Before the selection of members of the Committee, but with knowledge that the Committee had been authorized, the Gov- ernors of The Aero Club of America designated a Committee which we hope will co-operate with us in our activities. The members of this Committee are as follows : William W. Miller, of Hornblower, Miller & Garrison. Stephen H. Philbin, of Fish, Richardson & Meade. Philip A. Carroll, of Shearman & Sterling. *W. Benton Crisp, of Crisp, Randall & Crisp, and Col. Arthur O'Brien, of the Blair Securities Corpora- tion, all of New York City. Of these Mr. Philbin is of counsel for the Wright-Martin Company, and Mr. Crisp was of counsel for the Curtiss Company ; Colonel Carroll was active in the aviation forces of America in Europt, and Colonel O'Brien was one of the assistants to the Secretary of W?.r. The Chairman of our Committee has been in correspondence with John Hinkley, Esq., of Baltimore, Maryland, Chairman of the Committee of the Commissioners on Uniform State Laws upon a uniform aviation law. Consideration has been given to the letter of Mr. William V. Rooker, of Indianapolis on the Jurisprudence of the Atmos- phere, which was circulated among the members of the Con- ference of Delegates at St. Louis last summer, and which contains information and endeavors to classify powers, (i) as between the United States and foreign governments; (2) as between the United States and the Several States ; (3) as be- tween the political and judicial departments of the United States; (4) as between the State and the owner of land; (5) finally, the nature of such jurisprudence. * Mr. Crisp has since died. The Chairman has also considered the report of the Com- mission appointed by the Governor of New York in the year 1920. Augustus Post, Secretary of the Aero Club of America has kindly volunteered to give information and suggestions upon the legal side of the subject oi aviation and aeronautics; Mr. Post was Secretary of the Commission appointed by the Governor of New York. The Conference of Commissioners on Uniform State Laws at its meeting in August, 1920, adopted the following resolu- tion : The whole world has come to a realization of the fact that Aviation is practical and not a mere art or fad for pleasure and profit in exhibition flying, for many States in the Union now have scores of aviators constantly flying from State to State carrying com- merce between the States, which aviation needs regu- lation, so your Committee recommends the appointment of a special committee to investigate this subject and report as soon as practical a uniform aviation law. The members of the Committee of the Commissioners are : John Hinkley, Baltimore, Md. Charles V. Imley, Washington, D. C. Thomas J. Brooks, Bedford, Ind. N. E. Corthell, Laramie, Wyo. George G. Bogert, Ithaca, N. Y. A. T. Stovall, Okolona, Miss. George B. Young, Montpelier, Vt. Mr. Hinkley has indicated that he considers that the scope of the two committees is different, in that our Committee as he assumes is authorized to consider particularly the interstate and international features of the question, while his Committee is limited to matters of strictly State regulation. Our Committee through its Chairman has been in corre- spondence with members of the Committee; the Librarian of the New York Public Library ; Hon. Simeon E. Baldwin of Connecticut; the Chief of the Economics Division of the New York Public Library ; the Foreign Manager of the International Fire and Marine Agency Corporation ; the Assistant Librarian of the Association of the Bar of the City of New York; the Librarian of Congress, Washington, D. C. ; The Secretary of Commerce, Washington ; a Senator of the United States, mem- ber of the American Bar Association ; Editor of the Literary Digest (in respect tq an article in the December 4, 1920 num- ber on American Backwardness in Formulating Laws of the Air) ; the Chief of the United States Army Air Service; the President of the Board of Aldermen of the City of New York ; one of the District Judges of the United States for the Southern District of New York ; the Director of the Bureau of Standards, Department of Commerce, Washington, D. C. As the result of this correspondence he has received the fol- lowing : From the New York Public Library a copy of the entries in its catalogue on Aviation Law, which, however, is not intended to include a multitude of magazine articles or chapters in books, documents, etc., which a search would bring to light. The Library has grafiwously tendered the use of a research room in the Economics Division and all of the material in the Library on the subject; From Judge Baldwin a list of his numerous published articles on aviation ; From the Foreign Manager of the International Fire and Marine Agency Corporation the tender of information of avia- tion insurance men gained from experience in the Scandinavian countries, England and France on this subject; From the Assistant Librarian of the Association of the Bar of the City of New York a list of the works appearing in the subject catalogue of the Library under the head of Aviation (Aeronautics, see Aviation) ; A communication from the Judge Advocate General to the Senator above indicated, giving full information respecting ac- tion on the regulation of air navigation in the United States, from which it appears that legislation has been passed already in Hawaii, California, Massachusetts, Michigan, Texas, Wash- ington and Wisconsin, while New York now permits aircraft insurance. The Judge Advocate furnished an informative list of articles on the subject, not appearing in the other lists fur- nished to us from other sources. It appears that his office has not yet rendered any opinion on the subject, but that some study has been devoted to it and some observations have been made; A list of publications on the Law of Aviation in the Library of Congress; A list of the works on Aviation Law listed in the catalogue of the New York Public Library ; Report of the Aviation Commission of the State of New York; An invitation