FOREWORD
The New Brunswick Historicai, Club, at its Annual Meeting
held Thursday, December 19, 1912, authorized the publication of the
first Charter of the City of New Brunswick, bearing date December 30,
1730, together with Ordinances thereunder enacted. Manuscript copies
of Charter and Ordinances, defective in part, are in the possession of
the Club. The copy of the Charter lacks only a word or phrase here
and there, the manuscript having been worn by repeated folding. The
mianuscript copy of the Ordinances is worn in places and has lost the
outer folios which contained the text of the Ordinances of the first year
or eighteen months of the city government and those enacted after Janu-
ary 15th, 1750. The titles of the earliest ordinances are, however,
probably all preserved in a subsequent repetition.
The date of the first meeting of "The Mayor, Recorder, Aldermfen
and Commonalty of the City of New Brunswick" seems to have been
March 16, 1731.
The editor has thought proper to reprodtice, as far as possible in
print, the spelling, punctuation (or lack of it), use of capitals and
other peculiarities of the manuscript inasmuch as it appears to have been
the copy officially prepared. The mis. copy tho continuous in form is
probably incomplete since for examlple it contains no record of acts of
Common Council between the dates, Dec. 24, 1735, and Oct. 18, 1737.
The first half of the eighteenth century supplie!d many elements to
the political deveilopment of the American Colonies. One phase of de-
velopment during this period, the forming of cities, was not the result of
necessity, for the growing density of population did not then demand
them, and the movement is therefore to be attributed to some other gen-
eral and perhaps more conscious piuirpose. That it was a real movement
having essential unity in its causes is evident from the fact that theise
cities were all in the middlemost of the COilonies. A straightened belt
aliout six miles in width, stretching from the border of New York
across New Jersey into Pennsylvania, just before 1750, would have
touched all the city organisms of the country, save Albany to the north
and Annapolis to the south, which we may perhaps compare to the
clasps on Uhis girdle. This confining of the movement to the middle of
the coast strip gives it definiiteness of character, for neither in all New
England nor in the farther south was there any attempt to organize
cities until after national independence had come.
On the 4th of August 1718, Perth Amboy was incorporated by
royal charter as a city; New Brunswick on the 30th of December, 1730;
a little more than two years later, Burlington, on the 7th of May; on
the 8th of February, 1739-40, Elizabeth, and on the 6th of September,
1746, Trenton received borough charters with essentially city func-
tions. The Philadelphia city charter was granted in 1691 and this was
modified and renewed by Perm ten years later. Annapolis was made a
city in 1708 by royal charter. New York and Albany had received
charters from Governor Dongan in 1686, but New York, from the fear
that the city was never legally lincorporated (because its former charter
was given in the name of the governor iristead of the king) asked and
received, on the 15th of January, 1730-31, two weeks after the grant to
New Brutiiswick, the royal charter, by which it was governed for a
■ century.
Middlesex in New Jersey was the only county in America con-
taining two cities.
The historic significance and value of this assumption of the city
form of municipal organization, so marked in the middle colonies has
been analyzed and emphasized in a palper on "The Early Cities of New
Jersey," read before the State Historical Society and printed by that
Society in its Proceedings for 1887.
Up to the preseM time the editor has come upon no copy of a for-
mal grant to New Brunswick of political organization prior to Deecmber
30, 1730, the date of the Royal City Charter, but the community seemis
to have been considered a separate political entity in the years just pre-
vibu's to that date as is evident in the list of noteworthy events in its
history given herewith in an appendix.
The dditor takes occasion on behalf of the New Brunswick His-
torical Club to express its thanks to those who have generously borne
the expense incident to the publication of this pamlphlet. Their names
appear in the appendix. To Wliliam H. Benedict, Esq., are also due
the thanks of the Club and of the present editor for the aid he has
given in the preparation of the list of early events in the history of New
Brunswick.
Chancellor Kent writing in 1836 in his edition of New York charters
(pages 216, 217) says: "The legislative powers of the Common Council
assume a very grave importance wihen we consider that their ordin-
ances afifect, much more than the whole legislaition of the State, the in-
finitely diversified details of comm!on business and the ordinary security
and comforts of domestic life."
The senitiments expressed on the first corporate seal are still cher-
ished by the grateful and loyal citizens of New Brunswick. On the
right of the seal the goddess of Agricultural bounty is represented by a
sheaf of wheat alongside a pair of scales and her mbtto reads "Alma sed
Aequa," signifying, "kindly but just" ; on the left side appears a ship
riding at anchor in the Raritan, typifying Commerce. Her word is
"Laeta revertor" , which may be freely rendered "I am glad to return
home."

