PREFACE The amendment of Section 1391 of the Code of Civil Proced- ure authorizing garnishee execution in this State was of the utmost importance to creditors and attorneys seeking to enforce collection of their claims. It was the first time that accruing salary of a debtor could be reached, as supplementary proceed- ings have never been available for that purpose. Notwithstand- ing the fact that the statute authorizing garnishee execution is embraced in but one section.of the.Code, and is merely a part of that section, yet its language is by no means clear, and con- siderable difficulty has arisen in its interpretation. It has re- quired the aid of the courts to construe its meaning and point to attorneys the correct procedure. On this account, the need for a careful and systematic treatment of this subject in the form of a text book has become imperative. Realizing this, the author has made an extended study of this subject and given careful consideration to all the decisions thereunder, and the following volume covering that and Supplementary Proceedings has resulted therefrom. An urgent need for a modern and practical treatment of Sup- plementary Proceedings has also arisen, due to the fact that no work written expressly upon that subject has been published within a period of nearly twenty years. A great number of decisions have been handed down since that time and the stat- utes giving this remedy have also been amended during that period. The remedy of supplementary proceedings, in many respects, is by no means clear and simple. The various sec- tions of the Code involved are not always harmonious, and a iii iv PREFACE. careful consideration of the decisions has been necessary to ob- tain the true rules governing thereunder. Throughout this whole work, there has been kept continually in view the fact that too many text books have been made by throwing together the decisions without statement by the author of the prevailing and governing rules. The attorney of to-day, in the active stress of practice, needs books that are carefully edited and which give him the meat of the decisions in clear and concise language, with an exhaustive analysis of the sub- jects involved and a usable and practical index showing every question covered. This work has been written along these lines and every effort employed by testing, careful checking back and repeated proof reading to secure the highest degree of accuracy, and continued use of the work will disclose whether this degree has been attained. The author will appreciate sug- gestions and constructive criticisms from the Bar relating to matters treated in either part of the book. Much time and research has been spent upon the forms in- cluded in this work to make them usable and reliable, and it is hoped that they will prove of great value to attorneys.