from the President of the Board of Aldermen of the City of New York to attend a preliminary meeting on January 4th, 1921, relative to a regulating ordinance for flying over the City; Copies of bills pending before Congress (H. R. 14061, intro- duced May 13, 1920 by Mr. Kahn; H. R. 14137, introduced May 19, 1920 by Mr. Hicks) ; Sixth Annual Report of the National Advisory Committee for Aeronautics. Among the suggestions elicited from this correspondence are the following: That from the experience in aviation insurance in many countries there arises a conviction that it is of vital importance to cover as big a territory as possible by the same regulations, and this imperatively calls for Federal laws and Federal su-. pervision, and any legislation by single States, as effective and well-devised as it may be, will ultimately be detrimental to a branch of transportation which by its very nature is success- fully possible only if employed over great distances ; that such legislation may concern the ship, its cargo, its passengers, ports of flying, the routes and the transportation company itself, and one of its most important points is the person of the pilot ; Information that the Lloyds have an Aviation Committee, and that a bill has been brought before the British Parliament by the British Civil Control Department for Air, intended to give that Department fuller powers by extending very con- siderably the British Air Navigation Acts of 191 1 to 1919. We are making an effort to secure copies of these Acts; The serious embarrassment to national regulation growing out of the dual nature of our Government, and the division of powers between the National and State Governments ; The absence of any grant oi express power over the general subject of aviation in the Constitution of the United States; The possibility, indeed the probability, that the extent of the power of Congress, or the Government of the United States, over the subject of aviation is determined by the incidental re- lation of aviation to other subjects, such as international af- fairs, interstate and foreign commerce, and other matters within the domain of congressional power or Federal control by the express grants of the Constitution, and their necessary implications; that a serious effort is making to have Congress take the view that the control of aviation is within the ad- miralty jurisdiction of the United States Government; that it is far better that the express power should be conferred upon the United States by amendment of the Constitution, than that in constitutional matters the United States Government should grasp powers that were not contemplated, and are not neces- sarily incident to the powers already conferred upon it. The Foreign Manager oi the International Fire and Marine Agency Corporation in New York has kindly volunteered to confer with his company's London office and secure copies of the English air navigation acts, and the new bill now pending in Parliament. It is suggested' that this legislation is doubtless the most up to date and complete now in existence, and that its study will probably convey considerable indication of points worthy the attention and supervision of a Government. It is suggested that the hazards involved to the person of a pilot, the physical conditions of the aeroplane, the hangar, the landing field, etc., have repeatedly been discussed recently by American aviation insurance people, and the necessity for combined action having clearly arisen there was organized last July the National Aircraft Underwriters Association, with the immediate object to exercise a control over pilots, but with a larger field in contemplation, comprising every factor which may influence aviation insurance ; That there is a tendency to assert exclusive jurisdiction of this subject matter in the Federal Government, on the theory that it comes within the admiralty jurisdiction; and a tendency to rush to the National Government with all grievances, re- gardless of the constitutional view that it is a Government of limited powers, and that powers not expressly granted, or necessarily implied in the actual grant are reserved to the States respectively", or the people thereof ; That it seems advisable for constitutional minds to get busy on this new field of jurisprudence; That navigation of the air in America has itself been back- ward, thus requiring very little formal interference or regula- tion, and that the division of powers between State and Na- tional Governments make it advisable that early efforts at legis- lation should be very carefully conceived in order to avoid a conflict between National and State authority, which otherwise is almost inevitable. The Secretary of the Aero Club of America has kindly vol- unteered to furnish to a member of the Committee the names and addresses of the officers of aviators' associations as those who may be especially interested in proposed Federal or State legislation on aviation ; The Senator above indicated kindly volunteered to take the matter up with the Chief of the Air Department, and with the Judge Advocate General ; Information respecting the issuance in the Southern District of New York of a libel against an hydro-aeroplane; A suggestion that the National Advisory Committee for Aeronautics has submitted to Congress a report containing a recommendation for the creation of a Bureau of Aeronautics by Congress, to be headed by a Commissioner of Air Naviga- tion, charged with Federal regulation of commercial air traffic, the licensing of pilots, aircraft and landing fields, and all other details not military in character ; Information that the meet held under the auspices of the Aero Club of America on Thanksgiving Day, 1920, in competi- tion for the Pulitzer Trophy and the Samuel M. Valentine Prizes, was the most successful aircraft meet ever held in this country, forty-four of the fastest airplanes in the world, repre- senting American, British, French, Italian and German de- signs being among the competitors. That those interested