerigon was a practical man who united exact knowledge of the details of business with manly sense and consum- mate erudition. He was a practising Lawyer at Marseilles for perhaps forty years. The Public Statutes and the Judgments of the various Courts are quoted by the dates of the Kings' reigns. A Table of Eegnal Years, showing the commencement and termination of each reign, is therefore given. This Table is calculated according to the common and historical year, viz. — from the 1st of January j but the civil, ecclesiastical, and legal year for a long period began differently. Until the end of the 13th century it began at Christmas. In and after the 14th century it commenced on the 25th of March, and so continued, till, by Statute 24 Geo. II, cap. 23, (1751,) it was ordered to commence on 1st January 1753. Remarkable examples of the confusion produced in consequence of this, are afforded by two of the most celebrated events in English history. King Charles I is said by most authorities to have been beheaded on the 30th January 1648 ; while others, with equal correctness, assign that event to the 30th January 1649. The Revolution which drove James II from the Throne is stated by some writers to have taken place in February 1688 ; while, according to others, it happened in February 1 689. These discrepancies arise from some historians using the civil and legal, and others the historical year, though both would have assigned any circumstance happening between the 25th March and 31st December to the same years — namely, 1649 and 1689. To avoid, as far as possible, the mistakes which this custom produced, it was usual, when speaking of any day between the 1st of January and the 25th of March, to add the date of the historical to that of the legal year ; thus : — 8 i. e., the civil and legal year. This practice is frequently misunderstood; and even learned and intelligent persons are sometimes perplexed by dates being so written. The explanation, how- ever, is perfectly simple, for the lower, or last figure, always indicates the year accord- ing to our present computation. See the following work : — 640. The year was ordered to com- mence on the 1st January instead of the 25th March 1600 by a Proclamation dated \he 17th December 1599. The Julian, or Old Style, was used in both countries till the foresaid Statute 24 Geo. II, c. 23, (1751). The difference between the OldsLud. New Style up to 1699 was only ten days ; after 1700 it was eleven days ; and after 1800 twelve days j so that the 1st January 1800 of the Old, corresponds with the 13th January 3 800 of the -New Style. LAW (James Thomas.) — Forms of Ecclesiastical Law; or the mode of con- ducting Suits in the Consistory Courts ; being a Translation of the First Part of Oughton's Ordo Judiciorum, with large additions, from Clarke's Praxis, Conset on Practice, Ayliflfe's Parergon, Cockburn's Clerks' Assistant, Gibson's Codex, constituting a succes- sion of feus. On the death of the vassal, his heir must enter with the superior and make up a feudal title to the lands. This is different in England, where mortuus sasit vivum. Rights in land must be constituted by sasine, {nulla sasina, nulla terra,) and the sasines must be recorded in the Registers of Sasines. Farther, all deeds creating real burdens on land must be recorded in the same Registers ; and pre- ferences are determined by the priority of recording. The state of every landed property in Scotland can be ascertained with perfect accuracy by a search of these records, which thus afford complete security to persons transacting, whether as pur- chasers, lenders on bond or mortgage, &c. There are no separate Courts of Law and of Equity in Scotland as in England. The Courts are Courts of Equity as well as of Law. There are four Supreme Courts in Scotland, — three Civil and one Criminal ; and there are Inferior Courts, most of which exercise a criminal as well as a civil juris- diction. The Court of Session, Teind Court, and Court of Exchequer, are the Supreme Civil Courts. The Court of Justiciary is the Supreme Criminal Court. All the other Courts in Scotland are Inferior Courts. There was formerly a Court of Admiralty/ in Scotland. It had a jurisdiction both civil and criminal. In civil matters its jurisdiction extended to all maritime causes ; and in criminal matters the High Admiral acted as the King's Justice-General upon the seas. By 6 Geo. IV, c. 120, sec. 57, its jurisdiction in questions re- lating to prizes and captures in war, and the