To the liberality of the Marquess of Bute in contributing towards the expense of transcribing, printing, and illustrat- ing the present Volume, and to the care taken hj the Municipality of Ayr in preserving the ancient records and documents in their custody, the Members of the Ajr and Wigton Archseological Society are indebted for this Cartulary of the Fiiars Preachers of Ayr, The coUection was too large to print in the ordinary Volumes of the Society, and too complete to break up into separate parts; and it was therefore determined to make it an extra issue. The documents contained in it will be found of great general and local interest, and form an important contribu- tion to the history of the Order in Scotland. The only other printed Cartulary of the Friars Preachers (those of Glasgow) was published in the Maitland Club Series in 1846. The mununents now given throw a great deal of light on the early history and topography of Ayr ; and, taken in connec- tion with the records of the Burgh about to be printed by xviii PEEFAOE. the Society, will afford authentic materials for the local history of the district. In dating some of the charters the ordinary practice of dealing with the regnal years of David II. has been followed. It is necessary to state, however, that this point is involved in very great obscurity and doubt, and it is to be hoped that some further light will be thrown upon it by future investigations. I have great pleasure in acknowledging the valuable assistance I have received from many kind friends in going over the charters. R. W. COCHRAN-PATRICK. WOODSIDE, Beith, Decemher 1880. INTEODUCTION. It is much to be regretted that so little is recorded relating to the history of the Order of Preaching Friars in Scotland. The original documents cannot be recovered, and without them we have little except tradition to inform us. According to the received account, the Preaching Friars were brought into Scotland during the reign of Alexander II. The continuator of Fordun, and the author of a chronicle printed in the Extracta e Variis Cronicis Scocie} give the year 1230 as the exact date of their first appearance. It is said that Clement, afterwards Bishop of Dunblane, received the habit at the hands of S. Dominic himseK, and was the first of the Order in this country. He is probably the same individual who is mentioned in the Acts of the General Council held at London in 1230.^ He was elected and consecrated Bishop of Dunblane in 1233,^ and died in 1256.* Spotiswood, on the other hand, says the Order was introduced into this country by WiUiam Malvoisin, Bishop of S. Alexander the II. founded eight houses of the Order, namely at Edinburgh, Berwick, Ayr, Perth, Aberdeen, Elgin, Stirling, and Inverness. Considerable uncertainty exists as to the exact date of the earliest foundation. That honour has been claimed for Ayr, on the authority of S. Antonine, and it is not improbable that it may have been the case. Spotiswood gives the same year for the foundation of Ayr, Edinburgh, and Berwick, viz. 1230. He is responsible for the statement that the convent of S. Katherine at Ayr was founded by William, Bishop of S. Andrews, though he also gives the more correct account by the author in the Extracta e Variis Cronicis Scocie, which is rendered certain by the records now printed. The present coUection of documents contains several of more than local interest, and relating to the Order in general. The first of these is a BuU of Clement IV.,^ in favour of the master and brethren of the Order of Predicant Friars, permitting them to possess, succeed to, and sell temporal property, and employ the proceeds to their own advantage as they may think best. This was given in the year 1266. The next relates to a much later period, being dated in the year 1518.^ It is a Brief by Leo X., granting to the Friars Preachers the right to receive confession, without permission being first granted to the penitents by their rectors; to receive and ask for alms without the licence of the parish priest ; and to bury such as desired it within the precincts of ' P. 2. = p. 83. The last of this class of documents is a Brief by Leo X./ granting to the Friars of the Predicant Order similar privileges to those enjoyed by the Minorite Friars in regard to the observance of certain feast days in places under ecclesiastical interdict, so that on the feasts of SS. Dominic, Peter Martyr, Thomas Aquinas, Vincent, and Catherine of Sienna, the said Friars might open their churches and celebrate divine service, excluding only those who were personally excommunicated. This was also given in 1518. Scotland was erected into a province of the Order in 1487, according to the learned editor of the Muniments of the Friars Preachers of Glasgow.