to be done to be recovered by action of Debt before any
one Magistraite of this City one third of which penalty to
be pd to the informer ye other two-thirds to ye Treasurer

monaility shall think fit and for ye better Regulating and
paving the sd Streets as aforesd it is hereby further or-
dained that Jacob Ouke and Wm Cbx axe appointed in-
spectors to Lay out order and Direct the sd Pavemt and

City and liberties thereof the Sum of twenty pounds
money at 8 p. oz towards the support of the poor & use of

said City who is hereby Ordered to pay the Same into
the hanlds of the IVeasurer on or before ye first day of
May niext follow'ing for the use oif the poor and Corpora-
tion to be Drawn out by Warrents from the Mayor Re-
corder and two Alidermen which Warrts shall be suffi-
cient Discharge ftom the said Treasurer for so much

A Law for Regulating Indian Negro or MuUatto Slaves
In the Night Time.
Be itt Ordained by the Mayor Recorder and Aldermen
(&) Assistants In Common Council 'Convened and it is
hereby Ordained by the authority of the Same that from
henceforth No Indian or Mullatto Slave or Negro above
the age of fourteen do presume to be or apear in any of
the StreetJs of this City in the Night Time after Nine of
the Clock att Night and that if any Indian or Mullatto
Slave or Negro Slave or Slaves as aforesaid shall be
found in the Streets after the hours aforesaid without a
certificate from their Masters or Mistresses or a lanthorn
with a lighted Candle in itt so as the light thereof may
plainly appelar that then and in such case itt shall and may
be lawfull for any of bis Majesties subjects within this
City to ajprehend such Slave or Slaves not having a certifi-
cate or Ijantborn with a lighted Candle in itt and forth-
with Carry him her or them to the Goale Keeper of Said
City who is hereby authorized and commanded to put
such Slave or Slaveis into the Common Goale and there
him her or them to Detain Till the Master Mistres or
Owner of such Slave or Slaves shall pay to the person
who apprehended such Slave or Slaves Eighteen pence

An Act or Ordinance to Prevent Stranger Stragling or
Vagrant persons becoming a Charge to this City.
Whurbas by an Ordinance of the Mayor Recorder Al-
dermen & Assistants of this City in Common Council Con-
vened the Sixteenth Day of March 1 730-1 it was or-
dained that the Constables of this City & liberties should
from time to time make strick Search & Enquiry concern-
ing all Strangers that should comfe & reside within this
City & Liberties & should give a list of their Names to
the Mayor or Recorder &c in order that their State &
Condition might be Enquired into, to prevent their be-
coming a City Charge which Ordinance it hath been found
by experience has proved ineffectual for the Purpose it
was intended, & that since the making of the same Divers

us which have been Lodged & intertained by the Inhabit-
ants housdhbldier's of this City perhaips with a view of
Gain till what little m'Oney they may have had about them,
hath beeo expended & then 'being turned out to shift for

this Oity, not being in a Capacity to provide for them-
selves, have been maintained at the Publick Charge, In
order therefore to Prevent the L,ike Inconveniences & im-
positions for the future.
Be it Eiilacted & Ordained by the Mayor Recorder Al-
derman & Assistants ini Common Council convened & it is
hereby Enacted & Ordained by the authority of the same
that from & after the Publication of this Act or Ordinance
no Prson or Pisons, being Inhabitants householders within
this City & li'bertieis shall presume to lodge or intertain in
his her or their house or houses, any Stranger Stragling
or Vagrant Pson 'ar PsOnis Whatsoever for the Space of
twenty four hours, withbut giving Immtediate Notice
thereof to any Onie Magistrate of this City, of such per-
son or persons under piin of forfeiting the Sum of Twen-
ty Shillings for each Offense to be leivied by distre^ss, of
the Goods & Chatties of him her or they so offending by
warrent from the Mayor Recorder, or any one of the
Aldermen & for w'atit of Goods whereon to make such
distre!ss the offender to be imprisoned till the forfeiture be
paid with dost two thirds wheireof shall be paid to the
Overseer of the poor for the time being for the relief of
the poor, & the other third part thereof for the use of the
informar.
And it is hereby further Enacted & Ordaineid by the
authority afor^sd, that if aniy person or persons whatso-
ever shall from & after the Publication hereof bring in
any Stranger Stragling or Vagrant person or personis
whatsoever without giving notice therieof to any one Mag-
istrate of this Oity, of such person or persons & being
therewith Duly charged, within Seven Days next after he
she or they, ware so brought in, shall be Lyable to take