condemnation of vessels, was transferred to the High Court of Admiralty in England. By 1 William IV, c. 69, the Court of Admiralty was abolished, — its civil jurisdiction was transferred to the Court of Session and to the Sheriff-Courts, and its criminal jurisdiction to the Court of Justiciary and the Sheriff-Courts. There was also a Supreme Oonsistorial Court in Edinburgh, which exercised juris- diction over the whole of Scotland; and there were Inferior Consistorial Courts in the Counties. These were termed Commissary Courts. The Commissary Courts were anciently the Courts of the Commissaries or Delegates of the Clergy. The Com- missaries had an exclusive jurisdiction in consistorial cases, such as questions con- cerning the constitution and dissolution of marriage, separation a mensd et thoro, 172 XX. LAW OF SCOTLAND. and the confirmation of testaments. These Commissary Courts underwent many alterations by various Statutes. But by 4 Geo. IV, c. 97, 1 Will. IV, c. 69, and 6 & 7 Will. IV, c. 41, they were abolished, and their jurisdiction, so far as regards actions and suits, transferred to the Court of Session and Sheriflf-Courts. Adminis- tration in regard to testate and intestate succession is vested in the Sheriffs of the Counties, where the deceased persons had their domicile, as Commissaries in said Counties ; and in the Sheriff of Edinburgh, when they die furth of Scotland. I. — SUPREME COURTS. 1. TJie Court of Session. Originally, in Scotland, there was no permanent Supreme Court of Justice. Com- mittees were appointed by the three Estates of the Kingdom to sit on Appeals from Inferior Courts, ' super Judiciis contradicfis.' In the Parliament held at Perth on 18th February 1369, a Committee was appointed ' ad ea que concernunt communem 'justiciam,' viz. — Appeals, and Pleas and Complaints, which, of right, ought to be decided in Parliament. Each successive Parliament appointed its Judicial Com- mittee, or Dominos ad causas et querelas, who not only exercised an appellate juris- diction, but decided causes in the first instance. Their jurisdiction is in no respect distinguishable from that of the King's Council. In 1467 it was ordered by Parlia- ment ' that all Summondis and Causis that is left undecided in this Parliament sal ' be decidit before the Lords of Counsaile ;' and accordingly, causes that commenced in the one Court frequently were disposed of in the other. The proceedings of the Judicial Committee of Parliament are printed in a separate volume, embracing the reign of James III and James IV, under the Title oi Acta Dominorum Auditorum ad causas et querelas audiendas electorum 1466-1494, {Vide No. 1507, infra). The parallel Judicial proceedings of the Lords of Council are also comprised in a volume entitled Acta Dominorum Goncilii', 1478-1495, {Tide No. 1508, infra'). See on this subject. Preface to Thomson's Edition of the Acts of Parliament, Noi 1483, infra, pages 11 and 12. The Court of Session was at last established in 1532 after the model of the Parlia- ment of Paris. It consisted originally of fifteen Judges, (seven Churclimen, seven Laymen, and a President, also a Churchman,) who aat in one Court. It now consists of thirteen Judges nominated by the Crown, called Senators of the College of Justice, viz. — The Lord President, the Lord Justice-Clerk, and eleven other Lords. The Lord President and three Lords form the First Division ; the Lord Justice-Clerk and three Lords form the Second Division. These two Divisions have co-ordinate jurisdiction, and three Judges in each are a quorum. The remain- ing five Lords are called Lords Ordinary, and each officiates by himself in separate chambers in the Outer (Court) House. AH litigated cases are first brought before one or other of the Lords Ordinary, and the party bringing the suit has the power to select the Lord Ordinary and the Division. The Judgments of the Lord Ordinary are subject to the review of the Division so selected. Tbe Lords Ordinary, from sitting in Chambers in the Outer-House, are called Outer-House Judges ; while the Lords of the two Divisions, who sit in two Inner-Houses, are termed Inner-House Judges. The Court of Session has an almost universal jurisdiction in civil causes. In one class of causes its jurisdiction is exclusive of all Inferior Jurisdictions, such as declarators of real property, competitions of heritable rights, provings of the tenor. XX. LAW OF SCOTLAND. 