^ John Mure, who is mentioned in the Ayr records in 1469, as Vicar-General ^ of the Predicants in Scotland, became, after the erection, the first provincial Prior of the Order. The last one is also mentioned, Friar John Grierson, iu 1557.^ He is said to have been Prior for thirty years, and to have survived the Reformation. No other notices relating to the Order in general are to be found in the records. The only place where any mention is made of the resident Friars is in a charter of 1557,^ where the names of eight are given, comprising apparently all in the convent at the time. The king commands the Provosts of Ayr to pay to the Friars Preachers twenty pounds of sterlings yearly, from the revenues arising out of the mills and burgh of Ayr. This grant was confirmed by Robert the Bruce in 1328;^ by David II. in 1344; 2 by Robert II. in 1376 ;^ and by Robert III. in 1390." Alexander II. or his successor also gave to the Friars some land within the burgh of Ayr for the purpose of enlarging their cemetery. The original grant is not amongst the coUection, but it is referred to in the charter of Juliana de Ponte.^ Besides confirming the grant of his predecessor, Robert I., in 1328, gave to the Friars the right to have their corn ground without multures.^ In 1336, Malcolm, Earl of Wigton, dedi- cated a chapel in the church of the Friars to the Blessed Virgin, and endowed it with an annual rent of one hundred shillings, secured on his lands of Carse and Barshalloch, in Kyle Regis, and in addition he bestowed his lands of DuppoU for the maintenance of an officiating priest, and for lights in the chapel.'^ This endowment was further increased, in 1344, by a yearly grant of six merks of sterlings, out of his personal funds, to be continued by his successors, under the penalty of excommunication by the Bishops of Glasgow. To about this period must be assigned a grant by Adam de Ponte, of his stone house in vico Nemoris, probably the Wood- gate ^ of later times ; three roods of land in vico de Canniher, and an annualrent of twenty-one shillings from the barony of 1 P. 3, No. 3. INTEODUCTION. xxm AUoway, Cortoun and Gortluy ; which grant was confirmed by his daughter Juliana, who added another rood of land to the benefaction.^ By another undated charter, which must belong to the same period, Andrew of Wasford, son of Simon of Wasford, burgess of Ayr, conveys to the Friars Preachers his house, with a kiln, two roods of land next the kiln, and one croft called the Grukithalf acre ; to which Margaret his wife added a rood of ground.^ The next recorded benefactor was John of Kilmarnock, burgess of A.jy, who in 1348 made large grants to the Black Friars, making over to them for the weal of his soul, and the souls of his parents, and of all faithful successors, for light to be burned on the high altar, and for the repair of the house of S. Katherine the Virgin, and for his own sustenance during life in the same place, all his lands and annualrents in the territory of the burgh of Ayr, or outside of it.^ The list of these* is highly interesting, as showing the property of a wealthy burgess at the time. Besides the usual confirmation, Robert II., by letters patent, took the Friars Preachers of Ayr under his sure fence and protection.® About 1386, a dispute seems to have arisen between the Burgh and the Friars Preachers as to the annuity of .£20 granted by the royal mandate of Alexander II. XXIV INTEODUCTION. muniments, and evidents, relating to the matter, on an appointed day ; and they not having compeared were again summoned to appear in the cathedral of Glasgow on the 26th of July 1386, to hear sentence given.^ The decision was in favour of the Friars, and on the following day the Cardinal addressed letters to the Earl of Fife and Menteth, Chamber- lain of Scotland, narrating the procedure and result, and requesting him to make payment of the said annuity and arrears to the convent.