& Carry away the sd person or persons out of this City &
Liberties & if the said person or pers-ons shall Neglect or
refuse to do the same sihall forfeit the sum of Twenty
Shillings for each offence to he recovered & applyed in
the same sort & manner, as before provided in this Or-
linance.
And it is hereby further Ordained & provided by the
Authority aforesaid, that the Constables of this City &
liberties 'shall be enjoyned & strickly charged duly to Ob-
serve the Duty of them required by the recited Ordinance
of the i6th Day of March 1730-1 & they & every one of
them are accordingly hereby enjoyned & stridy charged,
to be Vigilant & Carefull that the Duties of them re-
quired by That Ordinance & this, in that behalf, be Duly
Disdhairged under ye penalty of 7| for every offence
Nothing however in these Ordinances Contained Shall be
Deemed or Construed to Extend to the prohibiiting of any
person to Give a Meals Victuals or Drink to any poor
Traveller, to & for their necessary refre'shmt. in passing
along anything in these Ordinances Contained to the Con-
trary thereof in any wise notwithstanding.

Such Chimney hath bin on fire and the said ViewCTs Shall
have ten Shillings for each prosecution; and upon refusal
or Neg'lect So to prosecute as is hereby Derected Shall
forfitt the Sum of ten Shillings to be recovered before
any Majestrate of this City; and that the said Viewers

Assessed and Collected upon the Inhabitants of this City
the Sum of fifty pounds at 8 s. per ounce for the releafe
of the Poor and that the Assessor do assess the said In-
habitants according to their Estates not exceeding ten
Shillings nor under one ShilUng & two pence Ordered
that the Said Assessor Make his Asessment and Deliver
it to the Overseer of the poor by the first of March next
and that the Overseer Cbllect ye Same by the first of May
1742. Ordered tihat after ye first Day of May the Over-
seer make a Return of all the Delinquents to any one
Magestrate of this City who is hereby required to Issue

An Ordinance for Erecting of a Market House and
for regullating the iMarkets, &c.
Whereas Lawrence Williamson by Deed bearing Date
the Sixth Day of February 1742 hath granted and Con-
veyeid unto Dirck Van Aesdalen and William Ouke a
Certain Lot of Land Scituate Lying and being in this
City between Burnet and Peace Street in Trust and for
the Use and ben^efit of the Inhabitants of this City to and
for the Erecting and bnilding of a Market House in this
City, And whereas it apears to this Common Oouncill that
Divers of the freemen and Inhabitants of this City have
Subscribed Sundry Sums of Money for and towards
building of the said Market House on the Lot aforesaid,
and have ateo Exhibited a petition toi this Common Coun-
cill approving of the Situation of the place and Judging it
Highley reasonable & necessary that a Market House
should be built on said Lot and the Market kept under
proper Regulations.

do agree with workmen who will undertake to do the

And it is hereby further Ordained by the authority
aforesaid, that so soon ais the said Market House is built,
then and from thenceforth, ail flesh, fish, poultry^ eggs,
butter, cheese, and ail other provisions and all Herbs,
Roots, fruits &c shall on the market days mentioned in
the Charter (viz) on Tuesdays & Saturdays in Every
week, be brought into the said Market, before it shall or
may be Exposed to Sale, and shall Continue there two
hours at least, before it shall or may be Carried to any
other place to be sold. And if any person or persons
Whatsoever, presume or offer to sdl on said Days atiy
flesh, fish, poultry. Eggs, Butter, Cheese, or any other pro-
visions, or Herbs, Roots, fruits &c in any of the Streets,
or parts of this City, before the Same has been Exposed
to Sale in the market af sd contrary to this Ordinance, the
Same shall beoom(e forfeit to the poor of this City, wheth-
er the Same may be found in the hands of the buyer, or
the seller, and it shall and may be Lawful! for the Clerk of
the Market, the Sherif, or any Other Magistrate of this
City to Seize the Same, and dispose of it for the use of the
poor aforesaid.
And it is herdby furtiher Ordained by the Authority
afsd that no Butcher, or any other person or persons what-
soever, shall Huckster, or buy up any flesh, fish, poultry,
Butter, Cheese, Eggs, herbs. Roots, fruits &c in order to
sell the Same again to gain thereby, before the Same hath
been at least two hours in the said Market, under the