in aeronautics are divided in- opinion as to the action to be taken by the Government ; first, those who favor a separate department of aeronautics, covering all phases of the subject, both military and civil; second, those who believe the army should develop its aviation corps con- sistent with the needs of the army, that the navy should com- bine its aviation under one head in the form of an aviation corps, division or bureau, and that the civil functions, such as the establishment of navigation rules, licensing of machines, pilots, etc., should be performed by a small civil bureau estab- lished for that purpose in the Department of Commerce. The bills which have been introduced are said to be an em- bodiment of the second of the propositions, though it is pos- sible that if it should develop that a separate department is essential, the three aviation services could be combined. The resume of observations accompanying the letter of the Judge Advocate General deals with the constitutionality of Fed- eral legislation and legislation regulating air navigation, chiefly with analogies of decided cases and legislation in somewhat kindred fields-; it deals with air navigation as commerce, with the analogy of the migratory bird acts; with the analogy to railroad traffic ; with the analogy to radio-telegraphy ; with the desirability for uniform legislation ; with the absolute necessity for uniformity in the protection of interstate and foreign air navigation, and the probable effects of such legislation over intrastate air navigation ; with the analogy of the regulation of private pleasure water craft ; with the analogy between navigable air and navigable water; with the possibility of con- flict between State and Federal claims, in that the Constitution does not grant the same authority over navigable air as over navigable water; with the embarrassment caused by the com- mon law doctrine of cujus est solum, ejus est usque ad coelum, and with the denial of the existence of this doctrine, or its limitation by altitude; with the subjection of aircraft to Na- tional regulation, and by reason of their relation to the safety of other craft over which the National Government would un- doubtedly have jurisdiction; with the incidental effect of the exercise of congressional power to see that interstate commerce may be conducted upon fair terms and without molestation and hindrance ; with the effect of treaties as extending the national power to deal with the subject covered by the treaty; with the effect of action by Congress over matters clearly within its jurisdiction, but incidentally also within the jurisdiction of the State police power, or other power ; with the difference be- tween the exercise by Congress of power in anticipation of a treaty, and of power in fulfilment of a treaty. Money in "New France" 3 :467-8, April, 1919. "Information Annual, 1915" contained the following item: "B. H. Hendricks of Atlantic City, N. J., was fined $3.00 for flying without lights on his hydroaeroplane, September 10th. Government officials at Washington having decided that in its dual life the hydroaeroplane might be immune from Governmental control in the air, but if it undertook to be a boat and sailed the sea within the jurisdiction of the United States authori- ties it would have to obey the law there was on the subject of coastwise navigation." And in "Information Annual, 1916," the following items ap- peared : "Hydroaeroplanes received the status, February 21st (1916) of 'vessels' in an order issued by Assistant Secretary of Treasury Peters, and sent out from Washington to all custom houses of the country. Aeroplanes, however, were not to be deemed vessels. "The first set of international law bills for airships and the space above the earth was adopted at the re- cent Pan-American conference held in Santiago, Chile. A copy of the bills reached the Aero Club of America, July 22nd. The conference resolved to re- commend the bills to all American countries. "The bills provide that all space too high to be util- ized by the proprietor of the ground beneath shall be declared public property for public use. "All nations shall have a sovereign right to the space dominated by their territories, and private aero^ planes belonging to the citizens and the legal 1 esidents of a country shall have the right of passage through the space over other nations. "Every aeroplane or other airship shall have a na- tionality. 16 "Public aircraft shall have the nationality of the nation to which they belong and private machines the nationality of the individual owning them. "All aircraft shall carry distinctive badges of na- tionality after they have been correspondingly regis- tered. "The nations shall endeavor, when there is aerial warfare, not to harm neutral countries and endeavor not to restrict the commerce of neutral nations. "Aeroplanes shall be employed by the Red Cross for acts of mercy. "To facilitate aerial locomotion and to produce uni- form legislation, a congress will be called to draft a universal code." Through the War Department Air Service the Committee is informed that at the present time there is no Federal law in existence for the registration of aircraft nor for the licensing of operators. Under the President's proclamation of February 28, 1918, all persons who wished to operate air- craft over the United States or its territories were required to obtain licenses from the Joint Army and Navy Board on Aero- nautic Cognizance. This proclamation, which was a war meas- ure, was, however, rescinded on July 31, 1919. At the present time the only law which may be considered to control air traffic in the United States is that covered in a ruling of the Solicitor for the Department of Commerce. The only other restrictions are those contained in local laws and ordinances in the following localities: State of Con- necticut, State of Massachusetts, County of Los Angeles, Cali- fornia ; City of Newark, New Jersey ; Atlantic City, New Jersey; Town of Nutley, New Jersey, and Kissimee, Florida.