^ Accordingly, the Steward of Scot- land commanded the sheriffs of Ayr to distrain the goods, movable or immovable, of the Provost and Bailies of Ayr, if they should refuse to make payment.^ Some doubt or delay apparently still took place/ for the matter came before Par- liament in 1389,^ and was finally decided in the meantime in favour of the Friars, to whom the annuity is regularly recorded to have been given in the Exchequer RoUs,^ previous to this time. An anniversary was founded in 1397 by Hugh Wallace of Craigie, for himself, and his parents and successors, and an annual grant of four boUs of white oat meal, or in default thereof forty pence for each boU, was secured on the granter's lands of Craigie.'' This was confirmed in 1419* and 1480 ^ by his successors. Robert III. set the royal customs of the burgh to the burgesses in perpetual farm for ten pounds yearly, and the Friars accordingly protested, and made a complaint to Parlia- ' P. 25, No. 17, * P. 30, No. 21. INTRODUCTION. xxv ment in 1400.^ On the 25th of March 1406, the matter came before Robert, Duke of Albany, to decide. On the one part appeared Robert of Linlithgow, prior of the Friars ; and on the other, Reginald of Fenwick, alderman of Ayr, and WiUiam Nelson, one of the burgesses.^ The merits of the case were fully gone into, and the result was that the community of Ayr were ordained to pay to the convent the twenty pounds annually. In consequence of this decision an arrangement was made by which the mUls of Ayr, of Merlingburn, and of Lochmillburn, two cruives in the mill dam of Ayr, with multures and sequels, were handed over to the convent, in lieu of one half of the royal annuity, the Friars engaging to main- tain the miUs and dams at their own expense, and to allow the burgesses and staUkeepers to have their corn ground at the rate of threepence for each boU. The other sum of ten pounds was to be uplifted from the first revenue of the burgh, by the hand of the Chamberlain of Scotland, Some time previous to this Alane of Lawder granted to the convent of S. Katherine the lands of DaUncathe or Dankeith, and in 1411 the fact was attested in solemn form, and in the Scottish language, by the burgesses and community of Ayr.^ The next gift to the church was an annualrent of four shiUings, given by Adam of Boure, one of the burgesses of Ayr, to found an anniversary for himself and his wife.* This is the commencement of an interesting series of smaU grants by the burgesses of Ayr, which are of great interest for local 1 P. 35, No. 24. ^ P. 38, No. 26. ^ P. 45, No. 29. * P. 47, No. 31. d xxvi INTRODUCTIOK historj. A curious tack by Janies Cathcart of Carbreston, in the parish of Coylton, to Allan White, of a tenement in Ayr, in •1438, is the next document.^ This was foUowed in 1443 by the gift of friar Michael Gray, Preceptor-General of S. Anthony, near Leith, to the Friars Preachers, of a piece of land in the croffcs of Ayr, to found an anniversary.^ Somewhat later there is the record of an attempted distraint on the lands of Kerse, to recover fifty shillings of annualrent, by Prior Patrick Pulty.'^ In 1469 an anniversary was founded by Allan White for himself and his wife.* In consideration of the special affection borne by Sir William Young, Vicar of Craigie, to the Friars Preachers, shown by his many gifts to the convent, a daily mass was ordered on his behalf for ever.^ Another burgess of Ayr, Matthew M'Nedyr, founded in 1471 an anniversary for himself and his wife.® A small portion of the property of the qonvent was granted to Gibbon M'Callan in 1476.'' A third anniversary was to be celebrated on the day of the death of the Lady Isabella, secured on a tack of the lands of the Wood of Dalrymple. An obit was founded in 1488 by William Noble and his wife, from his tenement in the town of Ayr, near the bridge.^ Andrew Raperlaw, in 1491, granted a reversion in favour of the convent of half a croft of land,^ while the other half was made over by John Walker, burgess of Ayr.^ In the same year William of Preston agreed to give the reversion of his tenement, granted by the convent, to the Friars.* Sir John Chalmers of Gadgirth, and Dame Janet Hamilton his wife, founded an anniversary for themselves and all Christian souls in 1500.