Its agreed by the Common Council with John De Graw
that he shall halve the Bene>fiet of Ringing the Court
House 'bell During his good behavior in that behalf upon
the following Terms.
for Ringing for the English Meeting he shall Receive
Thirty five Shillings at 8s p. oz p. annum viz for the
Dutch Meeting twenty Shillings p. Ditto And that he
have Liberty to Ring the bell for all ye funerals and it is
further agreed by the said John De Graw that he shall
from time to time Repair all the Running Geer belonging
to ye bell at his own Cost & Charge.
Anid its further agreed with said John De Graw that
he make ye Sending boards on the Torret of ye Court
house and 'bring in his Acctt at ye next Meeting of the
Common Council.
Be it Ordlained by the Common Council that Mr. Wil-
liam Ouke and Mr. Dirck Van Aersdden Bsqrs are here-
by appointed to see a poor Child Calld Charity now with
Cornelius Sollom Bound to Hendrick Hogiland till she
arives to ye age of eighteen years & that he be bound be-
sides finding sufficient Meat Drink & Cloathing to teach
the sd Child to Read the BiWe & give Security for the Due
performance thereof as also that the Same shall not with
in sd Term become a further Charge to this City.

Be it Ordaind by the Cbmimon Council that all the for-
mar Laws & Ordinances are hereby Continued & Confirm-
ed except the formar Law for Regulating ye Watch.
Be it Ondalind by the Common Council & it is hereby
Ordainid by the Authority oi the Same that there be every
Night a watch kept & upheld within this City from Nine a
Clock till Daybreak by the Inhabitants householders &
Journeymlen thereof and that the Same shall Consist of
four Men upon Each watch and that the said watch shall
& may take up alll & every Silave after the hour of Nine
of ye Clock in the Evening (unless they can show a Suf-
ficient Token to sd watch that they are upon Some lawfull
business of their Master or Mistriss) and bring all & ev-
ery Such Slalve to the Jail Keeper of this City who is
hereby authorized & required to keep all & every Such
Slave or Slaves taken up as afd in close Confinement till
rdieved by their Master or Mistress and the sd. Master or
Mistress Shall pay for each such Slave eighteen pence to
the Watch that took them up & eighteen pence to Jail-
keeper for their Confinmt & all Other reasonable Allow-
ance for firiding Meat & Drink to such Slave or Slaves if
kept in Priison above Twenty four hours. And be it fur-
ther Ordaind by the Authority afd that the said Watdh
shaill & May Examine all & every Other person or persons
that they shall find strolling about the Streets after twelve
a dock at Night wlhb can Give no good account of them-
selves. And it is further Ordaind by the Authority afd
that Jacob Ouke & Dirck Vaui Aersdalen or either of them
Esqres Shall have the appiointment of the sd Watch from
time to timie & keep an ex'act list of alii the Inhabitants
holLise hoilders & Journieymen afd & Observe that the bur-
den thereof be layd equal upon the Same And be it further
Ordaind by the Authority afd that all & every person or
perisonis who shall Neglect or Refuse to Watch when
thereunto appomted as afd or find a Sufficient person in
his Room shall for each offense forfeit the Sum of six
Shillings to be paid to the Treasurer of this City for the

Whereas an ordinance of ye Mayor Recorder & Alder-
men & Assistants of this City in Common Councill Con-
vened the Sixteenth Day of March 1739 it was ordained
that ye Constableis of this City & Liberties Should from
time to time should make Strick Sarch & Inquiry Con-
cerning all Strangers that should Come within this City
& Liberties & Should give a List of theire Names to ye
Mayor or Recorder &c in order that theire State & Con-
ditidn mfght be Enquired into in order to prevent theire
becomeing a City Charge which Ordinance hath been
found to be in Some 'Measure inef ectual for that purpose
& that since the Makeing of the Same Divers persons
halve come in & others have been brought into this City
& have been Lodged & entertained by ye Inhabitants
householders of this City perhaps with a View of Gain
till whiat Little Money they have had hath been spent &
then have been turned out to shift for themselves by
which Means have become burthensome to the Inhabitants
of this City not being in a Capacity to provide for them-
selves have been Maintained at the pubdick Charge In
order therefore to prevent the Like Inconveninces & Im-
positions for ye future.