173 reductions of decrees or of writings, and all other rescissory actions, judicial sales of the estates of minors and bankrupts, &c. In another class of causes, such as advoca- tions and suspensions, the Court exercises an appellate jurisdiction in reviewing the judgments pronounced by the Inferior Courts. In all civil actions which fall under neither of these classes, the' jurisdiction of the Court of Session is concurrent with that of the Judge Ordinary (of the bounds, viz. — ^the Sheriff of the County, or the Magistrates of the Royal Burgh, where the case occurs), unless otherwise declared by Statute. This Court has also power to set aside or suspend the sentences of all Inferior Courts in civil causes, unless expressly excluded by Statute ; and it can review its own Judgments by way of Suspension and Reduction. Its Judgments are subject to review by the House of Lords only. The Court of Session, as a Court of Equity as well as of Law, frequently exer- cises an equitable jurisdiction, by giving aid to those who could have no remedy by strict Law. This power, which is called the nobile officium, is inherent in the supreme judicatory of every State, unless separate Co^urts are established for law and equity, as in England, where the Court of Chancery modifies the strict proceedings of the Courts^ of Common Law. The Court of Session has also a criminal jurisdiction in certain cases, which, how- ever, is rarely exercised. Bill Chamber, — The jurisdiction of the Court in regard to all summary matters of possession, such as Interdicts, Suspension of Diligence, &c., is exercised by the Lord Ordinary on the Bills. During Session the junior Lord Ordinary ofHciates as Ordi- nary on the Bills, and in vacation the oflSce is exercised by those of the Judges who are not Justiciary Judges, in rotation, each for a fortnight at a time. Applications for the sequestration of the estates of bankrupts, under the Bankrupt Statute, are made to the Lord Ordinary on the Bills, and all applications to the Court, which are competent, during vacation, are made to said Lord Ordinary. The Interlocutors of the Lord Ordinary on the Bills are subject to review of the Inner-House by Reclaiming Note. Jurff Trial. — Trial by Jury existed at an early period in Scotland, and it formed part of the ordinary procedure both in the Civil and Criminal Courts ; but after the institution of the Court of Session in 1532, it fell into disuse in the Civil Courts. By 55 Geo. Ill, c. 42, (2d May 1815,) Trial by Jury in civil causes was again introduced. By the 59 Geo. Ill, c. 55, its sphere was considerably enlarged, and it was^ further enlarged and altered by 6 Geo. IV, c. 120. Under those Statutes the trial was con- ducted in a separate Court, having Judges and OEScers peculiar to itself. But by 1 Will. IV, c. 69, this separate establishment was done away, and Trial by Jury in civil causes united with, and declared to form part of, the ordinary administration of justice in the Court of Session. By 13 & 14 Vict., c. 36, important changes were introduced. The Lord Ordinary, before whom the cause depends, is appointed to preside at the trial, when such trial takes place during Session. The Lords Ordinary are empowered to try special facts without a Jury, and without adjusting an Issue ; and, of consent of parties, to try Issues in any cause without a Jury ; and of con- sent of parties, the Issue in any cause may be tried before the Lord Ordinary or the Court, by any one arbiter, or by any three, five, or seven arbiters, sitting as a Jury. Trials generally take place in Edinburgh, where, during Session, the Lords Ordi- nary try the causes respectively depending before them, — and during vacation the 174 XX. LAW OF SCOTLAND, Lord President and the Lord Justice-Clerk try the causes helonging to their respec- tive Divisions. For the convenience of parties, however, civil causes are frequently appointed to be tried at the Circuit Towns, either by one of the Judges of the Court of Session, specially authorised to do so, or by one of the Justiciary Judges on Circuit. Jury Trial has, from time immemorial, been the regular and constitutional mode of trial in the Court of Justiciary. It is now also the ordinary mode of trial in all im- portant criminal cases in the Sheriff-Court. In civil Jury Causes, in Revenue cases before the Court of Exchequer, and in cases of High Treason, the number of the Jury is twelve. In cases of High Treason the Jury are required to be unanimous in their verdict. Until recently the Jury were also required to be unanimous in Civil cases; but, by 17 1790.