^ The third part of the lands of Kersholmes and Kersland, and the third part of an annualrent of four shillings from the lands of Stob- redding and Lauchlane, were given to the convent in 1503, by Agnes Ker.^ An anniversary was founded two years later for William BeU, burgess of Ayr, and Agnes Mure his wife, out of properties within the burgh ; '^ and also in 1507 by Marion Curry, with consent of her husband John Lang, for the souls of John Curry her father, and Elizabeth Hume her mother, Similar anniversaries were founded in 1508 for John Craufurd and his wife;® and in 1515 for John Maknedar, burgess of Ayr, and Marion Martin his wife f and these are the last which are recorded before the Reformation. The Prior and Convent granted a tenement in Ayr in 1515 to Roland Kennedy : ^ and in the same year received a grant from Friar John Walker, and in 1518 another from Friar Andrew Lathis.^ Adam Wallace of Newton, alderman of Ayr, gave in 1524 his walkmill and pertinents to the convent:' and this is the last recorded donation to the Friars Preachers. They received possession in 1541 of the tenement which had been granted to Alan Boyman, according to the " altogether laudable custom of the burgh of Ayr, beyond the memory of man," by proving in their head courts of the burgh that the annualrent had not been paid.* In 1557 the convent made over to John Blair of Middle Auchindrane, and Helen Cathcart his wife, a property in the principal street of the burgh of Ayr, for the annual payment of six merks.^ Immediately after the Reformation, Queen Mary granted to Charles Craufurd, one of her gentlemen servitors, the lands, houses, mills, fishings, and other possessions which had be- longed to the Friars Preachers of Ayr,^ for the space of nine- teen years. INTKODUCTION. xxix In 1614 the magistrates of Ayr resigned into the king's hands the church lands and rents belonging to them, for the purpose of getting a new infeftment in their favour.^ The document contains apparently a complete list of the possessions of the Friars Preachers which were then in the hands of the municipality. Their later history will be afterwards traced in the documents belonging to the burgh. The records now printed enable us to give a few of the Priors of the Convent of S. Katherine, though the list is, especially in the earlier period, obviously imperfect. The first of whom we have any mention is John de Torry, who appears in an undated charter, apparently about the first half of the fourteenth century.^ In 1401 Patrick of Oarrick ^ appears as prior, but when he was appointed or how long he continued is uncertain ; but it is probable his successor would be Robert of Linlithgow, whose name and seal occur in charters of 1406.^ An interval of more than half a century occurs during which no name is recorded. But in 1460 Patrick Pulty ^ is mentioned as prior. His name occurs in 1469,^ in 1471,^^ and in 1476.® In 1488 John Reid was prior,^ and he is mentioned in 1491.^^ John Shanks occupied the place in 1500^^ and 1503.^^ He was succeeded by Hugh Ramsay, who is recorded in 1505^^ and 1508." Perhaps the most interesting is an hitherto unpublished privy seal of John, Earl of Carrick, the Steward of Scotland.^ Though unfortunately imperfect, enough remains to give an idea of the design and workmanship. The seal of Malcolm Fleming, Earl of Wigton,^ is a very fine example of fourteenth century work, in excellent preseivation. Only one seal of the convent remains, that of Robert of Linlithgow, in 1406,^ but it is a beautiful specimen, in the finest state. Notarial copy of Bull of Pope Clement (Fourth) in favour of the master and brethren of tlie order of Predicants, wliereby, in answer to certain petitions from them for remedy against the misrepresentations of some prelates and others in various parts of the world, asserting that they were dead (to the world), and not capable of enjoying temporal property, thereby designing to exclude them from succession to any goods, the Pope declares that they, being in the world, may lawfully succeed to, possess, and sell, temporal property, and employ the proceeds to their own advantage as they may think best ; and decrees all sentences of interdict, suspension, and excommunication, by whomsoever pronounced, contrary to the tenor of this Bull, to be null and void.