ertys shall presume to Lodge or entertain in his her or
theire house or houses any Stranger Straglin or Vagrant
person or persons whatsoever for the space of twenty four
hours without Giving Imimeidiate notice thereof to any one
Magistralte of this City shall forfeit ye Sum of thirty
[shilils] for ye first offense and ye Sum of forty Shillings
for every twenty four hours thereafter to be Recovered by
Distress & SaJle of ye Goods & Chatties from all persons
so Offending by Warrt. &c.
And its further Ordained by the Authority afd that if
any person or persons whatsoever shall at any time after
ye Publication hereof bring any Stranger or Vagrant per-
son or persons into this City either by Land or by Water
without giveing Imediate Notice thereof to any one of ye
Magistrates shall forfeit the Sum of thirty Shillings to be
Levye'd by Distress & Salle of his Goods & Chatties And
Shall also be oMidged to Convey such person or persons
out of this City to the place from^ whence he or they had
so brought them at his own Charge and upon Neglect or
refusall thereof shall forfeit the Sum of forty Shillings
for Each offence to be Levied by Distress & Salle of ye
Goods & Chattles' of him her or they so offending by
warrt. from' ye Mayor Recorder or any one of the Alder-
men & for Want of Goods & Chatties wberon to make
such Distress the offender to be imprisoned till the for-
feitter be paid with Costs two thirds wihereof shall be paid
to the overseers of ye poor for ye time being for ye releife
of ye poor & the other third part thereof for ye use of ye
Informer.
And its further Ordained by ye Authority aforesd that
ye Constables of this City & Libertys are hereby Enjoined
& Strickly Charged Duly to Observe the Duty of them
required by ye recited Ordinance of ye i6th Day of March
1 730-1 under ye Penalty of Seven ShilHings for Every
offence nothing however in these Ordinances Contained

ing of any person to give a Meal Victuals or Drink to any

its hereby Ordained by ye Authority of ye Same that if any
person or persons Wihatsoever Shall bring in to this City
or Liberties thereof any Stranger Idle or Vagrant Per-
son or persons after ye Publication hereof and Shall not
foithwith give up ye Names of such person or Persons
to ye 'Mayor or any other Magistrate of this City or to
ye Overseers of ye Poor upon being Duly Chardged with
such Strangers Idle or Vagrant person or persons Shall
besides paying the penalty in said Ordinance mentioned
pay or cause to be paid to ye Overseer of ye poor of this
City all such Cost & Damage which ye Corporation Shall
be put to by reason of such Stranger Idle or Vagrant per-
son or persons to be recovered & applyed in Such Way &
Manner as the penality in & by isd Ordinances is Directed

Be it Ordained By the Common Council of this City
& it is hereby Ordained by the Authority of the Same
that all the Laws & ordinances of this Corporation which
have expired Since the Last Meeting of the Said Com-
mon Council be revived and they are hereby revived ac-
cordingly.
Its ordered that Messrs. William Ouke Jaunes Neilsoii
& Jiames Lyne be a Cbmmittee to Inspect into & revise all
the Laws & Ordinances of this Corporation to amend
Such as are Deficient and to frame New Laws Such as
they Shall Judge beneficial to this Corporation and to
Make their Report thereof to this Board at the Next
Setting of ye Common Council .
It is Ordered that the Treasurer of this Corporation
purchase a well Bound Book for the fair Entry of all the
Laws orders and Ordinances of this Corporation.
It is Ordered that Dirck Schuyler Paul Miller and Dirck
Van Veglhte be a Com'mlittee to audit the Acctts of all the
former Collectors and Overseers of the Poor who have
not rendered their accts of their respective offices and do
Make their report thereof at the Next Setting of the
Common Council of this City.

Messrs. Miller Schuyler & Van Veghte the Committee
appointed on the twenty fourth of Aprill last to audit the
Acoounits of all the then former Collectors & overseers
of the poor have reported to this Board that they have
au'dited the Acct. of Reuben Runyon one of the said
overseers and find that he is indefbted to this Corporation
in the Sum] of forty one Shililings and Seven pence at
Eight ShiilHngs p. oz and also that they have audited the
acct of John Predmoor another of said overseers and find
that this COriporation is Indebted unto him in the Sum of
twienty two ShilKngs and 'One penny like Money which
^■^eport is approved of by this Board It is Ordered by this
Board that the Said Reuben Runyon do pay the afore-
said Sum of forty one Shillings and Seven pence unto
Abraham Schuyler one of the present overseers of the
poor for this City.

It is Ordered that Messrs. Miller Schuyiler & Van
Veghte ibe a Oomlmittee to Audit the acct. of Daniel South
one of the overseers of the poor of this City for the Year
1748 and of Abraham Heyer a nother overseer for the
Year 1747 & 1748 and that they make their Report there-
of to this Board lat the Next Setting.
Ordered that Messrs. William Ouke & Jacob Ouke do
Repair the Stone Bridge at ye North En:d of Burnet Street
in this City Ito agree with Workmen and provide Stone &
other Materials for the Same.
[Whereas] it alppears to ye Common Council of this
City that a [Sum of Money] is wanting to Relieve
the poor of Said City
Be it there Ordained by the sd 'Common Council and it
is hereby ordained by the Authority of the Same that the
Assessor of this City do assess the Inhabitants of the Same
in the Sum of forty pounds Money at Eight Shill per
ounce for the use of said poor according to their respec-
tive Estates not exceeding the Sum of fourteen Shillings
nor under one Shilling like Money and that the Assessor
do Deliver his List of Assessment to the overseers of the
poor by the first Monday in September Next So that the
Same be Collected in by the first Monday in October Next
and that the overseers do Make a return of all Delin-
quents to any one Magistrate of this City.
Be it Ordained by the Common Council of this City and
it is ihereiby Ordained by the Authority of the Same that all
the Eaws & Ordinances of this Corporation Now in being
be Continued and be in full force from henceforth for Six
Months and they are herdby Continued in force accord-
ingly.
Ordered that the Treasurer pay unto the Sheriffe of this
City the Sum of Nine Shillings for Moneys by him Layd
out in Repairing the Goal of this City.

1681. June 25. ComeHus Longfield, purchases land ''opposite the
plantation of George Drake". This purchase included what is now the

1681. June 27. Purchase of "the Raritan Lots" for John Inians
and Assiociates. Some of these lots are today the north half of New
Brunswick. The purchase was confirmed by Governor and Council on

Longfidd and Inians built and dwelt on their purchases. They
were our finst settlers.

1686. April 19. Extract from the Journal of Governor and Coun-
cil:
"A paper was given in here by Mr. John Inyens, therein setting
fforth that hee has bin att a considerable expense to accommodate the
Cbuntry in makeing out a Road to the ffals [of Delaware] from his
house upon the Raraton wdh is six miles shorter then formerly and hath
ffurnished himselfe wth all accommodacon as boates Canoes &c ffitting
for fferrying iOVer the Raraton River all Travelling wth horses and
Catle &c. Desireing this Board Will b6e pleased to order its being a
publicke Road for the use of the Country and setle the Rates for the
fferry &c wch being Read It's agreed and ordered that the Commis-
sioners appointed by Act of General Assembly for laying out of all High
Wayes Ivandings and fferryes in some short tyme Repaire to the sd
fferry and there inspect the same and make their Retorne to the Secre-
tairyes office. And as to the sd ffees and Rates for the fferry the same
must be setled by Act of General Assembly to whch end this Board will
take care to Recomend the samte to the House of Deputyes." Archives

nor's Coundl. His fellbw first settler, Cornelius Lonigfield, was for
manly years a miember of the House of Deputies. Arch. XIII. 194, 237

1693. Oct. 30. Each town by majority vote may elect to maintain

1693. Oct. 31. An Act for dividing each County into Townships.
Middlesex County comprised three townships, Woodbridge, Perth Am-
boy and Piscataway. The territory south of the Raritan, of which the
present New Brunswick forms a part, was by separate metes and
bounds made a distinct portion —
